This book traces the evolution of the EU’s fight against terrorism from the late 1970s until the end of the first decade after 9/11. This historical analysis covers both EU-internal and international counterterrorism policies and features an in-depth account of the EU’s reaction to the terrorist incidents in New York, Madrid and London. In the first few weeks after these incidents, the EU mobilised a complex but also incoherent set of policy measures, which significantly influenced the course of European security over the years. From a theoretical perspective, this volume argues that context-specific factors dominated over functionalist considerations in the EU’s fight against terrorism. Building on frameworks from public policy analysis, the author demonstrates that EU institutions played a critical role as policy entrepreneurs, while the many security measures were chosen on the basis of timing rather than significance. Such short-term political dynamics also explain the implementation deficits and persistent imbalances in the EU’s counterterrorism policy; limitations which still hinder its fight against international terrorism. This book will be of much interest to students of EU policy, counter-terrorism, European security, public administration, foreign policy, and IR in general.

Counter-terrorism law and policy has been prominent and widespread in the years following 9/11, touching on many areas of everyday life from policing and border control to financial transactions and internet governance. The European Union is a major actor in contemporary counter-terrorism, including through its development of counter-terrorism laws for application within the Union. This book undertakes a multi-disciplinary and empirically informed analysis of the impact, legitimacy and effectiveness of EU counter-terrorism. Taking into account legal, societal, operational and democratic perspectives, this collection connects theoretical and practical perspectives to produce an interdisciplinary and multi-stakeholder study of how we might measure and understand the impact, legitimacy and effectiveness of EU counter-terrorism. Bringing together a select group of experts in the field, particular emphasis is placed on understanding the practical experience of implementing and assessing these measures gathered from and with end users, including law-makers, policy-makers, security services, industry partners and civil society. This edited collection will be of great relevance to scholars and policy makers with an interest in counter-terrorism law, EU law and security studies.

The Treaty on the European Union stipulates that one of the key objectives of the Union is to provide citizens with a high level of safety within an Area of Freedom, Security and Justice. Given that the fight against terrorism is a prominent aspect of this general objective, it is remarkable that, in spite of its political relevance and decade-long history, it has only relatively recently received due attention in the academic community. Yet an analysis of the successes and failures of the EU's involvement in this field is imperative and this is a particularly pertinent moment to take stock of progress. The goal of this book is therefore to look back at the post-9/11 period and answer the question of whether, when it comes to the measures taken to combat terrorism following these attacks, the EU has lived up to the promise made in its founding treaties. In pursuing this goal, this volume presents the views of leading experts casting a critical eye over the EU's performance, recognising achievements but also being suitably critical when the realities did not match the European rhetoric. In doing this, the book makes a significant contribution not only to the scholarly investigation of European Union policies, but also to the study of counter-terrorism in general. This book argues that we can understand and explain the EU as a security and peace actor through a framework of an updated and deepened concept of security governance. It elaborates and develops on the current literature on security governance in order to provide a more theoretically driven analysis of the EU in security. Whilst the current literature on security governance in Europe is conceptually rich, there still remains a gap between those that do 'security governance' and those that focus on 'security' per se. A theoretical framework is constructed with the objective of creating a conversation between these two literatures and the utility of such a framework is demonstrated through its application to the geospatial dimensions of EU security as well as specific cases studies in varied fields of EU security. This book was originally published as a special issue of European Security.

Cooperation in Police and Criminal Law Matters, the 3rd pillar of the Union, is still subject to intergovernmental cooperation among the Member States. The terrorist attacks in the USA and in Spain had undoubtedly a strong impact on this area, leading to a visible intensification of inter-state cooperation. This consequence is only natural, since terrorism is a crime, therefore a matter for police and judicial cooperation in criminal matters; terrorism is a global issue, affecting multiple states and therefore its combating needs the cooperation among states. Unlike on the international stage, in European Union's case more than intensified cooperation could be possible, by way of transferring 3rd pillar matters to the supranational level of the 1st pillar. This paper is putting forward an assessment on the likelihood of this process taking place, within the following structure: a brief overview of the way anti-terrorism measures affected the 3rd pillar, followed by an assessment of intergovernmental cooperation and communitisation as likely and recommendable for the cooperation in police and criminal matters. Finally, the "case-study" of the Framework Decision regarding the definition of terrorist offences will serve as exemplification of the arguments brought in the previous chapter.
