Statelessness is incessantly produced in seas, cities, and law. Building around the postcolonial experiences of statelessness Sites of Statelessness examines the entanglements of citizenship policies and practices with the spread of statelessness in contemporary times, something that defies any kind of a citizen/stateless binary. These policies are significant, the background of a shift in emphasis from jus soli to jus sanguinis, the proliferation of borderland populations and nowhere people, population flows across (post)colonial border formations and boundary delimitations, and the growth of regional, formal, and informal labor markets characterized by immigrant labor economies. In this context, contributors address the distinctive dynamics of the different sites in the production of statelessness and considers the impact of these sites as critical and does not merely treat them as a backdrop. They argue that these different sites evoke different histories and repertoires and also bring different possibilities of alignment with emerging problematics.

Understanding Statelessness offers a comprehensive, in-depth examination of statelessness. The volume presents the theoretical, legal and political concept of statelessness through the work of leading critical thinkers in this area. They offer a critique of the existing framework through detailed and theoretically-based scrutiny of challenging contexts of statelessness in the real world and suggest ways forward. The volume is divided into three parts. The first, ‘Defining Statelessness’, features chapters exploring conceptual issues in the definition of statelessness. This is the first book dedicated to clarifying the concept of “foundlings” and how to best prevent their statelessness in light of the object and purpose of Article 2 of the 1961 UN Convention on the Reduction of Statelessness and equivalent nationality law provisions. Among other features, the book defines the terms “foundling,” including the maximum age limit of the child to be considered a “foundling”; “unknown parents”; being “found” in a territory; and “proof to the contrary”; as well as the procedural issues such as the appropriate burden and standard of proof. In doing so, the book draws upon a comparative analysis of national legislation on “foundlings” covering 193 states, case law, and precedents in some states as well as international human rights law norms including the best interests of the child. As its conclusion, the book proposes an inclusive model “foundling provision” and a commentary to inform legislative efforts and interpretation of the existing provisions. Its findings are useful not only to state parties to the 1961 Convention but also to non-state parties, particularly in countries lacking systematic civil documentation or experiencing the effects of armed conflicts, migration, trafficking, and displacement.

This book advances the study of the right to nationality, the prevention of statelessness, and the protection of stateless persons, taking Nigeria as a case study. Much recent literature on the subject of statelessness has been written from a US/European perspective. This work addresses this imbalance with an in-depth study of statelessness and best practice in how to prevent it in an African country. The book appraises international legal regimes on statelessness, their efficacy or otherwise in practice, what can be improved under international law, and the relevance of these regimes in the Nigerian context. The regional frameworks include those of the African Union, the Council of Europe, the EU, the Organization of American States, and the Arab League. Comparisons are also drawn with specific countries that already have an enshrined Statelessness Determination Procedure including Ivory Coast, the UK, France, Moldova, and the Netherlands, which does not have a formal procedure but has alternative means of identification. The book assesses the successes and challenges faced in these countries, and evaluates the chances for legal transplantation in Nigeria. Presenting an in-depth analysis of how statelessness is approached in the global south, the work will be of interest to researchers, academics, and policymakers working in this field as well as those concerned with nationality from an international law perspective.

Why have statelessness and contemporary enslavement become endemic since the 1990s? What is it about global political economic policies, protracted warfare, and migration rules and patterns that have so systemically increased these extreme forms of vulnerability? Why have intellectual communities largely ignored or fundamentally rejected the concepts of statelessness and contemporary enslavement? This book argues that statelessness and enslavement are not aberrations or radical exceptions. They have been and are endemic to Euromodern state systems. While victims are discrete outcomes of similar processes of the racialized debasement of citizenship, stateless people share the predicament of those most likely to be enslaved and the enslaved, even when formally free, often face situations of statelessness. Gordon identifies forcible inclusion of semi-sovereign nations, extralegal expulsion of people who cannot be repatriated, and the concentrated erosion of the rights of full-fledged citizens as the primary modes through which people experience degrees of statelessness. She argues for the political value of seeing the connections among these discrete forms. With enslavement, she insists that while the centuries-long practice has taken on some new guises necessary to its profitability in the current global economy, what and who it involves have remained remarkably consistent. Rather than focusing on slavery as a radical and exceptional extreme of abuse or coercion, Gordon contends that we can understand contemporary slavery’s specificity most usefully through considering its defining dimensions together with those of wage laborers and guest workers. Gordon concludes that appreciation of the situation of the stateless and of the enslaved should fundamentally orient our thinking about viable contemporary conceptions of consent and of the kinds of twenty-first-century political institutions that would make it harder for some to make the vulnerability of others so lucrative.

Syria has been the country of origin of the largest number of asylum seekers in the EU every year since 2013. Given the long-standing existence of stateless communities in Syria, it is evident that there are stateless refugees among those displaced by the con ict and ending up in Europe. Against this background, this report explores the treatment of stateless refugees from Syria within the European asylum system, outlining the particular challenges they face and discussing related law and policy gaps. Building on existing research about the situation of stateless refugees and those at risk of statelessness in the neighbouring Middle Eastern countries, this study focuses on the ‘Greece corridor’ - the most common route for Syrians coming to Europe - as a framework through which to analyse the experiences of stateless Syrians in the EU. Within this ‘corridor’, the research focuses on two countries – Greece and the Netherlands – where in-depth interviews were conducted with stateless Palestinians and stateless Kurds from Syria who have arrived in Europe within the recent migration ow. eir testimonies help us to better understand the implications of the approach of relevant stakeholders, policies and procedures to the treatment of stateless refugees from Syria.
