In Taiwan's Democracy on Trial, Professor Copper assesses the process of democratization in Taiwan during the Chen Shui-bian Era (2000 to 2008) and after. He shows that in several respects, most important being press freedom, human rights, ethnic relations, political reform, constitutionalism, and clean governance, democratization regressed. Economic management was not good and relations with the United States were severely strained, which also hurt the Chen administration and explains why the Nationalist Party returned to power in 2008. The democratization process has improved since 2008.

In the spring of 2014, the Sunflower Movement’s three-week occupation of the Legislative Yuan brought Taiwan back to international media attention. It was the culmination of a series of social movements that had been growing in strength since 2008 and have become even more salient since the spring of 2014. Social movements in Taiwan have emerged as a powerful new actor that needs to be understood alongside those players that have dominated the literature such as political parties, local factions, Taishang, China and the United States. This book offers readers an introduction to the development of these social movements in Taiwan by examining a number of important movement case studies that focus on the post 2008 period. The return of the Kuomintang (KMT) to power radically changed the political environment for Taiwan’s civil society and so the book considers how social activists responded to this new political opportunity structure. The case chapters are based on extensive fieldwork and are written by authors from a variety of disciplinary backgrounds and methodological approaches; in some cases authors combine being both academics and activists themselves. Together, the chapters focus on a number of core issues, providing the book with four key aims. Firstly, it investigates the roots of the movements and considers how to best explain their emergence. Secondly, it examines the development trajectories of these movements. Thirdly, it looks at the best way to explain their impact and development patterns, and finally it assesses their overall impact, questioning whether they can be regarded as successes or failures. This book tells a story of Taiwan’s transformation from an authoritarian regime to a democratic system where human rights are protected as required by international human rights treaties. There were difficult times for human rights protection during the martial law era; however, there has also been remarkable transformation progress in human rights protection thereafter. The book reflects the transformation in Taiwan and elaborates whether or not it is facilitated or hampered by its Confucian tradition. There are a number of institutional arrangements, including the Constitutional Court, the Control Yuan, and the yet-to-be-created National Human Rights Commission, which could play or have already played certain key roles in human rights protections. Taiwan’s voluntarily acceptance of human rights treaties through its implementation legislation and through the Constitutional Court’s introduction of such treaties into its constitutional interpretation are also fully expounded in the book. This book provides a unique empirical study of criminal trials in China. Western observers such as the media, politicians and the legal scholars alike, have rarely had the exposure to the vast majority of the ordinary criminal trials in China. A number of legal reforms have been implemented in Chinese criminal courts in recent years, but there has been little research on whether these reforms have been effective. This book fills that gap, by unveiling the day-to-day reality of criminal cases tried by the lowest level courts in China. The data used in this study include hundreds of criminal trial observations, complete criminal case dossiers, and a comprehensive questionnaire survey of criminal justice practitioners from one large province located in China’s Southeast coast. These data were collected over a two-year period, with a generous research grant from the John D. and Catherine T. MacArthur Foundation, by scholars already working in the Chinese legal system. The work opens with a historical framework of the Chinese criminal justice system, both Western and Chinese interpretations, and an overview of the current state of the system. It will provide unique analysis of how criminal trials are being carried out in China, with a useful context for scholars with varying levels of familiarity with the current system. The research framework for gathering data discussed in this book will also provide a useful basis for studying the criminal justice system in other regions. ​
