This book seeks to contribute to the analysis of the serious violations of human rights in Mexico during the processes of democratic transition and the "War on Drugs" by taking bodies and territories as archives of the crimes committed by the Mexican State in the last decades. The text presents an analysis of the disappearance of persons, forced internal displacement, and gender violence as systematic expressions of State violence. These fields of research allow us to point out tensions between social practices and the institutional fragility that systematically denies human rights violations while at the same time ratifies and celebrates them. The thematic knotting between bodies and territories is anchored in the processes of shaping a memory that expresses State violence and presents the silenced resistances of minority social groups that elude the traditional forms of registration, control and collection of data. From these coordinates, body-territories are approached as scenarios where intersectionally-knotted violences unfold. The theoretical approaches considered are mobilized through a critical approach to capitalism, colonialism and patriarchy in order to analyze public policies and narratives related to the protection of bodies-territories, as well as the responses to the needs, interests and preferences of different groups and individuals whose lives are marked by the experience of serious human rights violations. Finally, this approach also considers the new ways in which crimes against humanity unfold in situations of democratic transition, as well as the forms of symbolic exchanges in the transmission of meaning and community bonding. Bodies, Territories and Serious Violations of Human Rights in Mexico will be of interest to academic researchers and graduate students in different fields of knowledge, such as criminology, sociology, history, anthropology, philosophy, psychology and the interdisciplinary field of human rights studies.

This book examines the roots of systemic aggression against women in contemporary Mexico, and the connection between social practices and the institutional permissiveness of the Mexican State with regard to gendered violence. Since the democratic transition at the end of the 1990s, Mexico has registered an increase in the intensity and types of violence that have made life in some regions almost unsustainable. The chapters in this volume consider that capitalism, colonialism and patriarchy are interrelated processes that employ the technologies of gender and race as a continuation of the symbolic hegemony that treats feminized and racialized bodies as disposable. Human Rights, Hegemony and Utopia in Latin America: Poverty, Forced Migration and Resistance in Mexico and Colombia by Camilo Pérez-Bustillo and Karla Hernández Mares explores the evolving relationship between hegemonic and counter-hegemonic visions of human rights, within the context of cases in contemporary Mexico and Colombia, and their broader implications. The first three chapters provide an introduction to the book ́s overall theoretical framework, which will then be applied to a series of more specific issues (migrant rights and the rights of indigenous peoples) and cases (primarily focused on contexts in Mexico and Colombia,), which are intended to be illustrative of broader trends in Latin America and globally.

The Oxford Handbook of Migration Crises focuses on two interrelated aspects of migration crises: the contexts that give rise to such crises, and the role of the media and public officials in framing migratory flows as crises. It critically examines what crises are, where they arise, and how this concept is used in scholarship and policy.

By the end of 2020, the number of forcibly displaced people globally had reached 82.4 million as a result of persecution, conflict, violence, human rights violations and events seriously disturbing public order (UNHCR, 2021). Efforts to prevent these people from crossing national boundaries have resulted in draconian legislation and the vilification of migrants at various international borders. In the Mediterranean, at the border with ‘fortress Europe’, there have been thousands of fatalities as migrants risk the treacherous crossing in tiny boats. The so-called ‘weaponization of migration’ is apparent in recent events on the Polish-Belarussian border as hundreds of asylum seekers are trapped between rival forces of armed soldiers. Under the UK government's 'hostile environment' policy, many legal immigration routes have been closed, and the rights of asylum seekers have been severely curtailed. The so-called 'migrant caravan', which began in Honduras in October 2018, prompted the US and Mexican governments to deploy active-duty military officers to the border, creating more chaos in the area.

This book analyses the use of the expression 'serious violations of human rights', and similar ones, such as 'gross' or 'grave', in international practice. It highlights some of the recurring responses and consequences to such violations and suggests that a new special regime - eponymous to the above-mentioned expression - was formed. This special regime is understood as substantively limited to a very specific issue-area of human rights violations. Within this regime, a series of monitoring mechanisms and procedures are in place to highlight, document, and record such violations; specific measures are taken to enforce compliance; and certain consequences arise focused on remedying the victims of such violations. As such, this special regime is comprised of at least four thinly interconnected components: the substantive, the monitoring, the enforcement, and the remedial ones. This monograph constitutes a first step towards the recognition of such a regime, allowing far more constructive and coherent elaboration in the future. Practice around this category of violations may well evolve in a different direction than the one suggested here. However, what becomes apparent from this work is that the serious violations of human rights are a key notion in the international legal order as it allows the international community to depict those factual situations requiring its attention and action.

The Rights of Victims in Criminal Justice Proceedings for Serious Human Rights Violations addresses a question of critical importance to policy-makers, international lawyers, academics, and affected societies throughout the world: Should victims of serious human rights violations be granted under international law the rights of access to and participation in criminal proceedings before international, hybrid and domestic tribunals? Juan Carlos Ochoa applies a thorough analysis of international and comparative domestic law and practice to this question, taking into account a host of international human rights instruments and case law, the theory, law and practice of international and hybrid criminal tribunals, the law and practice in several domestic jurisdictions, and many theoretical and empirical studies.
