To what extent are there trade impediments to the transfer and adoption of environmental goods and services? How can these be addressed by global trade negotiations? What is the role of complementary measures in order to ensure "win-win" benefits -- that is promoting both environmental protection and economic growth? And how can developing countries also benefit to ensure a triple -- "win-win-win" -- situation? This book addresses these questions. A key conclusion of the research is the need for policy settings to address both supply and demand-side factors. Indeed supply-side factors, including a diverse and cumulative range of trade barriers are more significant inhibitors of the deployment of technology and service-based solutions to global environmental challenges than has been assumed heretofore. Energy intersects with the environment at all stages of its life cycle by affecting nature and public health and is subject to government measures concerning low-carbon growth, energy efficiency and conservation, renewable energy and ecologically safe supply of nuclear and other energy resources. This timely book provides a comprehensive analysis of the role of international economic law in regulating such an energy-environment nexus under the regimes of the WTO, the Energy Charter Treaty, regional trade agreements and investment treaties. This book investigates the potential trade opportunity of climate friendly goods and technology (CFGT) in Asia and South Asia region, and uses a case study of India to clarify India's position on global warming and efforts to mitigate climate change impacts regionally and globally. In four main sections, the book applies econometric techniques to analyze the trade performance of CFGTs in nations in Asia and South Asia, in order to assess trade gaps and map the movement of CFGTs in these regions. The major themes addressed in the book include climate change and trade, issues that shape regional and national policies, and strategies for implementing global climate change mitigation on trade opportunities and developments. Section 1 introduces readers to some background on global climate change threats and its effects on trade, as well as the need to develop trade for CFGTs. Section 2 assesses the trade performance of CFGTs in Asia, and South Asia, and the competitiveness of CFGT trade. Section 3 uses a regional orientation index to analyze CFGT trade. Section 4 discusses the potential business applications of CFGT trade in the Asia, South Asia region, and uses a case study on India to analyze climate change mitigation effects on trade and policy. What can trade regulation contribute towards ameliorating the GHG emissions and reducing their concentrations in the atmosphere? This collection of essays analyses options for climate-change mitigation through the lens of the trade lawyer. By examining international law, and in particular the relevant WTO agreements, the authors address the areas of potential conflict between international trade law and international law on climate mitigation and, where possible, suggest ways to strengthen mutual supportiveness between the two regimes. They do so taking into account the drivers of human-induced climate change in energy markets and of consumption.
