Exploring the referendum practices of eight European states, this book unpacks the intricacies of the institutional and procedural settings of referendum authorization to reach an equilibrium between the exercise of popular sovereignty and the protection of rule of law. The book also examines how, by authorizing certain issues and refusing others, state institutions can exercise considerable control over the whole referendum process.

This handbook provides an empirically rich analysis of referendums in Europe from the end of the Second World War to the present. It addresses a range of perennial theoretical and legal questions that face policy-makers when they offer citizens the chance to take or influence decisions by referendum, not least whether to accept the ‘will of the people’. Taking a multi-disciplinary approach, drawing on historical, philosophical and political science perspectives, the book includes a contextual section on the history of referendums, the theoretical questions underpinning their use, and on constitutional and legal questions about the use of referendums. The implementation of referenda in advance to an Olympic bid is common in Western democratic countries. In many cases, they have produced negative results, ending the aspiration of Olympic Games on the spot. Germany is no exception to this case. While recent research has predominantly investigated the possible reasons why past referenda have failed, the aim of this book is to evaluate the necessity of a referendum as a tool in the first place. Since a referendum is no formal requirement by the International Olympic Committee (IOC), its application is examined on an ethico-political level. Therefore, the advantages and disadvantages of a referendum in terms of any future German Olympic bid are analysed and discussed – from a political, civil and German Olympic Sports Confederation (DOSB) perspective. Based on the findings, this work rejects the necessity of a referendum before a German Olympic bid, as the alignment of ethico-political considerations analysed does not seem to be sufficiently pronounced in the de jure and de facto implementation of this tool.

This book demonstrates that the generally assumed dichotomy between referendums and representative democracy does not do justice to the great diversity of referendum types and of how referendums are used in European democracies. Although in all referendums citizens vote directly on issues rather than letting their political representatives do this for them, some referendums are more direct than others. Rather than reflecting the direct power of the People, most referendums in EU countries are held by, and serve the interests of, the political elites, most notably the executive. The book shows that these interests rarely match the justifications given in the public debate. Instead of being driven by the need to compensate for the deficiency of political parties, decision-makers use referendums primarily to protect the position of their party. In unravelling the strategic role played by national referendums in decision-making, this book makes an unconventional contribution to the debate on the impact of referendums on democracy.
