The Color of Creatorship examines how copyright, trademark, and patent discourses work together to form American ideals around race, citizenship, and property. Working through key moments in intellectual property history since 1790, Anjali Vats reveals that even as they have seemingly evolved, American understandings of who is a creator and who is an infringer have remained remarkably racially conservative and consistent over time. Vats examines archival, legal, political, and popular culture texts to demonstrate how intellectual properties developed alongside definitions of the "good citizen," "bad citizen," and intellectual labor in racialized ways. Offering readers a theory of critical race intellectual property, Vats historicizes the figure of the citizen-creator, the white male maker who was incorporated into the national ideology as a key contributor to the nation's moral and economic development. She also traces the emergence of racial panics around infringement, arguing that the post-racial creator exists in opposition to the figure of the hyper-racial infringer, a national enemy who is the opposite of the hardworking, innovative American creator. The Color of Creatorship contributes to a rapidly-developing conversation in critical race intellectual property. Vats argues that once anti-racist activists grapple with the underlying racial structures of intellectual property law, they can better advocate for strategies that resist the underlying drivers of racially disparate copyright, patent, and trademark policy.

COVID-19 isn’t simply a viral pathogen nor is it, strictly speaking, the trigger of a global pandemic. Since the outbreak began in late-2019, an outpouring of clinical and scientific research, together with an array of public health initiatives, has sought to understand, mitigate, or even eradicate the virus. This book represents a snapshot of critical responses by researchers from 10 countries and 4 continents, in a collective effort to explore how Cultural Studies can contribute to our struggle to persevere in a "no normal" horizon, with no clear end in sight. Together, the essays address important questions at the intersection of culture, power, politics, and public health: What are the possible outlines for the panic-pandemic complex? How has the pandemic been endowed with meanings and affective registers, often at the tipping points where existing social relations and medical understanding were being rapidly displaced by new ones? How can societies discover ways of living with, through, and against COVID that do not simply reproduce existing hierarchies and power relations? The 30 essays comprising this collection, along with the editors’ introduction, explore the formative period of the COVID pandemic, from mid-2020 to mid-2021. They are grouped into three sections – ‘Racializations,’ ‘Media, Data, and Fragments of the Popular,’ and ‘Un/knowing the Pandemic’ – themes that animate, but do not exhaust, the complex cultural and political life of COVID-19 with respect to identity, technology, and epistemology. No doubt, readers will chart their own pathway as the pandemic continues to rage on, based on their own unique circumstances. This book provides critical-intellectual guideposts for the way forward – toward an uncertain future, without guarantees. The chapters in this book were originally published as a special issue of the journal, Cultural Studies.

Reimagines photography through the long history of ideas of expression The end of the nineteenth century saw massive developments and innovations in photography at a time when the forces of Western modernity—industrialization, racialization, and capitalism—were quickly reshaping the world. The Unintended slows down the moment in which the technology of photography seemed to speed itself—and so the history of racial capitalism—up. It follows the substantial shifts in the markets, mediums, and forms of photography during a legally murky period at the end of the nineteenth century. Monica Huerta traces the subtle and paradoxical ways legal thinking through photographic lenses reinscribed a particular aesthetics of whiteness in the very conceptions of property ownership. The book pulls together an archive that encompasses the histories of performance and portraiture alongside the legal, pursuing the logics by which property rights involving photographs are affirmed (or denied) in precedent-setting court cases and legal texts. Emphasizing the making of “expression” into property to focus our attention on the failures of control that cameras do not invent, but rather put new emphasis on, this book argues that designations of control’s absence are central to the practice and idea of property-making. The Unintended proposes that tracking and analyzing the sensed horizons of intention, control, autonomy, will, and volition offers another way into understanding how white supremacy functions. Ultimately, its unique historical reading practice offers a historically-specific vantage on the everyday workings of racial capitalism and the inheritances of white supremacy that structure so much of our lives.

Violent Inheritance deepens the analysis of settler colonialism's endurance in the North American West and how infrastructures that ground sexual modernity are both reproduced and challenged by publics who have inherited them. E Cram redefines sexual modernity through extractivism, wherein sexuality functions to extract value from life including land, air, minerals, and bodies. Analyzing struggles over memory cultures through the region's land use controversies at the turn of and well into the twentieth century, Cram unpacks the consequences of western settlement and the energy regimes that fueled it. Transfusing queer eco-criticism with archival and ethnographic research, Cram reconstructs the linkages—"land lines"—between infrastructure, violence, sexuality, and energy and shows how racialized sexual knowledges cultivated settler colonial cultures of both innervation and enervation. From the residential school system to elite health seekers desiring the "electric" climates of the Rocky Mountains to the wartime incarceration of Japanese Americans, Cram demonstrates how the environment promised to some individuals access to vital energy and to others the exhaustion of populations through state violence and racial capitalism. Grappling with these land lines, Cram insists, helps interrogate regimes of value and build otherwise unrealized connections between queer studies and the environmental and energy humanities.

Any and all songs are capable of being remixed. But not all remixes are treated equally. Rock This Way examines transformative musical works—cover songs, remixes, mash-ups, parodies, and soundalike songs—to discover what contemporary American culture sees as legitimate when it comes to making music that builds upon other songs. Through examples of how popular discussion talked about such songs between 2009 and 2018, Mel Stanfill uses a combination of discourse analysis and digital humanities methods to interrogate our broader understanding of transformative works and where they converge at the legal, economic, and cultural ownership levels. Rock This Way provides a new way of thinking about what it means to re-create and borrow music, how the racial identity of both the reusing artist and the reused artist matters, and the ways in which the law polices artists and their works. Ultimately, Stanfill demonstrates that the extent to which a work is seen as having new expression or meaning is contingent upon notions of creativity, legitimacy, and law, all of which are shaped by white supremacy.

When first written into the Constitution, intellectual property aimed to facilitate "progress of science and the useful arts" by granting rights to authors and inventors. Copyright is one of the cornerstones of western civilization; it is as relevant today, if not more so, than it was when the first formal copyright laws were enacted in the eighteenth century. With the rise of the Digital Age, new challenges have been brought to the frontlines of the copyright battle. Online piracy, extensive unauthorized use of copyrighted works by educational institutions, and artificial intelligence are testing the ability of copyright laws to protect creators and their intellectual property. Canada’s copyright laws are out of step with other western democracies and are overdue for updating. They need to be resilient and adaptive to the digital age to promote the production of new work and ideas.
