The performance of international courts has traditionally been judged against criteria of compliance and effectiveness. Whilst these are clearly desirable objectives for litigants before Africa's international courts, this book shows that we must look beyond these criteria to fully appreciate the impact of these courts. This book shows how litigants use their participation in international litigation to achieve other objectives: to amplify political disputes with their governments, to build their movement, to educate the public about their cause, and to challenge the status quo. Chapters in this collection show how these courts act as coordination points for opposition political parties to name and shame dominant parties for violation of their organizational rights. Others demonstrate how Africa's international courts serve as transitional justice mechanisms in which truth telling about ongoing conflict and authoritarian governance receives significant attention. This attention serves as a platform to galvanize resistance against continued authoritarian rule, especially from outside the conflict countries. Ultimately, the book shows that these courts must be judged against new and broader criteria, and understood as increasingly important venues for waging political, social, environmental, and legal struggles.

The collection of chapters contained in this book originates from the first Raoul Wallenberg Institute Regional Africa Academic Network Conference held at the University of Zimbabwe, Harare, Zimbabwe in October 2022. The main aim of this book is to advance an understanding of the way Africa regional and sub-regional human rights systems contribute to access to justice on the continent and to generate further knowledge about the institutions that make up the African human rights adjudication system, the African Court on Human and Peoples’ Rights, the African Commission on Human and Peoples’ Rights, the African Committee of Experts on the Rights and Welfare of the Child and sub-regional courts, such as the Economic Community of West African States Community Court of Justice.

Historically Africa has suffered from numerous conflicts which are typically addressed through international criminal law mechanisms and courts, but the need for a broader approach is both evident and demanded. This book pulls together the debates originating from the conference “Criminal Justice and Accountability in Africa: National and Regional Developments” and highlights the different approaches and mechanisms used to date and what can be taken from them to advance justice and accountability across the African continent.

The relationship between human rights and the environment, as evidenced by the recent UN Resolution on the human right to a healthy environment, is a topical, fascinating, uneasy, and increasingly urgent one. This timely collection explores the inextricable relationship between human rights and the environment as a critical lens for understanding and addressing key human rights and environmental issues confronting Africa. Comparative law is a common subject-matter of research and teaching in many universities around the world, and the twenty-first century has aptly been termed 'the era of comparative law'. This Cambridge Handbook of Comparative Law presents a truly global perspective of comparative law today. The contributors are drawn from all parts of the world to provide different perspectives on how we understand the 'law' and how it operates in practice. This book traces the development and impact of regional economic communities (RECs) in Africa and addresses a timely question: do REC members, and the REC itself, positively influence member states’ behaviors towards other members and more broadly, regionally and continentally due to REC membership? ‘Changing member states’ behaviors’ is measured across three ‘interconnected, fundamental dimensions of societal-systems’ proposed by Marshall and Elzinga Marshall in CSP’s Global Repot 2017. These are i) the persistence of conflict or its counterpoint, achieving peace, ii) fostering democratization and better governance, and iii) achieving socio-economic development and (as proposed by this research, a fourth dimension), iv) being active participants in multilateralism? Is membership in a REC ultimately beneficial to the member and other countries in the region? While there are no clear and obvious – at least, discernible traditional – benefits such as increase in trade (perhaps because Africa’s overall trade relative to the world is about 3 percent), there are other non trade benefits (e.g., decrease in conflict, coercion to take certain actions towards peace and refrain from others, coups and wars) presenting in REC member states. These in/actions, abilities, coercions, exclusions and cooperation instances are outlined and discussed in the book.
