The purpose of this book is to provide a consolidated collection of materials to facilitate comparison of the various national human rights institutions (NHRIs) already established in the Asia-Pacific region, against a background of selected international materials and with the assistance of several comparative tables. The latter are not intended to be exhaustive, but are designed to assist in identifying and considering the strengths and weaknesses inherent in the legislative mandates of each national institution. While the collection is primarily intended for teaching purposes, it should also be useful to countries considering establishing a national human rights commission or, for those which have already done so, strengthening its mandate. For this reason several sections have been included outlining the relationship which should exist between NHRIs, the Executive, the Legislature, the Judiciary and other related institutions and a short section on the importance of the process which should precede their establishment.

The Asia-Pacific region is known for having one of the least developed institutional mechanisms for protecting human rights. This edited collection makes a timely and distinctive contribution to contemporary debates about strengthening the institutional protection of human rights in the Asia-Pacific region, in the wake of ASEAN’s announcement in 2009 of an ASEAN regional human rights mechanism. Drawing together leading scholarly voices including Surya Deva, V.T. Thamilmaran, Tom Zwart and Catherine Renshaw, the book focuses on the systemic issue of institutionalizing human rights protection in the Asia-Pacific. It critically examines the prospects for deepening and widening the institutionalization of human rights monitoring in the region, challenging the orthodox scepticism about whether Asia is "ready" for stronger institutions. The volume analyses the impediments to institutions, whilst questioning the need for them.

This book reviews Southeast Asia’s National Human Rights Institutions (NHRIs) as part of an emerging assessment of a nascent regional human rights architecture that is facing significant challenges in protecting human rights. The book asks, can NHRIs overcome its weaknesses and provide protection, including remedies, to victims of human rights abuses? Assessing NHRIs’ capacity to do so is vital as the future of human rights protection lies at the national level, and other parts of the architecture—the ASEAN Intergovernmental Commission on Human Rights (AICHR), and the international mechanism of the Universal Periodic Review (UPR)—though helpful, also have their limitations. The critical question the book addresses is whether NHRIs individually or collaboratively provide protection of fundamental human rights. The body of work offered in this book showcases the progress of the NHRIs in Southeast Asia where they also act as a barometer for the fluid political climate of their respective countries. Specifically, the book examines the NHRIs’ capacity to provide protection, notably through the pursuit of quasi-judicial functions, and concludes that this function has either been eroded due to political developments post-establishment or has not been included in the first place. The book’s findings point to the need for NHRIs to increase their effectiveness in the protection of human rights and invites readers and stakeholders to find ways of addressing this gap.

The Asian Yearbook of International Law is a major refereed publication dedicated to international law issues as seen primarily from an Asian perspective. This is a special publication of its kind edited by a team of leading international law scholars from across Asia. The Asian Yearbook of International Law provides a forum for the publication of articles in the field of international law, and other Asian international law topics, written by experts from the region and elsewhere. Its aim is twofold: to promote international law in Asia, and to provide an intellectual platform for the discussion and dissemination of Asian views and practices on contemporary international legal issues. As a rule, each volume of the Asian Yearbook normally contains articles; notes; a section on State practice; an overview of the participation of Asian countries in multilateral treaties; a chronicle of events and incidents; surveys of the activities of international organizations which have special relevance to Asia, such as a survey of the activities of the Asian-African Legal Consultative Committee; and book review, bibliography and documents sections.

National Human Rights Institutions (NHRIs) – human rights commissions and ombudsmen – have gained recognition as a possible missing link in the transmission and implementation of international human rights norms at the domestic level. They are also increasingly accepted as important participants in global and regional forums where international norms are produced. By collecting innovative work from experts spanning international law, political science, sociology and human rights practice, this book critically examines the significance of this relatively new class of organizations. It focuses, in particular, on the prospects of these institutions to effectuate state compliance and social change. Consideration is given to the role of NHRIs in delegitimizing – though sometimes legitimizing – governments' poor human rights records and in mobilizing – though sometimes demobilizing – civil society actors. This is the first Commonwealth-wide comparative study of national human rights institutions (NHRIs), and is designed to help everyone interested in establishing and developing NHRIs to improve their effectiveness. The study looks at the international framework for the protection of human rights, and the historical and political background to the establishment of NHRIs and ombudsman offices. The individual mandates of various institutions are considered, looking at them region by region. Finally, the study compares the normative framework and mandates of the NHRIs are analysed, comparing what NHRIs are empowered to do and what they are doing in practice, though value judgements as to the merits and demerits of individual named institutions are avoided. Rather than provide a detailed theoretical analysis, the study concentrates on helping practitioners and policy-makers improve the working of NHRIs in practice, and will be a useful tool both to the institutions themselves and to all those who wish to support them.

Sovereignty-the authority of a state to wield ultimate power over its territory, its citizens, its institutions-is everywhere undergoing change as states respond in various ways to the challenges posed, from above and below. "Above" the state is the widening net of international institutions and treaties dealing with human rights, trade, investment, and monetary affairs; and "below" it are rising claims within states from long-resident groups discontented with the political order and from new migrants testing its authority. Sovereignty under Challenge deals with a range of such challenges and responses, analyzed in authoritative studies by leading scholars. The introductory chapter sets forth the theme that sovereignty is asserted clearly, but often unpredictably, when governments respond to challenge. It suggests ways of classifying these responses as variables that help explain the changing nature of sovereignty. Part 1, "The Citizen and the State," treats the rising tide of dual citizenship and the concerns this arouses in the United States; the work of national human rights commissions in Asia; and the challenge posed to the state by the Falungong movement in China. The two chapters in Part 2, "The Government as Decision-Maker," examine Japan's response to global warming and the problems of the World Health Organization in orchestrating collaboration among Southeast Asian states in implementing infectious disease control. Part 3, "Sovereignty and Culture," looks at conflicts engendered by outside change on indigenous economic, cultural, and legal institutions in India, Fiji, Indonesia, and Malaysia. The chapters in Part 4, "Sovereignty and the Economy," analyze the economic and cultural instability induced by Chinese migration to Russia's far east; the impact on state sovereignty brought about by transnational regulatory campaigns and social activism; the question of indigenous land rights in the Philippines; and the impact of transnational corporations on information technology in Asia. A concluding chapter offers a global assessment of the current status of state sovereignty.

Offering a comparative case study of transitional justice processes in Afghanistan and Nepal, this book critically evaluates the way the "local" is consulted in post-conflict efforts toward peace and reconciliation. It argues that there is a tendency in transitional justice efforts to contain the discussion of the "local" within religious and cultural parameters, thus engaging only with a "static local," as interpreted by certain local stakeholders. Based on data collected through interviews and participant observation carried out in the civil societies of the respective countries, this book brings attention to a "dynamic local," where societal norms evolve, and realities on the ground are shaped by shifting power dynamics, local hierarchies, and inequalities between actors. It suggests that the "local" must be understood as an inter-subjective concept, the meaning of which is not only an evolving and moving target, but also dependent on who is consulted to interpret it to external actors. This timely book engages with the divergent range of civil society voices and offers ways to move forward by including their concerns in the efforts to help impoverished war-torn societies transition from a state of war to the conditions of peace.

Many publications dealing with human rights contain a wealth of materials from the United Nations, Europe, and even the Inter-American and African regional human rights systems, but none cover the geographical region which encompasses Asian and Pacific states. The collection of documents contained in this volume is an attempt to rectify this situation. A unique reference tool to those with an interest in human rights in Asia and the Pacific, be they students of law, Asian studies or international relations, or lawyers or researchers using human rights materials, this volume contains various inter-governmental and non-governmental documents, as well as a section on numerous human rights organisations and resources. Despite the Asia-Pacific area now being the world's only region without a human rights instrument, the volume of constitutional provisions, treaty provisions, governmental and non-governmental declarations on human rights as well as other types of relevant documents is very substantial, putting to lie the argument that human rights are of little concern or secondary to other considerations. This huge amount of material has made it necessary to edit certain documents to their most essential elements. Other documents are included in their entirety where they are deemed to be of particular significance.
