Much of the discussion of social transformation and resistance in socio-legal studies centres around the question of whether and how the law can be used to achieve practical change. However, the editors of this volume argue that it will never be possible to enact change through the law because it is inseparable from violence, be it metaphysical, social, or political. They posit that a “just world,” free from oppressive power relations, requires us to imagine communities where the state and its law cease to exist. Contributors address the underexplored questions of what alternatives to law could look like: how communities could organize their everyday lives, and how they could address social and interpersonal conflicts outside of an apparatus of violence. These essays contribute to the ongoing interrogation of settler colonialism, racism, and structural violence in Canada by demonstrating how to expose the violence the law produces, how to deconstruct law’s power, and, finally, how to identify modes of resistance that have transformative potential.

Using a variety of theoretical reflections and empirically grounded case studies, this book examines how certain kinds of imagination – political, artistic, historical, philosophical – help us tackle the challenge of comprehending and responding to various forms of political violence. Understanding political violence is a complex task, which involves a variety of operations, from examining the social macro-structures within which actors engage in violence, to investigating the motives and drives of individual perpetrators. This book focuses on the faculty of imagination and its role in facilitating our normative and critical engagement with political violence. It interrogates how the imagination can help us deal with past as well as ongoing instances of political violence. Several questions, which have thus far received too little attention from political theorists, motivate this project: Can certain forms of imagination – artistic, historical, philosophical – help us tackle the challenge of comprehending and responding to unprecedented forms of violence? What is the ethical and political value of artworks depicting human rights violations in the aftermath of conflicts? What about the use of thought experiments in justifying policy measures with regard to violence? What forms of political imagination can foster solidarity and catalyse political action? This book opens up a forum for an inclusive and reflexive debate on the role that the imagination can play in unpacking complex issues of political violence. The chapters in this book were originally published in a special issue of the journal, Critical Review of International Social and Political Philosophy.

In a time of renewed interest in insurrectionary movements, urban protest, and anti-austerity indignation, the idea of resistance is regaining its relevance in social theory. De-Pathologizing Resistance re-examines resistance as a concept that can aid social analysis, highlighting the dangers of pathologising resistance as illogical and abnormal, or exoticising it in romanticised but patronising terms. Taking a de-pathologising and de-exoticising perspective, this book brings together insights from older and newer studies, the intellectual biographies of its contributing authors, and case studies of resistance in diverse settings, such as Egypt, Greece, Israel, and Mexico. „After more than two years, what has remained of the Gezi Park protests?“ „Is Gezi`s critique of political power still valid?“ „What has changed after Gezi?“ These valid questions linger; not properly answered, not yet properly discussed. Perhaps Gezi`s enduring effects and legacy can be discovered in the resistances, dissents and practices of political critique that have been created since June 2013. In this book, fourteen authors discuss and elaborate on such questions from both political and quotidian perspectives. Critique of the power of the multitude, the anthropology and ethnography of resistance, the causes, effects and continuity of the Gezi Park protests are among the issues covered in „Another Brick in the Barricade: The Gezi Resistance and Its Aftermath.“ This book does not offer all-explaining narratives of singular objective truths. It does not represent the whole of the multitude. Henry A. Giroux argues that education holds a crucial role in shaping politics at a time when ignorance, lies and fake news have empowered right-wing groups and created deep divisions in society. Education, with its increasingly corporate and conservative-based technologies, is partly responsible for creating these division. It contributes to the pitting of people against each other through the lens of class, race, and any other differences that don't embrace White nationalism. Domestic violence is a significant threat to women’s survival. But Christian understandings of marriage often prevent women from resisting abusive relationships. Can the Church’s teaching on marriage be reshaped so that it helps women to survive, rather than encourage them to submit to their husband, bear their cross, or sacrifice themselves for the sake of their marriage? Focusing on everyday practices of marriage in two very different contexts: Argentina and England, Reimagining Theologies of Marriage in Contexts of Domestic Violence considers how Christian understandings of marriage as a covenant or sacrament relate to the lived experience of marriage. Drawing on Augustine’s notion of the goods of marriage, and on belief in the saving power of marriage, this book suggests that only when the wellbeing of bodies is central to a marriage can it have the power to save.

How should state-sponsored atrocities be judged and remembered? This controversial question animates contemporary debates on transitional justice and reconciliation. This book reconsiders the legacies of two institutions that transformed the theory and practice of transitional justice. Whereas the Nuremberg Trials exemplified the promise of legalism and international criminal justice, South Africa's Truth and Reconciliation Commission promoted restorative justice and truth commissions. Leebaw argues that the two frameworks share a common problem: both rely on criminal justice strategies to investigate experiences of individual victims and perpetrators, which undermines their critical role as responses to systematic atrocities. Drawing on the work of influential transitional justice institutions and thinkers such as Judith Shklar, Hannah Arendt, José Zalaquett and Desmond Tutu, Leebaw offers a new approach to thinking about the critical role of transitional justice – one that emphasizes the importance of political judgment and investigations that examine complicity in, and resistance to, systematic atrocities.
