The articles deal with the frameworks and causes for religious intolerance and discrimination in selected European countries. The methods of anti-cult groups and their supporters in governments and the mainline churches are described on the basis of specific case studies. Furthermore, the essays reflect about the threats for freedom of religion, which can arise on the one hand out of these anti-sect movements but on the other hand also out of the re-establishment of the religious in the post-secular era.

Today, ethnic violence accounts for the majority of the world's conflicts. The question is how ethnic difference is to be recognized. The task is to pre-empt destructive forms of interaction between states and peoples. Autonomy arrangements have, since the 1920s, helped to resolve ethno-national conflicts in Europe. Measures include cultural independence and political representation. Outside Europe, the demand for self-governance led to a deepening of the classic form of minority protection. Federalization, decentralization, and territorial self-governance are proven means of averting conflict. Conflict prevention means a turning-away from the cultural monopolism of nation-states.

The volume deals with the topic of Religious Freedom in Europe and North America, although not exclusively.The contributions argue that a clear separation of State and Church prevents privileged religions, as well as evangelical movements supported by state interests, from becoming power-political factors that seek to mould a society according to their own values and to their benefit. All too often, politicians are happy to accept ideological support on behalf of a religious community or a religious grouping, and then seek to further the interests and to promote these groups. Even though the two countries demonstrate differences such constellations may be identified in both the USA and in Russia.

Restrictions with respect to religious freedom have been in place in authoritarian states for a number of years. We can observe a new period of co-operation between authoritarian states and "state" churches. Some churches have assumed a clearly political position, even in belligerent conflicts, by justifying wars, criminalizing their religious competitors and, thereby, exploiting the Christian Gospel for non-Christian purposes. In this volume, scholars from Europe and North America discuss the core objective of religious freedom in the West and East seeking measures to encourage religions to act and interact, independent of deliberate political stances - to maintain their distance from territorial governments and to strengthen the principle of religious freedom and, thereby, their own denomination as well.

The religious association of Jehovah’s Witnesses has existed for about 150 years in Europe. How Jehovah’s Witnesses found their way in these countries has depended upon the way this missionary association was treated by the majority of the non-Witness population, the government and established churches. In this respect, the history of Jehovah’s Witnesses in Europe is also a history of the social constitution of these countries and their willingness to accept and integrate religious minorities. Jehovah’s Witnesses faced suppression and persecution not only in dictatorships, but also in some democratic states. In other countries, however, they developed in relative freedom. How the different situations in the various national societies affected the religious association and what challenges Jehovah’s Witnesses had to overcome – and still do in part even until our day – is the theme of this history volume.

This book examines the interpretation and application of the right to freedom of religion and belief of new minorities formed by recent migration by the European Court of Human Rights (ECtHR) and the United Nations Human Rights Committee (HRC). New minorities are increasingly confronted with restrictions of their religious practices and have addressed their rights claims both to the ECtHR and the HRC through their individual complaint procedures, which resulted in several contradicting decisions. Based on a quantitative and qualitative empirical analysis of the relevant case law, focusing in particular on the reasoning adopted by the two bodies, this book finds that the HRC in its practice offers a significantly higher level of protection to new minorities than the ECtHR. Such divergence may be explained by various institutional and conceptual differences, of which the concept of the margin of appreciation is the most influential. It is contended that the extensive use of the concept of the margin of appreciation by the ECtHR in the case law regarding new minorities’ right to freedom of religion and belief, and the absence of such concept in the HRC’s case law, could be explained by different understandings of the role of an international human rights body in conflicts between the majority and minorities. This book argues that such divergence could be mitigated with various tools, such as the inclusion of cross-references to the case law of other relevant bodies as well as to instruments specifically established for the protection of minorities. The book will be of interest to academics, researchers and practitioners in the area of international human rights law, international public law in general and law and religion.

When confronted by a range of violent actions perpetrated by lone individuals, contemporary society exhibits a constant tendency to react in terms of helpless, even perplexed horror. Seeking explanations for the apparently inexplicable, commentators often hurry to declare the perpetrators as “evil”. This question is not restricted to individuals: history has repeatedly demonstrated how groups and even entire nations can embark on a criminal plan united by the conviction that they were fighting for a good and just cause. Which circumstances occasioned such actions? What was their motivation? Applying a number of historical, scientific and social-scientific approaches to this question, this study produces an integrative portrait of the reasons for human behavior and advances a number of different interpretations for their genesis. The book makes clear the extent to which we live in socially-constructed realities in which we cling for dear life to a range of conceptions and beliefs which can all too easily fall apart in situations of crisis.

This book explores relations between state, religion and law in Bosnia and Herzegovina. Historically, multi-religiousness has been a constant feature of the Bosnian polity, from its creation in 12th century until modern times. Since the middle of the 19th Century, Catholics have tended to self-identify as Croats, Orthodox Christians as Serbs, and Muslims as Bosniaks. Moreover, in a region that has undergone significant recent transformation, from the communist to the liberal political system, Bosnia and Herzegovina represents a very interesting case for the study of the relationship between state and religion. This book includes a short overview of historical aspects of these relations and a detailed analysis of the existing constitutional and legal framework on freedom of religion and relations between the state and religious communities. It assesses the actual implementation in practice, including the relevant national courts’ case-law. The work covers both the developments of new legal standards, while also identifying the main obstacles in their implementation.
