Over the past several decades, democracy has taken root or been re-established in a number of countries with support from other democratic states and private groups. While the increase in the number of democracies worldwide has been widely heralded, very little has been written on how democracy can be protected and sustained where it has been chosen by the people of a state. In this first comprehensive guide to preventing and responding to threats to coups and erosions in democracies. The future of Europe as a community of democratic states is deeply uncertain. The European Union, founded to promote ‘ever closer’ integration, aims nominally for peaceful, prosperous cooperation. But this ideal has been battered by a series of bruising crises, and now by war. Protecting Democracy in Europe examines how, in this brave new world, the EU can and must safeguard democratic governance within its member states. Reviewing the Union’s past responses, Tom Theuns demonstrates that its existing laws and policies are normatively and expressively incoherent. Its failure to defend democratic values is unsurprising: the EU’s existing toolbox is based on an impoverished conception of democracy, and runs counter to its fundamental principles. Close attention to speeches by European Commissioners shows that they see democracy in a technical and legalistic way. This perspective–‘democracy without politics’–is easy for would-be autocrats to exploit. To protect democracy in Europe, Theuns argues, the EU must urgently correct policies that make it complicit in democratic backsliding. It must contain autocratic influences (within the strict limits of its political authority). And it must cultivate pluralist democracy within its constituent countries. But where this fails, he concludes, autocratic members should be expelled.

Civil Democracy Protection is an overview of attempts by organisations to oppose groups that are perceived to threaten democracy. The book traces the history of civil democracy protection actors from the establishment of democratic constitutional states up to the present day and develops a set of systematic and comparative approaches. The central question it explores is: What significance do civil actors have for the establishment and consolidation of democratic constitutional states, especially in relation to the protection of democracy by state institutions? The volume includes contributions from historians and social scientists, who combine idiographic approaches that focus on the specifics of individual cases with nomothetic approaches that aim to provide generalisable insights, incorporating historical experiences from various European countries and the USA in the 20th and early 21st century. This book analyses unamendability in democratic constitutionalism and engages critically and systematically with its perils, offering a much-needed corrective to existing understandings of this phenomenon. Whether formalized in the constitutional text or developed as part of judicial doctrines of implicit unamendability, eternity clauses raise fundamental questions about the core democratic commitments underpinning any given constitution. The book takes seriously the democratic challenge eternity clauses pose and argues that this goes beyond the old tension between constitutionalism and democracy. Instead, eternity clauses reveal themselves to be a far more ambivalent constitutional mechanism, one with greater and more insidious potential for abuse than has been recognized. The 'dark side' of unamendability includes its propensity to insulate majoritarian, exclusionary, and internally incoherent values, as well as its sometimes purely pragmatic role in elite bargaining. The book adopts a contextual approach and brings to the fore a variety of case studies from non-traditional jurisdictions. These insights from the periphery illuminate the prospects of unamendability fulfilling its intended aims - protecting constitutional democracy foremost among them. With its promise most appealing in transitional, post-conflict, and fragile democracies, unamendability reveals itself, counterintuitively, to be both less potent and potentially more dangerous in precisely these contexts.
