This handbook provides the first systematic integrated analysis of the role that states or state actors play in the construction of history and public memory after 1945. The book focuses on many different forms of state-sponsored history, including memory laws, monuments and memorials, state-archives, science policies, history in schools, truth commissions, historical expert commissions, the use of history in courts and tribunals etc. The handbook contributes to the study of history and public memory by combining elements of state-focused research in separate fields of study. By looking at the state’s memorialising capacities the book introduces an analytical perspective that is not often found in classical studies of the state. The handbook has a broad geographical focus and analyses cases from different regions around the world. The volume mainly tackles democratic contexts, although dictatorial regimes are not excluded.

Clarifying the Past provides a comprehensive analysis of state-sponsored historical commissions operating in conflicted and divided societies, developing a theoretical and methodological framework within the historical dialogue paradigm, key to understanding the work of such commissions. The theoretical and methodological framework is complemented with an extensive empirical analysis of 27 historical commissions that operated in different social and political contexts from 1990s to the present. The detailed examination of these cases gives a broad perspective into the potential capacities of historical commissions in different settings. Although only sampling the most recent cases, this volume shows how the steady increase of the number of historical commissions indicates that we are not dealing with a marginal phenomenon. The increased recognition of the potential of historical commissions to address the legacies of contested pasts and potential introduction of such commissions to transitional justice, makes this book highly relevant. This book has been written with the objective of deepening and broadening the existing knowledge on state-sponsored historical commissions. Its intended audiences are scholars and practitioners in the fields of historical theory, public history, and historical dialogue, transitional justice, peace and conflict studies.

This book examines state efforts to shape the public memory of past atrocities in the service of nationalist politics. This political engagement with the 'duty to remember', and the question of historical memory and identity politics, began as an effort to confront denialism with regard to the Holocaust, but now extends well beyond that framework, and has become a contentious subject in many countries. In exploring the politics of memory laws, a topic that has been overlooked in the largely legal analyses surrounding this phenomenon, this volume traces the spread of memory laws from their origins in Western Europe to their adoption by countries around the world. The work illustrates how memory laws have become a widespread tool of governments with a nationalist, majoritarian outlook. Indeed, as this volume illustrates, in countries that move from pluralism to majoritarianism, memory laws serve as a warning – a precursor to increasingly repressive, nationalist inclinations.

Remembering the Liberation Struggles in Cape Verde: A Mnemohistory takes as its reference from the anti-colonial struggles against the Portuguese colonial empire in Africa in the 1960s and 1970s and the ways this period has been publicly remembered. Drawing on original and detailed empirical research, it presents novel insights into the complex entanglements between colonial pasts and political memories of anti-colonialism in shaping new nations arising out of liberation struggles. Broadening postcolonial memory studies by emphasising underdeveloped research cases, it provides the first comprehensive research into how the liberation struggle is memorialised in Cape Verde and why it changes over time. Proposing an innovative approach to thinking about this historical event as a political subject, the book argues that the "struggle" constitutes a mnemonic device mobilised while negotiating contemporaneous representations related to the Cape Verdean nation, state and society. As such, it will appeal to scholars of history, sociology, anthropology and politics with interests in memory studies and public memory, postcolonialisms and African studies. This is not a new phenomenon, however, nor is it limited to the Western world. De-Commemoration focuses on the concept of de-commemoration as it relates to remembrance. Drawing on research from experts on memory dynamics across various disciplines, this extensive collection seeks to make sense of the current state of de-commemoration as it transforms contemporary societies around the world.

This book shows how the predominantly national focus that characterises studies of the United States after 1783 can be integrated with global trends, as viewed from the perspective of imperial history. The book also argues that historians of European empires have much to gain by considering the United States after 1783 as a newly-decolonised country that acquired overseas territorial possessions in 1898 and remained a member of the Western ‘imperial club’ until the mid-twentieth century. The wide-ranging synthesis by A. G. Hopkins, American Empire: A Global History (2018), provides the starting point for contributions that appraise its main theme and take it in new directions. The first three chapters identify fresh approaches to U.S. history between the Revolution and the Civil War, suggesting ways in which the United States can be considered as a newly-decolonised country, examining shifting meanings of the term ‘empire,’ and reassessing the character of continental expansion. The second group deals with initiatives and responses in the Philippines and Cuba, reconsidering the character of nationalism in two of the most important overseas territories that were either ruled directly or controlled indirectly by the United States, and placing it an international context. The third group examines the exercise of U.S. power in the twentieth century, identifying aspects of international law that have been overlooked and reviewing the extensive literature on the controversial themes of the Cold War and informal empire after 1945. The ten chapters in this edited volume bring together noted specialists on the history of international relations, the United States, and the insular empire it ruled in the twentieth century. The chapters were originally published as articles in a special issue of The Journal of Imperial and Commonwealth History.

This book elaborates a new framework for considering and understanding the relationship between law and memory. How can law influence collective memory? What are the mechanisms law employs to influence social perceptions of the past? And how successful is law in its attempts to rewrite narratives about the past? As the field of memory studies has grown, this book takes a step back from established transitional justice narratives, returning to the core sociological, philosophical and legal theoretical issues that underpin this field. The book then goes on to propose a new approach to the relationship between law and collective memory based on a conception of ‘legal institutions of memory’. It then elaborates the functioning of such institutions through a range of examples – taken from Japan, Iraq, Brazil, Portugal, Rwanda and Poland – that move from the work of international tribunals and truth commissions to more explicit memory legislation. The book concludes with a general assessment of the contemporary intersections of law and memory, and their legal institutionalisation. This book will be of interest to scholars with relevant interests in the sociology of law, legal theory and international law, as well as in sociology and politics.
