Animal Property Rights: A Theory of Habitat Rights for Wild Animals represents the first attempt to extend liberal property rights theory across the species barrier to animals. It broadens the traditional focus of animal rights beyond basic rights to life and bodily integrity to rights to the natural areas in which animal reside. John Hadley argues that both proponents of animal rights and environmentalists ought to support animal property rights because protecting habitat promotes ecological values and helps to ensure animals live free from human interference. Hadley’s focus is pragmatist – he locates animal property rights within the institution of property as it exists today in liberal democracies. He argues that attempts to justify animal property rights on labor and first occupancy grounds will likely fail; instead, he grounds animal property rights upon the importance of habitat for the satisfaction of animals’ basic needs. The potential of animal property rights as a way of reinvigorating existing public policy responses to the problem of biodiversity loss due to habitat destruction is thoroughly explored. Using the concept of guardianship for cognitively impaired human beings, Hadley translates habitat rights as a right to negotiate – human guardians ought to be allowed to negotiate, on behalf of wild animals, with human landholders whose development activities put animals at risk. In addition to a theory of animal property rights, Animal Property Rights affords a critique of Donaldson and Kymlicka’s wild animal sovereignty theory, a defence of indirect approaches to animal rights, an extensive discussion of euthanasia as a ‘therapeutic hunting’ tool, and the first discussion of Locke’s theory of original acquisition in animal rights literature.

Gary L. Francione explains our historical and contemporary attitudes about animals by distinguishing the issue of animal use from that of animal treatment. He then presents a theory of animal rights that focuses on the need to accord all sentient nonhumans the right not to be treated as property.

Writings from 1492 to 1826 reveal that the history of animals in the Spanish empire transcended the bullfight. The early modern Spanish empire was shaped by its animal actors, and authors from Cervantes to the local officials who wrote the relaciones geográficas were aware of this. Nonhuman animals provided food, clothing, labor, entertainment and companionship. Functioning as allegories of human behavior, nonhuman animals were perceived by Spanish and Amerindian authors alike as bearing some relationship to humans. On occasion, they even were appreciated as unique and fascinating beings. Through empirical observation and metaphor, some in the Spanish empire saw themselves as related in some way to other animals, recognizing, before Darwin, a "difference in degree rather than kind."

This “passionately eloquent” study shows the influence of eighteenth-century poetry on political theory, philosophy, and early discourse on animal rights (Helen Deutsch, University of California, Los Angeles). During the eighteenth century, some of the most popular British poetry showed a responsiveness to animals that anticipated the later language of animal rights. Such poems were widely cited in later years by legislators advocating animal welfare laws. In The Animal Claim, Tobias Menely links this poetics of sensibility with Enlightenment political philosophy, the rise of the humanitarian public, and the fate of sentimentality, as well as longstanding theoretical questions about voice as a medium of communication. In the Restoration and eighteenth century, philosophers emphasized the role of sympathy in collective life and began regarding the passionate expression humans share with animals, rather than the spoken or written word, as the elemental medium of community. Menely shows how poetry came to represent this creaturely voice and, by virtue of this advocacy, facilitated the development of a viable discourse of animal rights in the emerging public sphere. Placing sensibility in dialogue with classical and early-modern antecedents as well as contemporary animal studies, The Animal Claim uncovers crucial connections between eighteenth-century poetry; theories of communication; and post-absolutist, rights-based politics.

‘Empire and the Animal Body: Violence, Identity and Ecology in Victorian Adventure Fiction’ develops recent work in animal studies, eco-criticism and postcolonial studies to reassess the significance of exotic animals in Victorian adventure literature. Depictions of violence against animals were integral to the ideology of adventure literature in the late nineteenth and early twentieth centuries. However, the evolutionary hierarchies on which such texts relied were complicated by developing environmental sensitivities and reimaginings of human selfhood in relation to animal others. As these texts hankered after increasingly imperilled areas of wilderness, the border between human and animal appeared tense, ambivalent and problematic.

Animal minds and animal ethics - different origins, connecting similarities. Philosophers working on questions of animal ethics usually draw on research into animal cognition and subscribe to strong positions regarding animal minds. Whereas philosophers interested in the question of animal minds sometimes draw ethical conclusions from the positions they argue for. In spite of such overlaps, these two areas of research have grown up separately. One reason for this separation stems from the institutional distinction between theoretical and practical philosophy. The principal aim of this anthology is to build bridges between the fields and different philosophical approaches of animal ethics and of animal minds and cognition.

Animals are conscious beings that form their own perspective regarding the lifeworlds in which they exist, and according to which they act in relation to their species and other animals. It explores the reciprocity of human–animal relations and the capacity of animals to act and shape human societies. The chapters draw on examples from the Global North to explore how human life in modernity has been and is shaped by the sentience, autonomy, and physicality of various animals, particularly in landscapes where communities and wild animals exist in close proximity. It offers a timely contribution to animal studies, environmental geography, environmental history, and social science and humanities studies of the environment more broadly.
