Regional trade blocs are formed by neighbouring countries or countries that are in close proximity to each other. The two key features of a trade bloc is that (1) it involves a cutback or abolition of obstacles to trade, and (2) the trade liberalisation that is attained through the trade bloc is discriminatory in purview of the fact that it is applicable only to the member states of the trade bloc and non-member countries are shown prejudice in their dealings with members of the trade bloc. The first aspect of trade blocs above is in line with the mission of the World trade Organisation (WTO) and its antecedent, the General Agreement on Tariffs and Trade (GATT). The principle of Non-discrimination under the GATT stipulates that no member state shall show prejudice between GATT members during the operations of world trade. In the same magnitude, the WTO offers an environment for negotiating agreements that are focused on reducing barriers to international trade and making sure that trade is carried out on a basis of openness, thus contributing to economic growth as well as development. Notably, although trade blocs have different structures, they are premised on the same objective, that is, to lessen trade barriers among member states. The second aspect of trade blocs however seems to be in conflict with the motive of the GATT/WTO system. The preamble of the GATT is very clear on promoting non-discrimination in international trade by reinforcing the need for reciprocal and equally advantageous arrangements focused on substantial cutbacks in tariffs and other obstacles to trade and to the abolition of discriminatory treatment in international trade. Equally, under the WTO as well as under its predecessor, the GATT, trade discrimination is promoted through the use of the principles of the Most-Favoured-Nation (MFN) that requires treatment of other people equally as pertains to trade and the principle of National Treatment which stipulates that foreigners and locals should be treated equally in trade matters. International trade has, for decades, been central to economic growth and improved standards of living for nations and regions worldwide. For most of the advanced countries, trade has raised standards of living, while for most emerging economies, growth did not begin until their integration into the global economy. The economic explanation is simple: international trade facilitates specialization, increased efficiency and improved productivity to an extent impossible in closed economies. However, recent years have seen a significant slowdown in global trade, and the global system has increasingly come under attack from politicians on the right and on the left. The benefits of open markets, the continuation of international co-operation, and the usefulness of multilateral institutions such as the World Trade Organization (WTO), the International Monetary Fund and the World Bank have all been called into question. While globalization has had a broadly positive effect on overall global welfare, it has also been perceived by the public as damaging communities and social classes in the industrialized world, spawning, for example, Brexit and the US exit from the Trans-Pacific Partnership. What are the choices the Asia-Pacific community will face if it proceeds further down the path of developing preferential regional trading arrangements? Fragmentation of the region into preferential trading arrangements on a bilateral or subregional basis promises relatively little economic gain and considerable risk of increased trade conflict. Larger preferential trading blocs, spanning the whole of East Asia, the Western Pacific, or the APEC membership, offer greater potential economic benefits but also face formidable political obstacles. In this study, Scollay and Gilbert weigh the economic consequences of the increased use of preferential trading arrangements in the Asia-Pacific region, whether these develop on the basis of trans-Pacific cooperation or solely within the East Asian or Western Pacific sub-regions. They evaluate the economic effects of both the existing proposals for new bilateral and multilateral agreements and of more far-reaching developments involving the creation of a substantial trading bloc or blocs in the region. Comparisons between the economic effects of establishing such bloc(s) in the region and the effects of achieving APEC's Bogor goals on the basis of "open regionalism" suggest that the latter approach continues to offer a worthwhile alternative. The study demonstrates that the benefits of global free trade dominate those available from establishment of any combination of major blocs or from APEC's "open regionalism".

It is becoming increasingly evident that traditional sovereignty is simply out of date. Instead, what we might call 'cooperative' sovereignty – which focuses on communication and interaction – is more responsive to the realities of interdependent economies in the twenty-first century. Nowhere is this more salient than in the area of dispute resolution, especially as labour, intellectual property, and the environment can no longer be evaded in trade negotiations. This ground-breaking book suggests that it is this shift in perspective that has given rise to the proliferation of Regional Trade Agreements (RTAs) and the inevitable overlaps and tensions between their provisions and those of the World Trade Organization (WTO). The author examines this phenomenon in great detail, and offers viable recommendations to restore coherence in the global trading system without upsetting the rights and obligations of WTO Member States. Because the WTO and RTAs must be viewed as layers of one system and must therefore have a relationship that extends to dispute settlement, such principles of subsidiarity as autonomy, mutual assistance, and flexibility are key to a successful institutional relationship between the WTO and RTAs. From this theoretical springboard, the author proceeds to analyse the following issues and more: – the relationship between WTO and RTAs based on Article XXIV of GATT; - the extent to which WTO panels can apply RTA law; - the extent to which the WTO panels can hear RTA claims; - opportunity for RTA Members to secure preliminary rulings and advisory opinions from the WTO; - recognition by WTO panels of the results of litigation or arbitration that took place at the RTA level; - opportunity for RTA Members to appeal RTA dispute settlement decisions to the WTO; and - clarification of WTO rules designed to enable RTA activities (or intervene if necessary). Major cases decided at the WTO and RTA levels that manifest conflict between RTAs and the WTO are fully analysed. Confronting directly the stagnation in negotiating and concluding new trade agreements at the multilateral level and the fragmentation of the international trade law system, this important book shows clearly how the institutional relationship between the WTO and RTAs can be restructured with a view to establishing mutual recognition of the judgments of both. In a nutshell, the book calls for reconfiguration of WTO Dispute Settlement Body to perform functions of World Trade Court that is capable of hearing disputes arising between WTO Members, RTA Members and Non-WTO Members.
