The blood-laden birth-pangs of the Indian "nation-state" undoubtedly had a bearing on the contentious issue of group rights for cultural minorities. Indeed, the trajectory of the concept ‘minority rights’ evolved amidst multiple conceptualizations, political posturing and violent mobilizations and outbursts. Accommodating minority groups posed a predicament for the fledgling "nation-state" of post-colonial India. This book compares and contrasts Muslim and Sikh communities in pre- and post-Partition India. Mapping the evolving discourse on minority rights, the author looks at the overlaps between the Constitutional and the majoritarian discourse being articulated in the public sphere and poses questions about the guaranteeing of minority rights. The book suggests that through historical ruptures and breaks , communities oscillate between being minorities and nations. Combining archival material with ethnographic fieldwork, it studies the identity groups and their vexed relationship to the ideas of nation and nationalism. It captures meanings attributed to otherwise politically loaded concepts such as nation, nation-state and minority rights in the everyday world of Muslims and Sikhs and thus tries to make sense of the patterns of accommodation, adaptation and contestation in the life-world. Successfully confronting and illuminating the challenge of reconciling representation and equality both for groups and within groups, this exploration of South Asian nationalisms and communal relations will be of interest to academics in the field of South Asian Studies, in particular Sociology and Politics.

Plural societies all over the world are facing the challenge of integrating the minorities into mainstream polity and society. India is a land of many languages, cultures and religions. It is an ideal place where one can see the minorities in their different dimensions. It is the home to the second largest Muslim population in the world, and their integration into mainstream politics has remained a challenge to the secular polity of India. By making religious community a relevant category for discussing development deficit, the Sachar Committee Report (that was submitted to the Prime Minister of India in 2007) initiated a new political discourse in India. While the liberal secular framework privileged the individual over the community and was more inclined to use the category of class rather than the identity of religion, the Sachar Committee differentiated citizens on the basis of their religious identity. Its conclusions reinforced the necessity of approaching issues of development through the optic of religious community. This volume focuses on this shift in public policy. The articles in this collection examine the nature and implications of this new approach to the Indian social reality. Taking a close look at the findings of the Sachar Committee Report (SCR) they highlight the challenges posed by inter-community comparisons. At another level the articles supplement the debate initiated by the SCR by constructing a profile of religious communities in India so as to factor in their concerns of development into the present discourse and to nuance and modify the simple indicators to which development is often reduced. As most religious communities are themselves engaged in development-related activities the volume also examines some of these initiatives in order to see what development connotes to the members themselves and what receives attention by the community. Students of social sciences and development studies as well as those dealing with issues of marginalization will find this collection an invaluable resource for understanding contemporary India and for undertaking further theoretical and empirical research.

The six main United Nations human rights treaties enjoy almost universal ratification today. Almost 80 per cent of the possible ratifications have been made, and every Member State of the UN has ratified at least one of these treaties. The nearly universal acceptance of the treaties on the formal level, however, does not automatically translate into the norms contained in these documents being made a reality in the lives of the billions of people living in these countries. The treaty system is notoriously weak in terms of international enforcement, and there is a general suspicion that it has had little impact at the domestic level. Mechanisms to improve the international enforcement mechanisms of the six main treaties have been a topic of discussion and research for many years, but the domestic impact of the treaties has never been investigated in a systematic and comprehensive manner. This book constitutes the most ambitious attempt so far to establish the impact of the treaties at the domestic level. The following treaties in 20 United Nations Member States are investigated: the Convention on the Elimination of All Forms of Racial Discrimination, the Covenant on Economic, Social, and Cultural Rights, the Covenant on Civil and Political Rights, the Convention on the Elimination of All Forms of Discrimination Against Women, the Convention Against Torture, and the Convention on the Rights of the Child. This book reflects the findings of 20 researchers, based in the countries investigated, under the leadership of Professors Christof Heyns and Frans Viljoen of the Centre for Human Rights, University of Pretoria, in a study done in co-operation with the United Nations High Commissioner for Human Rights. The influence of the treaties in each of the 20 countries is investigated in respect of its influence on the continuation, legislation, court cases, policies and practices, and the impact of the treaty system in civil society. In an overview chapter by the study leaders based on a comparison of the available data, common trends and patterns are identified, and recommendations about reforms on the national and international level are made. This is a book that should be read by all those interested in the development of the international human rights system.

Multiculturalism in the British Commonwealth examines cultural diversity across the postwar Commonwealth, situating modern multiculturalism in its national, international, and historical contexts. Bringing together practitioners from across the humanities and social sciences to explore the legal, political, and philosophical issues involved, these essays address common questions: What is postwar multiculturalism? Why did it come about? How have social actors responded to it? Offering a global history of India's refugee regime, Making Refugees in India explores how one of the first postcolonial states during the mid-twentieth century wave of decolonisation rewrote global practices surrounding refugees - signified by India's refusal to sign the 1951 UN Refugee Convention. In broadening the scope of this decision well beyond the Partition of India, starting with the so called 'Wilsonian moment' and extending to the 1970s, the refugee is placed within the postcolonial effort to address the inequalities of the subject-citizenship of the British empire through the fullest realisation of self-determination. India's 'strategically ambiguous' approach to refugees is thus far from ad hoc, revealing a startling consistency when viewed in conversation of postcolonial state building and anti-imperial worldmaking to address inequity across the former colonies. The anti-colonial cry for self-determination as the source of all rights, it is revealed in this work, was in tension with the universal human rights that focused on the individual, and the figure of the refugee felt this irreconcilable difference most intensely. To elucidate this, this work explores contrasts in Indians' and Europeans' rights in the British empire and in World War Two, refugee rehabilitation during Partition, the arrival of the Tibetan refugees, and the East Pakistani refugee crisis. Ria Kapoor finds that the refugee was constitutive of postcolonial Indian citizenship, and that assistance permitted to refugees - a share of the rights guaranteed by self-determination - depended on their potential to threaten or support national sovereignty that allowed Indian experiences to be included in the shaping of universal principles.

This volume brings together a collection of essays analysing the current scenario in South and Southeast Asia with respect to the position of minority groups. Based on an in-depth investigation of some of the lasting minority–majority conflicts of the post-colonial period in countries that often escape comparison, the articles are a rich and critical exposition of the social, economic, cultural and political dimensions of these struggles. The central question being addressed is that of community rights in the modern nation-state and how these are being understood by the two concerned parties and, where and when, thereof, a situation of conflict arose.

This volume assembles renowned scholars to address, for the first time, the relationship between minorities and populism in South Asia and Europe from a critical perspective. Despite the very different and to some extent opposite historical and political trajectories, there is today a convergence on nationalist affirmation and on majoritarian politics between South Asia and Europe. In India, the Hindu majority rebels against wide-ranging minority rights anchored in the Constitution. In Europe, the refugee crisis and Islamic radicalization bring to the forefront the postcolonial legacy. Despite all rhetoric, there are obvious dangers of majoritarianism. Populist parties are divisive, partisan, disregard minority rights, engage in lynching, social division, stigmatization and exclusion, turning minorities into second-class citizens. There is a profound structural connection between minorities and the current rise of populism in India and Europe. But there remains a deep perplexity and also anxiety: Does the presence of minorities necessarily have to trigger majoritarian policies? Are there no solutions to this dilemma? Many observers considered multicultural policies and affirmative action programs in India as a possible model for Europe to adopt in order to achieve greater integration. But eventually they seem to have failed. Why so? Are multiculturalism and the recognition of differences still options today? On the other hand, most scholars in India typically reject the European model of liberal democracy and secularism as impracticable in India and locate the reason for the current malaise in the west. But is liberal democracy really so bad in dealing with pluralism? This volume, collecting a selection of the Reset DOC Venice-Padua-Delhi dialogue series, is going to answer two fundamental questions. First, what precisely is the nexus between minorities and populism in South Asia and Europe? Starting from those case studies, the authors will also draw some general theoretical inferences about the nature of populism. Secondly, given the dangers of populism for minorities, the volume will look for the most adequate and feasible solutions.
