This book has a simple objective: to present the fundamentals of international human rights treaty law in a way that can be helpful to the national leader, official, or legal adviser whose duty it is to help put a human rights treaty regime into the law and practice in his or her country. It is a book of international law, as provided for in the principal international and regional human rights treaties and draws upon the jurisprudence and practice of their monitoring organs.

The human rights project is one that brings together ideas, policies, and laws, as well as national civil society and international cooperation. Yet despite progress, human rights are still being grossly violated in vast numbers in many parts of the world, and the challenge remains to keep expanding the circles of achievements and opportunities for a universal culture of human rights. This handbook brings together a broad collection of documents from different parts of the world, from global and regional institutions, attesting to the fact that the universality of human rights resides in the spirit and aspirations of the peoples of the world. Divided into thematic sections, the volume brings together primary sources on topics such as philosophical and religious perspectives, international human rights policy, sustainable development, economic, social, and cultural rights, among many more, complete with a thorough introduction to each theme. The result is a remarkable collection of documents and teaching materials in support of the universality of human rights.

The UN Human Rights Council is the leading human rights organ of the United Nations and, ten years after it was established, it has attracted commendation as well as severe criticism. Its universal periodic review is widely recognized as a valuable process of international cooperation to advance the universal implementation of human rights. However, it has been criticized for not acting effectively and fairly in dealing with situations of shocking violations of human rights in many parts of the world. It is an international organ with the highest responsibilities to uphold universal values but, at the same time, it is a political organ of United Nations Member States, and it shows the characteristics of both a values-based body and a theatre of political drama. It is the merit of this book to present the Human Rights Council in terms of its mandates, roles and organization while seeking to remind the membership and the international community at large that the Council must be anchored in the modern human rights law of the Charter - of which the author gives a superb presentation. The book then proceeds to make the case that human rights are part of international constitutional law and this is exceedingly important at a time when universal values have come under stress from various quarters including from terrorist formations. The argument of the book is essentially that the modern human rights law of the Charter and the human rights provisions of international constitutional law must take precedence for everyone, everywhere.

The human rights movement strives to develop a universal culture of human rights in all societies, as well as to confront gross violations. This book, the first ever of its kind, is a veritable State of the World Report on Human Rights. It reproduces summaries by UN High Commissioners for Human Rights on the state of the national human rights protection systems of each UN Member State. These summaries were sent following each state’s passage through the Universal Periodic Review (UPR) process of the UN Human Rights Council. The summaries identify each state’s constitutional, legal, judicial and institutional architecture, international conventions not yet ratified, areas of progress, problem areas, and problems affecting different parts of the population. The High Commissioners’ summaries reproduced here are preceded by insightful reflections on the concept of a national human rights protection system, and by regional outlines of national human rights protection systems in the Americas and the Caribbean, Europe Africa, Asia and the Pacific. The book also contains some case studies of the national human rights protection systems of sample states such as Australia, Bhutan, Brazil, Canada, Democratic Republic of the Congo, Guyana, Portugal, Switzerland, Sweden, and South Africa.

Over the past few decades, European countries have witnessed a proliferation of legal norms concerning marginalised individuals and minorities who increasingly invoke them in front of courts to assert their rights and claim protection. The present volume explores the relationship between law, rights and social mobilisation in Europe. It specifically enquires into the extent and ways in which legal processes and entitlements are mobilised by less privileged social actors to advance their rights claims and pursue social change. Most distinctly, it explores such processes in the context of the multi-level European system, characterised by the existence of multiple legal and judicial arenas at the national, subnational and supranational/transnational level. In such a complex system of law and governance in Europe, concepts like legal opportunity structures, as well as the factors shaping them need to be reconceptualised. How does the multi-level European context distinctly shape the nature and salience of rights, as well as their mobilisation by individuals and minority actors?
