This work analyzes the weaknesses in the established political approaches to reform of the provision of justice, judging them as being either too overtly concerned with inappropriate free market structures, or too wedded to legal procedural rules. It argues that the most efficient solution is an adapted version of legal aid as a kind of welfare state benefit and more integrated public services aimed at providing justice for the citizen.

This book examines utopias in classical political economy and is based on the papers presented by leading scholars at the 22nd Heilbronn Symposium in the Economics and the Social Sciences. The book focuses on the tension between the State and utopia (the State as utopia vs. utopia instead of a state). The contributors also study the question of whether seafaring and landlocked states visualize the commonwealth differently and develop different utopias, and it is concluded they do not. The volume therefore follows the refutation of the Schumpeterian Hypothesis that more concentrated industries stimulate innovation. Though the hypothesis is refuted it still remains important, the chapters argue, because it charts out an entire research program, serves as a benchmark of definite public and private sector boundaries, and defines the grammar of discourse for constitutional economic policy in OECD states. Addressing the need for marshaling the resources of education to help promote a more civil society, this book argues that education has a critical role to play in challenging the dominant views of politics and education. Service learning, or academically based community service,is seen as a promising educational pedagogy that can help students acquire civic virtue and serve as a mechanism to enable institutions of higher education become stronger community partners. However, there is currently is a lack of theoretical grounding for the service-learning movement; consequently,service learning is in danger of being co-opted by academic traditionalism, which could vitiate service learning's social transformative potential and in fact undermine efforts at democratic revitalization. The author provides a basic explanation of service learning and how it is connected to promoting civic virtue. It examines the underlying public philosophy debate between weak and strong democracy theorists, or procedural and civic republicanism. This book argues that certain approaches to service learning, such as the voluntarist or charity model, the experiential education model, and the justice model are ineffective because of their association with weak democracy theory or procedural republicanism. The central argument of this book is that a progressive communitarian public philosophy maintaining that individuals attain meaning and significance in the context of community is the most appropriate grounding for service learning.

Current rhetorical and critical theory for the most part separates writing from consciousness and presumes relative truth to be the only possible expressive goal for rhetoric. These presumptions are reflected in our tradition of persuasive rhetoric, which values writing that successfully argues one person's belief at the expense of another's. Barbara Couture presents a case for a phenomenological rhetoric, one that values and respects consciousness and selfhood and that restores to rhetoric the possibility of seeking an all-embracing truth through pacific and cooperative interaction. Couture discusses the premises on which current interpretive theory has supported relative truth as the philosophical grounding for rhetoric, premises, she argues, that have led to constraints on our notion of truth that divorce it from human experience. She then shows how phenomenological philosophy might guide the theory and practice of rhetoric, reanimating its role in the human enterprise of seeking a shared truth. She proposes profession and altruism as two guiding metaphors for the phenomenological activity of "truth-seeking through interaction."
