Protecting Human Rights Defenders At Risk

eBook Download

BOOK EXCERPT:

This book assesses the construction, operation and effects of the international protection regime for human rights defenders, which has evolved significantly over the last twenty years in response to the risks people face as they promote and protect human rights. Drawing upon the experiences of human rights defenders who continue to persevere in their activism in Indonesia, Egypt, Kenya, Mexico and Colombia, this edited collection examines the ways in which formal protection mechanisms by state and civil society actors intersect with self-protection measures and informal protection initiatives by families and friends. It highlights that protection practices are most effective when they are designed to address the specific risks that human rights defenders face (which are gendered and intersectional); reflect how defenders understand ‘risk’, ‘security’ and ‘protection’; and are appropriate for the dynamic sociopolitical and legal contexts in which defenders operate. This book proposes ways in which the protection of human rights defenders at risk should be reimagined and practised. This book will be a thought-provoking guide for students and scholars of politics, international relations, law and human rights, as well as to practitioners engaged in the protection of human rights defenders at risk.

Protecting Human Rights In Africa

eBook Download

BOOK EXCERPT:

Selected by Choice magazine as an Outstanding Academic Book for 1996 Since the 1950s, sub-Saharan Africa has been the site of profound political changes initiated by ascendant nationalism and rapid decolonization. With this new beginning came fresh challenges involving many crucial aspects of human rights: self-determination; civil and political rights, including government legitimacy; military involvement in African politics; and unfulfilled basic needs that have cried out for economic and social development. Protecting Human Rights in Africa is the first major comparative study of the way human rights NGOs have brought revolutionary change south of the Sahara. Governments are both the most important protectors and abusers of human rights, while NGOs have become the most effective detectives in discovering abuses and the most active advocates in seeking solutions.

Protecting Human Rights And Building Peace In Post Violence Societies

eBook Download

BOOK EXCERPT:

This book critically examines the relationship between protecting human rights and building peace in post-violence societies. It explores the conditions that must be present, and strategies that should be adopted, for the former to contribute to the latter. The author argues that human rights can aid peacebuilding efforts by helping victims of past violence to articulate their grievance, and by encouraging the state to respond to and provide them with a meaningful remedy. This usually happens either through a process of adjudication, whereby human rights can offer guidance to the judiciary as to the best way to address such grievances, or through the passing and implementation of human rights laws and policies that seek to promote peace. However, this positive relationship between human rights and peace is both qualified and context specific. Through an interdisciplinary and comparative analysis of four case studies, the book identifies the conditions that can support the effective use of human rights as peacebuilding tools. Developing these, the book recommends a series of strategies that peacebuilders should adopt and rely on.

Effective Strategies For Protecting Human Rights

eBook Download

BOOK EXCERPT:

This title was first published in 2001: This book brings together the experiences of a diverse range of leading human rights advocates and activists to demonstrate strategies for protecting human rights. The volume identifies strategic problems and approaches and offers a range of strategies that hold promise for sanctioning human rights offenders and for inhibiting the behaviour of those who might otherwise engage in such activities. The contributors include, inter alia, Noam Chomsky, Justice Richard Goldstone of the Constitutional Court of South Africa who served as Chief Prosecutor of the UN War Crimes Tribunals for the former Yugoslavia and Rwanda, and David Rawson, United States Ambassador to Rwanda during the tragic genocide. Those who work in the disparate field of human rights increasingly understand the need to see the system strategically rather than piecemeal. This volume captures their insights and looks at both private and public actors, including the uses and limitations of international fora to prosecute violations. The focus is expanded to include private actions because political issues too often interfere with enforcement of human rights laws - allowing violators to hide behind the unwillingness of national governments to take action.

Protecting Human Rights In The 21st Century

eBook Download

BOOK EXCERPT:

This book contributes to current debates on the protection of human rights in the 21st century. With the global economic collapse, the rise of the BRICS, the post-intervention chaos in Libya, the migration crisis in Europe, and the regional conflagration sparked by the conflict in Syria, the need to protect human rights has arguably never been greater. In light of the precipitous decline in global respect for human rights and the eruption or escalation of intra-state crises across the world, this book asks 'what is the future of human rights protection?'. Seeking to avoid both denial and fatalism, this book thus aims to: examine the principles at the very foundation of the debate on human rights; diagnose the causes of the decline of liberal internationalism so as to offer guiding lessons for future initiatives; identify those practices and developments that can, and should, be preserved in the new era; question the parameters of the contemporary debate and advance perspectives that aim to identify the contours of future ideas and practices that may offer a way forward. This book will be of much interest to students of humanitarian intervention, R2P, international organisations, human rights and security studies.
