The number of non-citizens processed in the Federal criminal justice system increased an average 10% annually from 1984 to 1994. During 1984, 3,462 non-citizens were prosecuted in U.S. district courts; during 1994, more than 10,000 were prosecuted. The overall Federal criminal caseload increased at a much slower rate between 1984 and 1994 -- an average of less than 2% annually. During 1984, 49,000 defendants were prosecuted in U.S. district courts; during 1994 approx. 59,000 were prosecuted. The increase in the overall number of non-citizens prosecuted is primarily the result of the increase in the number of non-citizens charged with drug offenses. Illustrations. Congress is considering a comprehensive overhaul of the nation¿s immigration laws more than a decade after the enactment of strict immigration measures. Current U.S. immigration laws mandate deportation of lawful permanent resident (LPR) parents of thousands of U.S. citizen children, without providing these parents an opportunity to challenge their forced separations. Through a multi-disciplinary analysis, this policy brief examines the experiences of U.S. citizen children impacted by the forced deportation of their LPR parents and proposes ways to reform U.S. law consistent with domestic and international standards aimed to improve the lives of children.
