Aspects of the 2017 Final Report of the South African Commission on the Promotion and Protection of the Rights of Cultural, Religious and Linguistic Communities (CRL) have drawn strong criticism, particularly from South African scholars, politicians and the public. The criticism is largely regarding the constitutionality of its recommendation, which calls for regulation of the Religion to combat its abuse and commercialization. Scholars have criticized the CRL Rights Commission for hastening its investigation and releasing the final report without having a substantive understanding of what is meant by the commercialization of religion, and consequently the unconstitutional implications of the recommendation, to regulate religion. A close reading of this critique has pointed to the urgent need to assemble a cumulative body of research that examines and advances understanding of what is meant by the commercialization of religion. Accordingly, this book gathers scholarly contributions which offer valuable insights into the basics of what is meant by the commercialization of religion. Contributors examine this phenomenon from the historical roots to the manifestation in the contemporary world, particularly in South Africa.

This book is a pneumatological reflection on the use and abuse of the Spirit in light of the abuse of religion within South African Pentecostalism. Both emerging and well-established scholars of South African Pentecostalism are brought together to reflect on pneumatology from various approaches, which includes among others: historical, biblical, migration, commercialisation of religion, discernment of spirits and human flourishing. From a broader understanding of the function of the Holy Spirit in different streams of Pentecostalism, the argument is that this function has changed with the emergence of the new Prophetic churches in South Africa. This is a fascinating insight into one of the major emerging worldwide religious movements. This book focuses on government regulation of religious institutions in South Africa. PART 1 explains the meaning of government regulation for religious communities by providing a brief overview of the relationship between church and state, the right to freedom of religion and the legal status of religious organisations. With reference to case examples, this section highlights the importance of religious autonomy and the right to self-determination of religious institutions and non-interference by the state in the internal affairs of the organisation. No fundamental rights are however absolute and the section concludes with a discussion on the limitation of rights and an overview of the relevant constitutional provisions and anti-discrimination laws in place relevant to religious organisations, in the context of equality and non-discrimination. PART 2 discusses in more detail the daily rights, responsibilities and freedoms associated with the right to freedom of religion within some specific spheres of society where regulation of religion has occurred or are necessary or has proved to be problematic. It includes those related to the role of religion in society; the relations between religion and state institutions; education; finance; family matters; employment law; planning law; broadcast media and general governance issues.

This book explores recent developments in South African Pentecostalism, focusing on new prophetic churches. The chapters engage with a number of paradigm shifts in Christology, identified as complementing Christ, competing with Christ, removing Christ and replacing Christ. What are the implications of these shifts? Does it mean that believers no longer believe in Christ but in their leaders? Does it shift believers’ faith towards materiality than the person of Christ? Pentecostalism is a growing movement in world Christianity. However, the growth of Pentecostalism in South Africa has faced some challenges, including the abuse of religion by some prophets. This book first names these prophets and the churches they lead in South Africa, and then makes use of literary and media analysis to analyse the religious practices by the prophets in relation to cultism. Additionally, the book analyses the “celebrity cult” and how it helps promote the prophets in South Africa. The purpose of this book is threefold: First, to draw parallels between the abuse of religion and cultism. Second, to illustrate that it is cultic tendencies, including the celebrity cult, that has given rise to many prophets in South Africa. Last, to showcase that the challenge for many of these prophets is that the Pentecostal tradition is actually anti-cultism, and thus there is a need for them to rethink their cultic tendencies in order for them to be truly relevant in a South African context.

Relationships between peace, politics and religion are often controversial, and sometimes problematic. Religion is a core source of identity for billions of people around the world and it is hardly surprising that sometimes it becomes involved in conflicts. At the same time, we can see religion involved not only in conflict. It is also central to conflict resolution, peace-making and peacebuilding. Religious involvement is often necessary to try to end hatred and differences, frequently central to political conflicts especially, but not only, in the Global South. Evidence shows that religious leaders and faith-based organisations can play constructive roles in helping to end violence, and in some cases, build peace via early warnings of conflict, good offices once conflict has erupted, as well as advocacy, mediation and reconciliation. The chapters of this book highlight that religion can encourage both conflict and peace, through the activities of people individually and collectively imbued with religious ideas and ideals.

How can freedom of religion protect the dignity of every human being and safeguard the well-being of creation? This question arises when considering the competing claims among faith traditions, states, and persons. Freedom of religion or belief is a basic human right, and yet it is sometimes used to undermine other human rights. This volume seeks to unpack and wrestle with some of these challenges. A shared interest of law and religion is the advancement of human flourishing, yet there is no common understanding of what it means for humans to flourish and the means by which to attain a flourishing life. The concept of human flourishing is especially important for Africa, where community and national development compete with forces of conflict and scarce resources. In the broadest sense, the concept of human flourishing focuses our attention on having a comprehensively good or worthwhile life, but various religious and legal traditions suggest different norms for measuring the quality of life and designing the institutional structures that could best facilitate and preserve it.
