Putting Properties First

eBook Download

BOOK EXCERPT:

Putting Properties First considers the metaphysics of natural science. It develops and defends a contemporary metaphysical theory of natural modality called 'Modal Platonism', which puts properties first in the metaphysical hierarchy. According to this theory, natural properties-such as mass and charge-are fundamental entities which ground the laws of nature and the behavioural dispositions of physical things. This theory differs from other 'properties-first' approaches in two main ways. First, it views properties as Platonic universals, which exist even if they are not instantiated by anything. Second, the theory rejects the popular idea that properties are identical with, or essentially dependent upon, dispositions. Instead, Modal Platonism views properties as qualities which necessarily ground dispositions and other modal phenomena. This theory solves a range of philosophical puzzles regarding dispositions and laws. Given that laws of nature are a necessary precondition for scientific enquiry, Modal Platonism promises to provide a plausible metaphysical framework for all natural science.

Putting Intellectual Property In Its Place

eBook Download

BOOK EXCERPT:

Putting Intellectual Property in its Place examines the relationship between creativity and intellectual property law on the premise that, despite concentrated critical attention devoted to IP law from academic, policy and activist quarters, its role as a determinant of creative activity is overstated. The effects of IP rights or law are usually more unpredictable, non-linear, or illusory than is often presumed. Through a series of case studies focusing on nineteenth century journalism, "fake" art, plant hormone research between the wars, online knitting communities, creativity in small cities, and legal practice, the authors discuss the many ways people comprehend the law through information and opinions gathered from friends, strangers, coworkers, and the media. They also show how people choose to share, create, negotiate, and dispute based on what seems fair, just, or necessary, in the context of how their community functions in that moment, while ignoring or reimagining legal mechanisms. In this book authors Murray, Piper, and Robertson define "the everyday life of IP law", constituting an experiment in non-normative legal scholarship, and in building theory from material and located practice.

Placing Property

eBook Download

BOOK EXCERPT:

This open access book presents a legal geography of property rights in land through the lenses of landscape and critical spatial justice. It seeks to reassert the importance of landscape and place in property as an alternative to abstract concepts of property which dominate contemporary thinking. It investigates property’s origins and uptake in the common law through the lenses of landscape and spatial justice, providing a genealogy of property, from its early origins in pre-feudal Scandinavia to its development as a cornerstone concept in English common law. It offers a new perspective and analytical tools to reconsider many accepted approaches to land in the law today. This book also contributes both to the decolonization of property law and critiques of property’s unsustainability, as well as the examination of the role of law itself in facilitating large scale land changes that destroy place, and the ramifications of this process. As such, it should be of interest to inter-disciplinary scholars working in the socio-legal, environmental and property law fields
