The peaceful end of apartheid in South Africa was a monumental event in late twentieth century history. A racist regime built upon a foundation of colonialist exploitation, South Africa had become by that point a tinderbox: suffused with day-to-day violence and political extremism on all sides. Yet two decades later it was a stable democracy with a growing economy. How did such a deeply divided, conflicted society manage this remarkable transition? In When Political Transitions Work, Fanie du Toit, who has been a participant and close observer in post-conflict developments throughout Africa for decades, offers a new theory for why South Africa's reconciliation worked and why its lessons remain relevant for other nations emerging from civil conflicts. He uses reconciliation as a framework for political transition and seeks to answer three key questions: how do the reconciliation processes begin; how can political transitions result in inclusive and fair institutional change; and to what extent does reconciliation change the way a society functions? Looking at South Africa, one of reconciliation's most celebrated cases, Du Toit shows that the key ingredient to successful reconciliations is acknowledging the centrality of relationships. He further develops his own theoretical approach to reconciliation-as-interdependence-the idea that reconciliation is the result of an integrated process of courageous leadership, fair and inclusive institutions, and social change built toward a mutual goal of prosperity. As Du Toit conveys, the motivation for reconciliation is the long-term well-being of one's own community, as well as that of enemy groups. Without ensuring the conditions in which one's enemy can flourish, one's own community is unlikely to prosper sustainably.

Shortlisted for the 2013 BISA IPEG Book Prize, this book explores how Eastern Europe’s post-communist transition can only be understood as part of a broader interrogation of neoliberal hegemony in the global political economy, and provides a detailed historical account of the emergence of neoliberalism in Eastern Central Europe. Adopting an innovative Gramscian approach to post-communist transition, this book charts the rise to hegemony of neoliberal social forces. Using transition in Poland as a starting point, the author traces how particular social forces most intimately associated with transnational capital successful in the struggle over competing reform strategies. Transition is broken down into three stages; the "first wave" illustrates how the rise of particular social forces shaped by global change gave rise to a neoliberal strategy of capitalism from the 1970s. It goes on to show how the political economy of Europeanization, associated with EU enlargement instilled a "second wave" of neoliberalisation. Finally, exploring recent populist and left wing alternatives in the context of the current financial crisis, the book outlines how counter-hegemonic struggle might oppose a "third wave" neoliberalisation. Peaceful legal and political ‘changing of the guards’ is taken for granted in developed democracies, but is not evident everywhere. As a relatively new democracy, marred by long periods of military rule, Bangladesh has been encountering serious problems because of a prevailing culture of mistrust, weak governance institutions, constant election manipulation and a peculiar socio-political history, which between 1990 and 2011 led to a unique form of transitional remedy in the form of an unelected neutral ‘caretaker covernment’ (CTG) during electoral transitions. This book provides a contextual analysis of the CTG mechanism including its inception, operation, manipulation by the government of the day and abrupt demise. It queries whether this constitutional provision, even if presently abolished after overseeing four acceptable general elections, actually remains a crucial tool to safeguard free and fair elections in Bangladesh. Given the backdrop of the culture of mistrust, the author examines whether holding national elections without a CTG, or an umpire of some kind, can settle the issue of credibility of a given government. The book portrays that even the management of elections is a matter of applying pluralist approaches. Considering the historical legacy and contemporary political trajectory of Bangladesh, the cause of deep-rooted mistrust is examined to better understand the rationale for the requirement, emergence and workings of the CTG structure. The book unveils that it is not only the lack of nation-building measures and governments’ wish to remain in power at any cost which lay behind the problems that Bangladesh faces today. Part of the problem is also the flawed logic of nation-building on the foundation of Western democratic norms which may be unsuitable in a South Asian cultural environment. Although democratic transitions, on the crutch of the CTG, have been useful in moments of crisis, its abolition creates the need for a new or revised transitional modality – perhaps akin to the CTG ethos – to oversee electoral governance, which will have to be renegotiated by the polity based on the people’s will. The book provides a valuable resource for researchers and academics working in the area of constitutional law, democratic transition, legal pluralism and election law.
