Available research suggests that less developed countries have significant competitive advantage over developed countries in three major areas of international trade: agriculture, textiles and clothing (T&C), and cross-border labor mobility. Incidentally, these are also the trade sectors which experienced widespread protectionist measures, especially in developed world, for decade after decade. Under the World Trade Organization (WTO), which replaced the General Agreement on Tariff and Trade (GATT) in 1995, much of the restrictions in T&C trade has been phased out, but still this sector faces much higher tariff and non-tariff barriers than any other manufacturing sector in world economy. The agricultural sector also experienced significant dismantling of deeply entrenched trade barriers under the WTO over the course of last two decades, but the sector still remains plagued with quite extensive domestic supports, export subsidies, and tariff barriers. At the same time, despite both theoretical expositions and empirical trends point to significant potential gains from cross-border labor mobility, the sector remains mired in a complex quagmire of economic and political restrictions around the world. Thus, all three sectors in which less developed countries have exports interests still remain less liberalized than the sectors in which developed countries have exports interests. This book provides an in-depth and up-to-date scholarly analysis of all three trade sectors—agriculture, T&C and cross-border labor mobility—with a penetrating scrutiny of historical backgrounds and developments, crosscurrents of interests and perspectives of both developed and developing countries, and evolving trade patterns and potentials in a more liberalized and globalized world economy. International organizations like the United Nations, the International Monetary Fund, or the European Union are a defining feature of contemporary world politics. In recent years, many of them have also become heavily politicized. In this book, we examine how the norms and values that underpin the evaluations of international organizations have changed over the past 50 years. Looking at five organizations in depth, we observe two major trends. Taken together, both trends make the legitimation of international organizations more challenging today. First, people-based legitimacy standards are on the rise: international organizations are increasingly asked to demonstrate not only what they do for their member states, but also for the people living in these states. Second, procedural legitimacy standards gain ground: international organizations are increasingly evaluated not only based on what they accomplish, but also based on how they arrive at decisions, manage themselves, or coordinate with other organizations in the field. In sum, the study thus documents how the list of expectations international organizations need to fulfil to count as 'legitimate' has expanded over time. The sources of this expansion are manifold. Among others, they include the politicization of expanded international authority and the rise of non-state actors as new audiences from which international organizations seek legitimacy.

This book examines the work of the World Trade Organization (WTO), with a focus on the capacity of its judiciary to strike a reasoned balance between free trade in biotechnology and biosafety as to promote the 2030 Agenda for Sustainable Development and its Sustainable Development Goals. By adopting an innovative interpretation of the precautionary principle and proportionality analysis, the work offers normative suggestions to develop what the author terms “a constructive bridge of knowledge” between decision-makers, scientists, social experts and expert witnesses, which can support a judicial balance by design rather than by chance. Biotechnology is sometimes regarded as a panacea for modern-day challenges, such as feeding a growing world population and counteracting climate-change problems, and a means of offering significant economic opportunities. However, biotechnology can present uncertain, though serious, risks to human health and the environment (i.e., biosafety). Trading biotech products magnifies these risks and benefits globally. This book explores the topical, though still underexplored, question of how to find a point of equilibrium between the revolutionary advancement offered by technology and the need to safeguard biosafety from uncertain, though potentially irreversible, technology risks. It offers a thorough analysis of normative, judicial and epistemic issues hindering a reasoned balance between trade and non-trade interests under the WTO. The work offers practical relevance for the resolution of legal disputes in contexts of uncertainty, as well as innovative theoretical contributions. Since its foundation in 1995, the World Trade Organization, with its extensive legal provisions, has been defining the world trade relations and also had an enormous impact on both European and national economic law. At the same time, the WTO is perceived within the political discussion as a symbol for the world trade relations as a whole, the challenges of globalization and justice of the world trade order. Due to the expansion, consolidation and the increased enforcement of its rules, the relevance of the World Trade Organization will continue to increase. The WTO Secretariat reports that during the period from 1995 to June 30, 2007 WTO members initiated 3097 anti-dumping investigations. Of these, 474 were put forward by India, which made it the largest user of this measure among WTO Members. The traditional argument of developing countries was that loopholes or absence of clear definitions in the anti-dumping rules have increased the possibility of abuses and discretionary practices against them. Now, many developing countries like India have become frequent users of this measure. For a better understanding of the various provisions of the WTO's Anti-dumping Agreement (ADA) a critical investigation of the resulting jurisprudence is a necessity. To that end, this timely work has a fivefold aim: and• To explore the jurisprudence that has emerged around the anti-dumping regime and how it affected developing countries; and• To assess how effectively and to what extent the WTO's Dispute Settlement Body (DSB) is able to analyze the violations of ADA provisions; and• To examine domestic compliance with DSB decisions; and• To study the Indian cases which come before the nation's Customs, Excise andamp; Sales Tax Appellate Tribunal, various High Courts and the Supreme Court of India; and and• To offer recommendations for the improvement of the anti-dumping regime from a developing country perspective.
