This book examines the legal nature of Islamic states and the human rights they have committed to uphold. It begins with an overview of the political history of Islam, and of Islamic law, focusing primarily on key developments of the first two centuries of Islam. Building on this foundation, the book presents the first study into Islamic constitutions to map the relationship between Sharia and the state in terms of institutions of governance. It then assesses the place of Islamic law in the national legal order of all of today's Islamic states, before proceeding to a comprehensive analysis of those states' adherences to the UN human rights treaties, and finally, a set of international human rights declarations made jointly by Islamic states. Throughout, the focus remains on human rights. Having examined Islamic law first in isolation, then as it reflects into state structures and national constitutional orders, the book provides the background necessary to understand how an Islamic state's treaty commitments reflect into national law. This book analyses the growth of sectarian-based terrorist violence in Pakistan, one of the Muslim majority states most affected by sectarian violence, ever since it was established in 1947. Sectarian violence among Muslims has emerged as a major global security problem in recent years. The author argues that the upsurge in sectarian violence in Pakistan, particularly since the late 1970s, has had less to do with theological differences between the various sects of Islam, but is a consequence of the specific political, social, economic, demographic and cultural changes that have taken place in Pakistan since it was established as an independent state. A major theme of the book is the increasing violence, extent and expressions of sectarian conflict which have emerged as new forms of sectarian terrorism. The volume provides an in-depth empirical case study which addresses some major theoretical questions raised by Critical Terrorism Studies researchers in respect of the links between religion and sectarian terrorism in Pakistan and more widely. Why have Islamic insurance systems developed well in some countries, but not in others? Malaysia is considered as Islamic insurance elite due to its relatively large number of operators it houses as well as the sustained growth of Islamic insurance sales within the country, while Indonesia and Pakistan are still in early stages of development. Analyzing the political and social history of Islamization of insurance systems in these three Muslim majority countries in Asia since 1980s, this book demonstrates the development gap between these countries on Islamic insurance results from; firstly, complex bargains made between various groups within each country polity, and those bargains are structured by the country's fundamental political institutions. Secondly, the gap is also an outcome of different societal transformations during the Islamization that 'produce Islam(s)' in these countries. The revival of Islamic principles in these countries does not only create Sharia-compliant financial products but produces Islamic norms, identities, ethics, and practices enacted in the way the communities manage their risk.

Imagining Pakistan argues that the creation of Pakistan is a result of Muslim modernism in the Subcontinent, as it defined the struggle for identity, nationalism, and empowerment of Muslim communities. This modernist movement represented the ideals of inclusivity, equal rights, a liberal constitutional framework, and a shared sense of political community among diverse ethnic and regional groups. However, while this modernity was the ideal of Pakistan’s founders, it faced resistance from Islamists obsessed with recovering a past legacy of lost Muslim glory. A major threat to political modernism also came from the military that wanted to create a strong and secure Pakistan through ‘controlled’ democracy. Multiple interventions by the military and deviations from the foundational republican ideas left Pakistan in the rough sea of power struggles, causing institutional decay and creating space for the rise of radical Islam. Imagining Pakistan analyzes the institutional imbalance between the military and the civilian groups, the idea of the security state, and the Islamist social forces and movements that have been engaged in the politics of Islamic revival. It argues that Pakistan’s stability, security and progress will depend on pursuing the path of political modernity. Although the restoration of parliamentary democracy and the resilience of the Pakistani society are hopeful signs, resolving the critical issues that Pakistan faces today will require consolidation of democracy, better leadership, and a moderate and modernist vision of both, the state and the society.
