This volume unpacks the multidimensional realities of political violence, and how these crimes are dealt with throughout the US judicial system, using a mixed methods approach. The work seeks to challenge the often-noted problems with mainstream terrorism research, namely an overreliance on secondary sources, a scarcity of data-driven analyses, and a tendency for authors not to work collaboratively. This volume inverts these challenges, situating itself within primary-source materials, empirically studied through collaborative, inter-generational (statistical) analysis. Through a focused exploration of how these crimes are influenced by gender, ethnicity, ideology, tactical choice, geography, and citizenship, the chapters offered here represent scholarship from a pool of more than sixty authors. Utilizing a variety of quantitative and qualitative methods, including regression and other forms of statistical analysis, Grounded Theory, Qualitative Comparative Analysis, Corpus Linguistics, and Discourse Analysis, the researchers in this book explore not only the subject of political violence and the law but also the craft of research. In bringing together these emerging voices, this volume seeks to challenge expertism, while privileging the empirical. Political violence has disrupted the lives of millions of children around the world. Responding to the gravity and scale of this phenomenon, this volume is intended to stimulate discussion and research on children's exposure to political violence and its psycho-social effects. It brings together for the first time in a single volume three areas of scientific activity in different disciplines: research on effects, programs for intervention, and laws and policy for prevention of political violence to children. Section I presents reviews of research on children exposed to political violence, including child soldiers and refugee children, as well as an examination of methodology and ethics. Section II contains research on interventions with children exposed to political violence, including individual therapy and school, family, and community interventions. Section III covers legal and social issues in deterring the recruitment of children to violent causes and protecting children in armed conflict. Pulling together the work of leading scholars and practitioners in the social sciences and international law, this volume argues that the prevention of political violence to children is possible, and it provides a crucial basis for ideas for prevention.

The dramatic uprisings that ousted the long-standing leaders of several countries in the Arab region set in motion an unprecedented period of social, political and legal transformation. The prosecution of political leaders took centre stage in the pursuit of transitional justice following the 'Arab Spring'. Through a comparative case study of Egypt, Libya, Tunisia and Yemen, this book argues that transitional justice in the Arab region presents the strongest challenge yet to the transitional justice paradigm. This paradigm is built on the underlying assumption that transitions constitute a shift from non-liberal to liberal democratic regimes, where often legal measures are taken to address atrocities committed during the prior regime. The book is guided by two principal questions: first, what trigger and driving factors led to the decision of whether or not to prosecute former political leaders? And second, what shaping factors affected the content and extent of decisions regarding prosecution? In answering these questions, the book enhances our understanding of how transitional justice is pursued by different actors in varied contexts. In doing so, it challenges the predominant understanding that transitional justice uniformly occurs in liberalising contexts and calls for a re-thinking of transitional justice theory and practice. Using original findings generated from almost 50 interviews across 4 countries, this research builds on the growing critical literature that claims that transitional justice is an under-theorised field and needs to be developed to take into account non-liberal and complex transitions. It will be stimulating and thought-provoking reading for all those interested in transitional justice and the 'Arab Spring'.

This book offers a unique and powerful critique of the quest for international criminal justice. It explores the efforts of three successive generations of international prosecutors, recognising the vital roles they play in the enforcement of international criminal law. By critically examining prosecutorial performance during the pre-trial and trial phases, the volume argues that these prosecutors are simultaneously political actors serving in the interests of economic liberalisation. It also posits that international prosecutors help wage a mostly silent and largely unacknowledged politico-cultural war fought for control over the institutions governing modernist international affairs. As the author contends, international prosecutors are thus best understood as agents not only of the law and politics, but also of a war fought by proponents of various utopian projects.

This book offers a comprehensive analysis of the trial of former Serbian leader Slobodan Milošević at the International Criminal Tribunal for the former Yugoslavia (ICTY). With the premature death of Milošević in March 2006 his trial was left unfinished. Although the traditional objectives of criminal law, such as retribution, justice for victims, and deterrence, were not achieved, the Milošević trial archive is a significant historical resource for researchers from various fields. This book extracts details from the collection of documentary and transcript evidence that makes up the trial record – sources which would be almost impossible to extricate without an insider’s guiding hand – to allow readers to trace the threads of several historical narratives. The value of this methodology is particularly evident in the Milošević case as, acting as his own defence counsel, he responded to, and interacted with, almost all witnesses and evidence presented against him. This book examines the issue of territorial control by violent jihadist groups, using a comparative perspective. The book argues that in many parts of the world the connection between a state and the control over territory is not as close as presented by conventional political maps, and therefore it is necessary to analyse the territoriality of non-state actors as well. Based on a variety of case studies, the work looks at different levels of connection between the violent Islamist groups and territory, dividing them into non-territorial, semi-territorial and territorial groups. While the majority of the cases are located in the Middle East (Islamic State, Al-Qaeda, Al-Qaeda at the Arabian Peninsula, Ha ́yat Tahrir al-Sham, Hamas and Hezbollah), the book also draws cases from Africa (groups in the western Sahel, Al-Shabaab and Boko Haram), South Asia (Taliban), and East Asia (Abu Sayyaf). By providing in-depth understanding of their respective approaches to territory, the book identifies the specifics of each group’s territoriality, while also drawing more general conclusions.
