It identifies principles that have emerged, explores the ways in which human rights charter-based and treaty-based institutions are interpreting environmental principles and examines how they contribute to the emerging field of human rights and the environment. Given the disproportionate effect that polluting activities have on marginalized and vulnerable groups, Atapattu also discusses how these human rights mechanisms have addressed the impact on women, children, indigenous peoples, people with disabilities, and racial minorities. How can we guarantee a right to life or a right to health without also guaranteeing a decent environment in which to exercise these rights? It is becoming increasingly obvious that a high quality environment is key to the fundamental human rights of life and health, and associated rights such as the right to clean water, adequate housing, and food. This book canvasses a range of law and policy issues concerning human rights and the environment. Each chapter examines an aspect of the links between environmental law and human rights in substantive and/or procedural terms, loosely falling into four themes: human rights and the environment in the context of the private sector; analysis of decisions of the European and Inter-American courts in respect of substantive and procedural aspects; human rights and the environment in the Asian region, including the issue of human displacement; and the future direction of human rights and environment law.

Since the 1970s, the international community of states has demonstrated increasing willingness to invest UN institutions with politico-ethical authority to act on its behalf in addressing human rights abuses. Through trial and error, some of these institutions have had a degree of success in securing better practical observance of international human rights standards. Flood examines the reasons why some structural approaches have had more impact than others. He argues that states must make policy choices in an environment where many political actors operate simultaneously and where several state interests are in play simultaneously. This situation creates the political space in which community structures can operate to influence behavior. Because states require the active or tacit cooperation of other states to promote their interests, they seek to avoid prolonged political isolation. Thus, the most effective UN human rights institutions are those linked in meaningful ways with Charter-based human rights mechanisms. These mechanisms—thematic and country-specific—have different structural advantages, and their concrete effectiveness depends on the specific circumstances of the particular case they are asked to address. There is evidence that they have greater impact when employed simultaneously, as well as when key states support their efforts bilaterally. Through case studies, Flood analyzes the work of the thematic mechanisms on disappearances and religious discrimination and the country-specific mechanisms used with Chile and Iran. He concludes that Charter-based UN human rights institutions have become an enduring part of the international environment and that their activities have strengthened the concept and practice of state accountability to the international community for human rights conduct.

With the Stockholm+50 Conference, held on 2-3 June 2022, the global movement to protect the environment has reached a 50 year milestone. The first UN Conference on the Human Environment, also held in Stockholm, from 5-16 June 1972, proved to be the watershed in addressing this problem, and as the world assembles once more in the Swedish capital it is time to think aloud and look ahead. In his address in 1972, the then Swedish Prime Minister Olof Palme said: “The decisive question is in which direction we will develop ... there is no individual future, neither for people nor for nations.” The only other head of government to attend in 1972, Indian Prime Minister Indira Gandhi, highlighted the development as “one of the primary means of improving the environment of living, of providing food, water, sanitation and shelter, of making the deserts green and mountains habitable” and drew attention to the wisdom of the Atharva Veda: “What of thee I dig out; Let that quickly grow over; Let me not hit thy vitals or thy heart." As we look back over 50 years, we need to assess what has gone wrong in the trajectory travelled so far and look ahead to the future of our environment at this juncture and beyond. As a scholarly journal for global decision-makers, Environmental Policy and Law has sought to envision what lies ahead in the 21st century by inviting outstanding scholarly works from around the world. The book rethinks the means of harmonization of prima facie norm conflicts in light of the multitude of international agreements across regimes. The methodology deployed in this book, which is referred to as complementation or complementary application, represents a novel approach by focusing on commonly shared objectives and a unifying ordre public transnational across fields of public international law that allow for a harmonization beyond traditional treaty interpretation. Fields of public international law, mainly the laws of armed conflict, international environmental law, and human rights law, apply simultaneously to questions regarding the environment and war. Such a coexistence challenges the unity of the international legal order, and it also challenges the means of harmonization across fields of public international law. However, eventually, the co-existence of several fields of public international law can result in a refinement of international law and enhanced legal protection. Diversification can also contribute to clarification or normative intensification in areas of parallel application of various fields and multilayered legal protection, demonstrating a counter-option to fragmentation.
