This book is the third in the trilogy of books looking at the comparatively less-known destinations of Sikh migration to non-English speaking countries. The first one was Sikhs in Latin America, followed by Sikhs in Asia Pacific. Earlier Sikh migration was focused on the British Commonwealth and the USA. Once restrictions were placed on entering the UK, the Sikhs were forced to explore the possibility of migrating to other countries including Continental Europe. The pace of migration picked up in 1970s. Later there were more asylum seekers in the 1980s and 1990s adding to the migration numbers. Some could enter Europe through legal channels, while others found alternative routes as undocumented migrants. Sikhs found employment mostly as unskilled labour but now they have been able to create niche professions such as dairying in Italy and restaurants/bars in Finland. There is now a large second generation who is fully qualified to enter other professions. The author describes how Sikhs have kept up their traditions through ‘Nagar Kirtans’, Turban, Youth Summer camps, and ‘sewa’. Sikhs in Europe are neglected in the study of religions and migrant groups: previous studies have focused on the history, culture and religious practices of Sikhs in North America and the UK, but few have focused on Sikhs in continental Europe. This book examines the interpretation and application of the right to freedom of religion and belief of new minorities formed by recent migration by the European Court of Human Rights (ECtHR) and the United Nations Human Rights Committee (HRC). New minorities are increasingly confronted with restrictions of their religious practices and have addressed their rights claims both to the ECtHR and the HRC through their individual complaint procedures, which resulted in several contradicting decisions. Based on a quantitative and qualitative empirical analysis of the relevant case law, focusing in particular on the reasoning adopted by the two bodies, this book finds that the HRC in its practice offers a significantly higher level of protection to new minorities than the ECtHR. Such divergence may be explained by various institutional and conceptual differences, of which the concept of the margin of appreciation is the most influential. It is contended that the extensive use of the concept of the margin of appreciation by the ECtHR in the case law regarding new minorities’ right to freedom of religion and belief, and the absence of such concept in the HRC’s case law, could be explained by different understandings of the role of an international human rights body in conflicts between the majority and minorities. This book argues that such divergence could be mitigated with various tools, such as the inclusion of cross-references to the case law of other relevant bodies as well as to instruments specifically established for the protection of minorities. Religious practices and their transformation are crucial elements of migrants' identities and are increasingly politicized by national governments in the light of perceived threats to national identity. This volume gathers scholars who focus on gender through a variety of disciplines and approaches to Sikh Studies. The intersections of religion and gender are here explored, based on an understanding that both are socially constructed. Far from being static, as so often presented in world religions textbooks, religious traditions are constantly in flux, responding to historical, cultural and social contexts. So too is ‘the’ Sikh tradition in terms of practices, ideologies, rituals, and notions of identity. We here conclude that ‘a’ Sikh tradition does not exist; instead, there are numerous forms thereof. In this volume, Sikhism is presented as a collection of ‘Sikh traditions’. Gender studies—in line with women’s liberation, masculine and feminist studies have long examined and have long deconstructed the patriarchy, but also move to identify other subordinate-dominant relations between individuals.
