The ‘International Military Tribunal for the Far East’ (IMTFE), held in Tokyo from May 1946 to November 1948, was a landmark event in the development of modern international criminal law. The trial in Tokyo was a complex undertaking and international effort to hold individuals accountable for core international crimes and delivering justice. The Tribunal consisted of 11 judges and respective national prosecution teams from 11 countries, and a mixed Japanese–American team of defence lawyers. The IMTFE indicted 28 Japanese defendants, amongst them former prime ministers, cabinet ministers, military leaders, and diplomats, based on a 55-count indictment pertaining to crimes against peace, war crimes, and crimes against humanity. The judgment was not unanimous, with one majority judgment, two concurring opinions, and three dissenting opinions. The trial and the outcome were the subject of significant controversy and the Tribunal’s files were subsequently shelved in the archives. While its counterpart in Europe, the ‘International Military Tribunal’ (IMT) at Nuremberg, has been at the centre of public and scholarly interest, the Tokyo Tribunal has more recently gained international scholarly attention. This volume combines perspectives from law, history, and the social sciences to discuss the legal, historical, political and cultural significance of the Tokyo Tribunal. The collection is based on an international conference marking the 70th anniversary of the judgment of the IMTFE, which was held in Nuremberg in 2018. The volume features reflections by eminent scholars and experts on the establishment and functioning of the Tribunal, procedural and substantive issues as well as receptions and repercussions of the trial.

This book examines the evolution of international criminal procedure from the 1945–1946 Nuremberg and Tokyo trials to the present period. It is largely based on a normative-jurisprudential approach to the procedural rules, comparing both norms and case law of the relevant courts and tribunals. The book shows the possibility of classifying “international criminal procedure” as an autonomous concept and field of study, which is constantly evolving due to the interaction of different legal cultures that characterizes this subject matter and is derived from the varied procedures as established in both statutory law and jurisprudence. Far from being an autonomous entity, international criminal procedure now represents a great compromise between the legal traditions of different ICC member States. What emerges is the historical evolution of an international criminal procedure with a unique identity, a very real “third way” between the traditional dichotomy of common law and civil law, between the Anglo-Saxon and the European Roman Law-oriented legal traditions. Current histories seem to suggest that men alone have been capable of the development of ideas, analysis, and practice of international law until the 1990s. Is this the case? Or have others been erased from the collective images of this history, including the portrait gallery of notables in international law? Portraits of Women in International Law: New Names and Forgotten Faces? investigates the slow and late inclusion of women in the spheres of knowledge and power in international law. The forty-two textual and visual representations by a diverse team of passionate portraitists represent women and gender non-conforming people in international law from the fourteenth century onwards around the world: individuals and groups who imagined, developed, or contested international law; who earned their living in its institutions; or who, even indirectly, may have changed its course. This rich volume calls for a critical identification of the formal and informal institutional practices, norms, and rituals of (white) masculinities, both in the past and in the research of international law today. By abandoning reductive histories, their biased frames, and tacit assumptions, this work brings previously unseen glimpses of international law and its agents, ideas, causes, behaviour, norms, and social practices into the spotlight.

In early October 1935 and without any declaration of war some two hundred thousand men, comprising soldiers and airmen of the Italian armed forces, Fascist ‘Blackshirt’ Militia, Eritrean ascari and Somali dubats, invaded the independent state of Ethiopia (Abyssinia). It was an operation entirely of choice, the chooser being Il Duce: Benito Mussolini. The resultant conflict is often described as a colonial war. while it was certainly launched with the intent of turning Ethiopia into an Italian possession, it was in fact a war of aggression against an independent, sovereign, state with membership of the League of Nations. A state that had, according to one of its nineteenth-century rulers, been ‘for fourteen centuries a Christian island in a sea of pagans’. The swiftness of the Italian victory resulted from their possession and ruthless use of technology; most particularly aircraft, mustard gas, and motorisation/mechanisation. Since they were fighting an enemy who possessed none of these things, then they were able to wage, indeed inaugurate, what the prominent military theorist JFC Fuller dubbed ‘totalitarian warfare’ or, as it became known a few years later, total war. This, he opined, was the Fascist, the scientific, way of making war. In his considered view, the Fascist Army that waged it was ‘a scientific military instrument.’ This book examines that campaign in military and political terms.

The invasion of Ukraine by the Russian Federation and the subsequent military campaigns entail several classical aspects of armed conflict. First, it is a type of international armed conflict between two sovereign states that had been prevalent until the middle of the twentieth century but not in the last several decades. It is also a direct intervention by a superpower into a neighboring state with the former’s aspiration of territorial expansion. This action evokes a scheme of war reminiscent of the nineteenth or early twentieth century. At the same time, however, the invasion is generating in the international community a sense of new phenomena, leading to a new era that may be different from the past three decades following the end of the Cold War. In fact, the hostilities between the Russian Federation and Ukraine, as well as reactions by other states and international organizations, have raised legal and political issues that require scholars to reexamine existing frameworks of the international community and individual rules of international law. The process of applying international law to states is a dynamic one. Rules of international law may and should regulate the behavior of states and provide standards to decide whether a particular act by a state is permissible. At the same time, however, states may change or replace existing rules, and a significant event or series of such events may be a strong motivator to create a new legal framework. In this regard, rules of international law and the conduct of states are in a dialectical relationship. International law can both shape a mode of conduct and be shaped by that conduct—being its creator as well as its creation. The Ukraine conflict is not an exception. We can discuss the conduct of the Russian Federation, Ukraine, other states and international organizations and evaluate their legality and legitimacy from the viewpoint of existing rules. However, we may also reevaluate the current rules of international law through the lens of the Ukraine conflict and discuss possible changes to those rules in the future. Inspired by the latter aspect of the international legal process, the present book aims to examine the impact of the Ukraine conflict, whether salient or potential, on various rules of international law. Most of the authors are from Japan and other Asian countries that are geographically remote from the site of the conflict. It is often true, however — and particularly in this case — that those keeping an appropriate distance can look at relevant issues in a broader view and from a more objective perspective. To what extent and in what manner may the Ukraine conflict have an impact on the legal framework of the international community and the rules of international law? This book is the first to answer those questions in a comprehensive manner.

This book examines the history of the Japanese Red Cross Society (JRCS) and through it offers a new account of the humanitarian movement in modern Japan. Michiko Suzuki argues that contrary to its typical portrayal, the JRCS was not wholly subordinate to the government and the Imperial Family, nor was it derivative of Western values and institutional models. Instead, the JRCS operated within a transnational discourse, both contributing to and borrowing from peacetime and wartime international humanitarianism. Grounded in extensive research in the JRCS archives and archives outside Japan, this book explores the melding of Western and Japanese humanitarian traditions and organizational forms. Suzuki examines the role of grassroots efforts in the steady growth of the JRCS, showing how the society became Japan’s largest international organization by the First World War, as well as its pioneering role in Red Cross disaster relief. She traces the inclusion of non-Western national societies in the International Red Cross and Red Crescent Movement and the evolution of the JRCS from a national into a transnational organization with branches in Japan’s overseas empire as well as in the Asia Pacific and the Americas. A comprehensive chronicle of the JRCS, Humanitarian Internationalism Under Empire provides a fresh vantage point on major historical questions relating to Japanese modernization and internationalism before the Second World War.
