Disputes and dispossession of property rights in the mining sector are causes of injustice, violence, and forced resettlement around the world. This comprehensive volume examines mining, particularly what is often called ‘Artisanal and Small-Scale Mining’, from a perspective of governance and rights. It focuses on rights to land, natural resources, and other forms of material ‘property’. Many projects, policies, and laws targeting artisanal and small-scale mining are embedded in problematic conceptual and institutional frameworks that implicitly stigmatise and discipline artisanal and small-scale miners. This collection takes a critical look at notions of property to destabilise some of these frameworks. The chapters in this book are notable for their recognition of the agency of artisanal miners and ‘local communities’ within the uneven hierarchies in which they are embedded, and their acknowledgement of the difficulties of state regulation of such a complex set of issues. The authors use a variety of theoretical tools, engaging with political economy, political ecology, classical economic theory, and socio-cultural concepts derived from ethnographic methods. This book includes insightful case studies from Colombia, Democratic Republic of Congo, Ghana, Mongolia, South Africa, and Zambia, and is an important resource for academics, development practitioners, and policy-makers. When the guns are silenced, those who have survived armed conflict need food, water, shelter, the means to earn a living, and the promise of safety and a return to civil order. Meeting these needs while sustaining peace requires more than simply having governmental structures in place; it requires good governance. Natural resources are essential to sustaining people and peace in post-conflict countries, but governance failures often jeopardize such efforts. This book examines the theory, practice, and often surprising realities of post-conflict governance, natural resource management, and peacebuilding in fifty conflict-affected countries and territories. It includes thirty-nine chapters written by more than seventy researchers, diplomats, military personnel, and practitioners from governmental, intergovernmental, and nongovernmental organizations. The book highlights the mutually reinforcing relationship between natural resource management and good governance. Natural resource management is crucial to rebuilding governance and the rule of law, combating corruption, improving transparency and accountability, engaging disenfranchised populations, and building confidence after conflict. At the same time, good governance is essential for ensuring that natural resource management can meet immediate needs for post-conflict stability and development, while simultaneously laying the foundation for a sustainable peace. Drawing on analyses of the close relationship between governance and natural resource management, the book explores lessons from past conflicts and ongoing reconstruction efforts; illustrates how those lessons may be applied to the formulation and implementation of more effective governance initiatives; and presents an emerging theoretical and practical framework for policy makers, researchers, practitioners, and students. Governance, Natural Resources, and Post-Conflict Peacebuilding is part of a global initiative to identify and analyze lessons in post-conflict peacebuilding and natural resource management. The project has generated six books of case studies and analyses, with contributions from practitioners, policy makers, and researchers. Other books in this series address high-value resources, land, water, livelihoods, and assessing and restoring natural resources.

This edited collection brings together a broad range of case studies to highlight the role of Canadian corporations in producing, deepening and exacerbating conditions of dispossession both at home and abroad. Rather than presented as instances of exceptional greed or malice, the cases are described as expected and inherent consequences of contemporary capitalism and/or settler colonialism. A core purpose of the book is to combine and synthesize analyses of dispossession within and outside of Canada. While the literature tends to treat the two as distinct and unrelated phenomena, these processes are often connected, as the normalization of settler colonialism at home can lead to indifference and acceptance of dispossession caused by Canadian companies abroad. This book brings local and global cases together in order to present a rigorous analysis of the role of Canadian corporate activity in processes of dispossession. The book includes a diversity of theoretical approaches related to the overarching theme of capitalism and dispossession; however, they share a critical analysis of capitalism and its implications on marginalized peoples at home and abroad. Included are political economy approaches that draw on the work of theorists such as David Harvey, important interventions from Indigenous and settler colonial studies, feminist approaches using the work of scholars such as Silvia Federici and the concept environmental racism, which draws on both critical race theory and environmental justice literature.

The main theme of this book is the social dimension of the circular economy (CE). This book’s objective is to provide a foundation for the discussion of social aspects of CE that also allows the integration of CE with the UN SDGs. The circular economy is increasingly becoming the consensual pathway for a transition towards sustainable production and consumption that balances the economic and ecological pillars of sustainable development. However, researchers have noted that the social dimension of sustainable development is noticeable missing or, at best, weakly developed in CE ideas and frameworks (Sehnem et al., 2019). The main argument of this book is that CE research and practice needs to embrace its social impacts, not only in terms of understanding and avoiding negative social impacts but also in terms of exploring the potential that CE models have for addressing social challenges.

This volume examines the impact of globalization on international environmental law and the implementation of sustainable development in the Global South. Comprising contributions from lawyers from the Global South or who have experience in the Global South, this volume is organized into three parts, with a thematic inquiry woven through every chapter to ask how law can enable economies that can be sustained, given the limited carrying capacity of the earth. Part I describes and characterizes the status quo of environmental and economic problems in the Global South during the process of globalization. Some of those problems include redistribution of environmental burden on the public through over-reliance on the state in emerging economies and the transition to public-private partnerships, as well as extreme uncontrolled economic expansion. Building on Part I, Part II takes an international perspective by presenting some tools that are in place during the process of globalization that lead to friction and interfaces between developed and developing economies in environmental law. Recognizing the impossibility of a globalized Northern economy, the authors in Part III present some alternatives through framework ideas of human and civil rights, environmental rights, and indigenous persons’ rights, as well as concrete and specific legal tools to strengthen justice and rule of law institutions. The book gives new perspectives to familiar approaches through concrete examples by professional practitioners and theoretical discourse by academic researchers, and can thereby form the basis for changes in practices, as well as further discussions and comparisons. This book will be of great interest to students and scholars of environmental law, sustainable development, and globalization and international relations, as well as legal professionals and practitioners.

This book explores the various issues that characterise the African mining sector, drawing examples from different African countries and regional organisations. The subject of local government and post-conflict reconstruction sits at the intersection of several interrelated research areas, notably conflict/peacebuilding, governance, and political economy. This volume addresses a gap in the academic literature: whilst decentralisation is frequently included in peace agreements, the actual scope and role of local government is far less frequently discussed. This gap remains despite a considerable literature on local government in developing countries more generally, particularly with regard to decentralisation; but also, despite a considerable and growing literature on post-conflict reconstruction. This volume provides a mixture of case study, cross-case studies, practitioner reflection, and conceptual material on the function of local government in the context of decentralisation in post-conflict countries, from both academics and policy-makers.
