This book analyses the development of anti-corruption as a policy field in the European Union with a particular focus on the EU Anti-Corruption Report. It reconstructs the origins of anti-corruption policy in the 1990s when the EU started to recognise corruption as a serious crime with a cross-border dimension. It also analyses the processes surrounding the downfall of the Santer Commission on charges of corruption in 1999 and the enlargement of the EU. This incorporation of transitional new Member States was accompanied by a number of specific measures, instruments and monitoring mechanisms to combat corruption at the supranational level, finally leading to the introduction of the EU-wide Anti-Corruption Report in 2014. The book presents an in-depth analysis of its implementation, abandonment and the way forward under the European Semester as the new instrument for achieving EU anti-corruption reforms. It offers a new interpretation of the Report as a form of reflexive governance that operates at multiple levels and involves not only the European institutions and national governments, but also the role of civil society actors in the process of developing anti-corruption policy. It applies the theory of reflexive governance in analysing the impact of the Report in the UK, Romania and Albania, including the involvement of non-state actors in anti-corruption policy making in these countries. The book concludes with a discussion on how future EU Anti-Corruption policy can make use of reflexive governance and offers recommendations to enhance anti-corruption policies of the EU, the Member States and Candidate States.

Democratic development in Central and Eastern Europe is not a finished project, nor is its progress immune to internal and external threats. The current social, economic, ethnic and political situation within the region presents new dangers. This text identifies and analyses challenges to current East-Central European democracies in terms of potential deconsolidation of democracy reflected in the changes in the institutional and procedural framework (polity), and in the choice of instruments and strategies in the policy area. Tax crimes have a significant impact on the functioning of national and international economies and on the global financial system. Not only do they affect the actors involved and the state that has been deprived of tax revenues, but the citizens of those states suffer too. Anti-corruption measures have firmly taken centre stage in the development agenda of international organisations as well as in developed and developing countries. One area in which corruption manifests itself is in public procurement and, as a result, States have adopted various measures to prevent and curb corruption in public procurement. One such mechanism for dealing with procurement corruption is to debar or disqualify corrupt suppliers from bidding for or otherwise obtaining government contracts. This book examines the issues and challenges raised by the debarment or disqualification of corrupt suppliers from public contracts. Implementing a disqualification mechanism in public procurement raises serious practical and conceptual difficulties, which are not always considered by legislative provisions on disqualification. Some of the problems that may arise from the use of disqualifications include determining whether a conviction for corruption ought to be a pre-requisite to disqualification, bearing in mind that corruption thrives in secret, resulting in a dearth of convictions. Another issue is determining how to balance the tension between granting adequate procedural safeguards to a supplier in disqualification proceedings and not delaying the procurement process. A further issue is determining the scope of the disqualification in the sense of determining whether it applies to firms, natural persons, subcontractors, subsidiaries or other persons related to the corrupt firm and whether disqualification will lead to the termination of existing contracts. The book compares and contrasts the legal, practical and institutional approaches to the implementation of the disqualification mechanism in the European Union, the United Kingdom, the United States, the Republic of South Africa and the World Bank.

Corruption has long been identified as a governance challenge, yet it took states until the 1990s to adopt binding agreements combating it. While the rapid spread of anti-corruption treaties appears to mark a global consensus, a closer look reveals that not all regional and international organizations move on similar trajectories. This book seeks to explain similarities and differences between international anti-corruption agreements. In this volume Lohaus develops a comprehensive analytical framework to compare international agreements in the areas of prevention, criminalization, jurisdiction, domestic enforcement and international cooperation. Outcomes range from narrow enforcement cooperation to broad commitments that often lack follow-up mechanisms. Lohaus argues that agreements vary because they are designed to signal anti-corruption commitment to different audiences. To demonstrate such different approaches to anti-corruption, he draws on two starkly different cases, the Organization of American States and the African Union. Contributing to debates on decision-making in international organizations, this work showcases how global governance is shaped by processes of diffusion that involve state and non-state actors. The book highlights challenges as well as chances linked to the patchwork of international rules.
