This report presents the results of an industrial design (ID) survey study carried out in three ASEAN countries, namely Philippines. It was prepared for the Project on Intellectual Property (IP) and Socio-Economic Development – Phase II, which aims to provide a better understanding of the role IDs play in business strategies, how ID rights contribute to the appropriation of investments in design innovation, and what challenges applicants face when using ID rights.

This document is a manual which provides the technical detail of the survey questionnaire designed and implemented for the study on “Understanding the Use of Industrial Designs –the Case of Indonesia, Philippines and Thailand.” It was prepared for the Project on Intellectual Property (IP) and Socio-Economic Development – Phase II, which aims to provide a better understanding of the role IDs play in business strategies in specific ASEAN Countries, and is designed to help and guide other researchers who wish to carry out a similar study in their countries of interest. The steps undertaken to mitigate the challenges and the lessons learned will hopefully inform researchers on their own endeavors.

The study attempts to gauge the impact of IP on different sectors in the ASEAN Member States, and the manner in which companies in these sectors have been making use of the different elements of IP to leverage their competitiveness, promote trade and create jobs.

This book systematically studies the structural characteristics of IP laws and regimes of major Asian economies, including (but not always) China, Hong Kong, India, Indonesia, Japan, Korea, Malaysia, Singapore, Taiwan, and Thailand. It explores and crystallizes some worthy Asian models which could further help the development of international IP laws. This book begins with an overview of Asian modern history and IP laws. It discusses the three basic IP laws in Asia which are patent law, trademark law and copyright law. It looks at the pre-established damages for copyright infringement and trademark counterfeiting. The book also deals with problems with trade secret and its over-protection. It compares IP laws and four industries in India and China, and examines what role have IP laws played in the development in those industries and how India and China can learn from each other. Finally, it examines one medium and one small-sized Asian economy on its respective struggle (Taiwan’s efforts to build a coherent IP exhaustion regime) and a success story (how Singapore has utilized IP to secure its position in global value chains). This book is a useful reference for law students, scholars, practitioners, IP professionals who are interested in knowing Asia, Asian IP laws and industries, their struggles and finding ways to better global IP laws. The case studies could provide helpful lessons for other Asian economies and beyond.

The Philippines emergence as a growth leader has been building gradually since the 1990s, following a long period of low growth and political upheaval. As of the 2010s improved governance under the administration of President Benigno Aquino III has helped to accelerate foreign direct investment (FDI) in business process outsourcing while reviving FDI into the manufacturing sector. This, and a demographic bulge in the young adult bracket, helped bring the average pace of growth in the first half of the 2010s to 6.3%, beating all the country’s main South-east Asian peers.

This book aims to shed light on the potentially innovative ICT (information and communication technology) architectures from an East Asian regional perspective. The business environment brought about by the development of ICT intensified global competition and caused dramatic changes in the industrial architecture. Firms that are involved in manufacturing and maintenance of ICT hardware and that offer services for software development are continuously being created, giving rise to the provision of new and diverse services to an increasingly growing East Asian regional market. Such industrial activities are advancing the shift from an old to a new industrial architecture. Some parts of emerging economies have grasped this edge on economic globalization and informatization and have adopted business models that enable them to enter the world economy. Entering this century, China, the Philippines, and Vietnam in East Asia have been rapidly expanding their ICT-BPO (Business Process Outsourcing) businesses as destinations of offshoring of service activities by firms in the advanced economies, following India’s example. Policy makers and firms in those countries are also meeting the challenge of catching up with advanced economies through the development of such industries. It has enabled those economies to exploit new possibilities of further development, which may mean a new stage of manufacturing cum services in an ICT- and knowledge-based economy.
