Modern conflicts now bear little relation to traditional wars between states. The threat of terrorism, the creation of new military technologies, the rise of private military companies, and the increasing involvement of the military in counter-terrorism and humanitarian operations all pose challenges to traditional ideas about the ethics of war, the relevance of current international law governing armed conflict, and Just War theory. How, then, should military ethics approach these new forms of conflict? Modern military ethics now includes work from disciplines as diverse as philosophy, history, sociology, international relations, politics, and psychology. This diversity of approaches suggests that the approach to contemporary military ethics that is best suited to understanding the wars of today is a broad multidisciplinary vision. New Wars, New Militaries, New Soldiers?

This book addresses the ambiguities of the growing use of private security contractors and provides guidance as to how our expectations about regulating this expanding ‘service’ industry will have to be adjusted. In the warzones of Iraq and Afghanistan many of those who carry weapons are not legally combatants, nor are they protected civilians. They are contracted by governments, businesses, and NGOs to provide armed security. Often mistaken as members of armed forces, they are instead part of a new protean proxy force that works alongside the military in a multitude of shifting roles, and overseen by a matrix of contracts and regulations. This book analyzes the growing industry of these private military and security companies (PMSCs) used in warzones and other high risk areas. PMSCs are the result of a unique combination of circumstances, including a change in the idea of soldiering, insurance industry analyses that require security contractors, and a need for governments to distance themselves from potentially criminal conduct. The book argues that PMSCs are a unique type of organization, combining attributes from worlds of the military, business, and humanitarian organizations. This makes them particularly resistant to oversight. The legal status of these companies and those they employ is also hard to ascertain, which weakens the multiple regulatory tools available. PMSCs also fall between the cracks in ethical debates about their use, seeming to be both justifiable and objectionable. This transformation in military operations is a seemingly irreversible product of more general changes in the relationship between the individual citizen and the state. This book traces the history of private military companies, with a special focus on UK private forces. Christopher Kinsey examines the mercenary companies that filled the ranks of many European armies right up to the 1850s, the organizations that operated in Africa in the 1960s and early 1970s, the rise of legally established private military companies in the late 1970s and early 1980s, and today’s private and important actors in international security and post-conflict reconstruction. He shows how and why the change from the mercenary organizations of the 1960s and 1970s came about, as the increasing newness of private military companies came to be recognised. It then examines how PMCs have been able to impact upon international security. Finally, Kinsey looks at the type of problems and advantages that can arise for organizations that decide to use private military companies and how they can make an unique contribution to international security. Contemporary war is as much a quest for decisive technological, organizational, and doctrinal superiority before the fighting starts as it is an effort to destroy enemy militaries during battle. Armed forces that are not actively fighting are instead actively reengineering themselves for success in the next fight and imagining what that next fight may look like. Since the end of bipolarism, the concept of asymmetric warfare, and of asymmetric conflict in general, has been increasingly applied with regard to armed forces activities and tasks. This book presents the findings of comparative empirical research conducted in selected military units by a group of distinguished experts on military organization, who hail from the eight participating countries: Bulgaria, Cameroon, Denmark, Finland, Italy, Lithuania, the Philippines and Spain. It discusses remarks made by military leaders with extensive experience in the field regarding current doctrines on military leadership and their applicability in the field, as well as proposals and suggestions for new directions. “It is a complex relation, always based on respect and politeness, but often with mismatched interests.” (Army Colonel). “It makes you realize that there is a cultural gap. You must firstly understand who you are going to relate to, and the culture of these people, and then try to establish a certain kind of relationship. Often the platoon commander states his objective and must try to establish a relationship, contact with the village chief.” (Army Lieutenant, Platoon Commander). “[In Afghanistan] We had meals with the locals, sometimes the food didn’t taste good, but you had to eat it if you wanted to be welcomed back again” (Army Captain, Company Commander). Military professionals, and military leaders in particular, perceive themselves as facing ambiguous situations that require an update in their professional training, and new skills to confront unexpected and unpredictable factors. Drawing on lived experiences, the book offers insights into what a new kind of leadership means when leaders have to cope with diverse and unclear missions. It also addresses leadership styles and behaviours, as well as individual adaptive behaviours on the part of military leaders, with special reference to middle and middle-high level ranks, such as captains, majors and colonels. Given its scope, the book will appeal not only to military professionals and military affairs scholars and experts, but also to readers interested in gaining a better understanding of the challenges that international expeditionary units are facing in crisis areas around the globe.

During combat, soldiers make life-and-death choices dozens of times a day. These individual decisions accumulate to determine the outcome of wars. This work examines the theory and practice of military ethics in counterinsurgency operations. Marcus Schulzke surveys the ethical traditions that militaries borrow from; compares ethics in practice in the US Army, British Army and Royal Marines Commandos, and Israel Defense Forces; and draws conclusions that may help militaries refine their approaches in future conflicts. The work is based on interviews with veterans and military personnel responsible for ethics training, review of training materials and other official publications, published accounts from combat veterans, and observation of US Army focus groups with active-duty soldiers. Schulzke makes a convincing argument that though military ethics cannot guarantee flawless conduct, incremental improvements can be made to reduce war’s destructiveness while improving the success of counterinsurgency operations.

This book examines how U.S. domestic institutions stand up to global threats and whether intelligence sharing across military and civilian law enforcement barriers is legal. The U.S. Constitution is designed to distribute power in order to prevent its concentration, and in particular, it draws clear lines between the responsibilities of the military and those of civilian law enforcement. But the new global threat paradigm, requiring responses both abroad and at home, calls out for military and civilian intelligence gathering to work in tandem. The Civil-Military Divide: Obstacles to the Integration of Intelligence in the United States looks at historic and legal ramifications of such efforts. Louise Stanton's thought-provoking work sums up the current state of U.S. intelligence gathering at all levels of government. It then looks at the range of recommendations for overhauling our intelligence efforts in the context of the U.S. Constitution to assess what may or may not be constitutionally supportable. At issue are three long-established, often reaffirmed principles: the separation of powers, the federalist system that gives the U.S. government precedence over states, and the separation of the civilian and military sectors.

The primary objective of this book is to understand the nature of the Boko Haram insurgency in northeast Nigeria. Boko Haram’s goal of an Islamic Caliphate, starting in the Borno State in the North East that will eventually cover the areas of the former Kanem-Borno Empire, is a rejection of the modern state system forced on it by the West. The central theme of this volume examines the relationship between the failure of the state-building project in Nigeria and the outbreak and nature of insurgency. At the heart of the Boko Haram phenomenon is a country racked with cleavages, making it hard for Nigeria to cohere as a modern state. Part I introduces this theme and places the Boko Haram insurgency in a historical context. There are, however, multiple cleavages in Nigeria ̶ ethnic, regional, cultural, and religious ̶ and Part II examines the different state-society dynamics fuelling the conflict. Political grievances are common to every society; however, what gives Boko Haram the space to express such grievances through violence? Importantly, this volume demonstrates that the insurgency is, in fact, a reflection of the hollowness within Nigeria’s overall security. Part III looks at the responses to Boko Haram by Nigeria, neighbouring states, and external actors. For Western actors, Boko Haram is seen as part of the "global war on terror" and the fact that it has pledged allegiance to ISIS encourages this framing. However, as the chapters here discuss, this is an over-simplification of Boko Haram and the West needs to address the multiple dimension of Boko Haram. This book will be of much interest to students of terrorism and political violence, insurgencies, African politics, war and conflict studies, and IR in general.
