Intellectual Property Rights And Business Security

eBook Download

BOOK EXCERPT:

The World Intellectual Property Organization defines intellectual property as "creations of the mind," which includes inventions, literary and creative works, as well as symbols, names, pictures, and designs utilized in commercial transactions. The organization recognizes two different categories of intellectual property, namely "Industrial" and "copyright," and establishes a difference between the two. The first kind of intellectual property is often the sort that is held by enterprises (inventions, industrial designs, etc.), while the second type of intellectual property relates to creative productions such as original literature or music. This book takes an industrial approach to the concept of intellectual property, concentrating on the legal actions and preventive safety measures that a company can take to preserve its intellectual property both now and in the future. This book takes a methodical approach to discussing how to file for and defend various types of intellectual property, as well as the associated techno-legal concepts. It brings together the fundamental ideas behind all different kinds of intellectual property rights (IPR), as well as the procedures for registering them and the regulations governing their use. The protection of intellectual assets is more challenging than the protection of other kinds of properties because intellectual properties are intangible. It is common practice to use the word "intellectual property in legal contexts in order to protect the rights of artists and inventors because of the monetary connotations of the term. By granting artists and inventors exclusive rights to their work for a certain amount of time, Intellectual Property Rights (IPR) serve to both promote and protect those who engage in creative endeavors.

Protecting Intellectual Property In The Arabian Peninsula

eBook Download

BOOK EXCERPT:

This work examines the endeavours of the Arabian Peninsula States – namely the Gulf Cooperation Council member States of Bahrain, Kuwait, Oman, Qatar Saudi Arabia and the UAE, as well as Jordan and Yemen as prospective GCC members – in establishing national intellectual property protection regimes which both meet their international treaty obligations and are also congruent with their domestic policy objectives. It uses the WTO’s TRIPS Agreement of 1995 as the universal benchmark against which the region’s laws are assessed. The challenges faced by the States in enforcing their intellectual property laws receive particular attention. Protecting Intellectual Property in the Arabian Peninsula considers the changing nature of the States’ intellectual property laws since 1995. It argues that the decade immediately following the TRIPS Agreement was marked by a period of foreign forces shaping or influencing the character of the States’ intellectual property legislative regimes, primarily through multilateral or bilateral trade-based agreements. The second and current decade, however, see a significant shift away from foreign influences and a move towards domestic and regional imperatives and initiatives taking over. The work also examines regional initiatives for the protection of traditional knowledge and cultural heritage, as areas of intellectual property which fall outside the parameters of the TRIPS Agreement, but which are of significant concern to the States and other developing countries, and to which they are giving increasing attention in terms of providing proper protection.

Cyber Law And Cyber Security In Developing And Emerging Economies

eBook Download

BOOK EXCERPT:

This timely and important book illuminates the impact of cyber law on the growth and development of emerging and developing economies. Using a strong theoretical framework firmly grounded in resource-based and technology diffusion literature, the authors convey a subtle understanding of the ways public and private sector entities in developing and emerging countries adopt cyber space processes. This book reveals that the diffusion of cyber activities in developing and emerging economies is relatively low, with the main stumbling blocks resting in regulatory, cultural, and social factors. The authors argue that cyber crimes constitute a prime obstacle to the diffusion of e-commence and e-governments in developing economies, and governments have an important role in developing control mechanisms in the form of laws. However, setting appropriate policies and complementary services, particularly those affecting the telecommunications sector and other infrastructure, human capital and the investment environment, severely constrains Internet access. Using both strategic and operational perspectives, the authors discuss the concrete experience of constructing and implementing cyber laws and cyber security measures in developing and emerging countries, and analyse their content and appropriateness. Professionals, academics, students, and policymakers working in the area of cyber space, e-commerce and economic development, and United Nations entities working closely with the Millennium Development Goals, will find this book an invaluable reference.
