This book details the legal and historical development of institutional and professorial academic freedoms to better understand the relationship between these concepts. While some judges and scholars have focused on the divergence of these protections, this book articulates an aligned theory that brings both the professorial and institutional theories together. It argues that while constitutionally based academic freedom does its job in protecting both public and private universities from excessive state interference, or at the very least it asks the right questions, it is inadequate because it fails to protect many individual professors in the same way. This solution entails using contract law to fill in the gaps that constitutional law leaves open in regard to protecting individual professors. Contract law is an effective alternative to constitutional law for three reasons. First, unlike constitutional law, it covers professors at both public and private universities. Second, it allows for the consideration of the custom and usage of the academic community as either express or implied contract terms in resolving disputes between universities and professors. Third, contract law enables courts to structure remedies that take into account the specific campus contexts that give rise to various disputes instead of crafting broad remedies that may ill fit certain campus environments. The proposed reconceptualization of academic freedom merges constitutional protection for institutions and contractual protection for individual professors. This combined approach would provide a more comprehensive framework than is currently available under the predominantly constitutional paradigm of academic freedom.

Warren Nord's thoughtful book tackles an issue of great importance in contemporary America: the role of religion in our public schools and universities. This edited volume connects the origins of US higher education during the Colonial Era with current systemic characteristics that maintain white supremacist structures and devalue students and faculty of color, as well as areas of study that interrogate Whiteness. The authors examine power structures within the academy that scaffold Whiteness and promote inequality at all levels by maintaining a two-tier faculty system and a dearth of Faculty and Administrators of Color. Finally, contributors offer systemic and collective solutions toward a more equitable redistribution of power, primarily among faculty and administration, through which other inequities may be identified and more easily addressed.

This book argues that academic freedom in higher education in East Asia, the U.S. and Australia is under stress. Academic freedom means freedom to teach, research, and serve in multiple political and social roles based on professional principles. It is closely linked to shared governance, in which academics participate in and influence decision making in core academic concerns such as choosing new faculty, faculty promotion, tenure decisions and the approval of new academic programs. In different countries and regions, the duress confronting academic freedom may come from different directions, and the ability of faculty to share power can vary greatly. In authoritarian mainland China, it is mostly political and ideological controls that greatly affect academic freedom, and shared governance is very much limited. In semi-democracies like Hong Kong and Macau and democracies like Taiwan, Japan, South Korea, the U.S. and Australia, corporatization and commercialization have had great impact on both academic freedom and shared governance. The result is that the roles professors play within academia are continually being diminished and the academic profession is struggling to maintain its ground. Similar developments are also occurring in Europe. These developments should cause great concern to educators, researchers and policymakers everywhere.
