This book explores how and why the EU and its member states define immigration policies. A comparison of EU negotiations on five EU immigration directives reveals interests of actors in EU integration and whether common policies aim at a restriction or expansion of immigration to the EU.

This book analyzes the externalization of the EU’s immigration and asylum practices towards non-member transit countries and the consequences of this process. Selected policy areas of externalization (border management, visa policy, readmission agreements and asylum policy) are applied to Turkey and Morocco as two main migration transit countries within two different institutional cooperation mechanisms: Turkey as an EU candidate country within the EU’s enlargement policy; Morocco without membership prospect within the EU’s neighborhood policy. Yıldız applies theoretical debates and critically compares the rhetoric in policy papers with practice in the field. This volume not only contributes to the issue of the external dimension of EU immigration policy by incorporating transit countries into the debate, but also expands upon our understanding of the EU’s contested external governance paradigm. This book is one of the very few studies that evaluates the evolving policies towards third country nationals residing and working in the European Union (EU). Other studies have analysed the existing legal framework of citizenship and migrants' rights in the EU and the flow of migrants into the Community. However, much less comparative research has been carried out about the actual position and the practice of migrants' rights in the receiving countries, in the context of an ever integrating EU and the removal of internal borders. The focus of this book is on the consequences of the increasing number of Maghrebin workers residing in Italy and Spain - both for EU policy and with respect to these two countries as relatively new receiving states. The book examines: What public policy implications does the labour immigration from the Maghreb Countries have for the EU as a supranational Community rather than for the Member states individually? To what extent can citizenship rights be extended to third country nationals legally residing in a European Union to make their status as close as possible to that of European citizens?

The European Union has committed itself to combating racism as a general objective of law and policy. EU legislation requires Member States to introduce laws prohibiting racial discrimination in many aspects of everyday life, including employment, education, healthcare, and housing. This is a study of the legal framework on criminal measures on trafficking and/or smuggling and facilitating illegal entry in six Member States: France, Germany, Italy, the Netherlands, Spain and the UK, and the European Union. This issue is at the nexus of migration and criminal law. The system of criminal law in the Member States is a central part of the balance of the powers of the authorities and the rights of the citizen. The way in which civil liberties of the individual are weighed in comparison with public protection duties by the authorities is in essence a constitutional issue. The treatment of foreigners, in particular as regards their entry onto the territory and residence is not part of the constitutional settlements, but a field governed by state discretion and exceptionalism. The rules and administrative measures regarding entry, residence and expulsion of foreigners is not subject to the same civil liberties guarantees of due process as apply in criminal law. This comparative study examines how, in each Member State, the insertion of immigration into criminal law takes place. Do the rules of criminal law in respect of due process take precedence over the lower evidential and procedural requirements which are applied in the field of immigration? How does the criminal justice system deal with this new field where central constitutional issues are not present? There are two levels on which the insertion of immigration into criminal law takes place – the legal and the social. This book deals with both. On the one hand it looks at the laws and the court decisions on criminal trials in respect of immigrants for immigration related offences, on the other hand it looks at how the society (political actors, media, interest groups etc) discuss and develop this issue. No analysis of migration in Europe today can avoid consideration of the role of the EU institutions, as well as the member states, in policy-making. This is because the obstacles for labour mobility which have confronted the EU in the post-enlargement period have been multi-dimensional in nature, have encompassed many different aspects of European integration process, and have operated at many different levels.
