Interest in contract farming is growing, especially in countries that previously had a central planning policy. This series features the scholarly works supported by the Phnom Penh Plan for Development Management, a region-wide capacity building program of the Asian Development Bank that supports knowledge products and services. It seeks to disseminate research results to a wider audience so that policy makers, implementers, and other stakeholders in the Greater Mekong Subregion can better appreciate and understand the breadth and depth of the region's development challenges.

FAO’s previous contribution to the development of contract farming saw the publication in 2015 of the UNIDROIT/FAO/IFAD Legal Guide on Contract Farming, which focused on the bilateral relationship between an agricultural producer and a contractor. This Legislative Study develops that research and focuses on the regulatory frameworks for contract farming, aiming to highlight different possible approaches for different contexts. Responsible contract farming can be a powerful tool for small scale farmers in developing countries to move towards larger scalecommercial production. It can create economic wealth, contribute to supply chain efficiency through the production of higher quantities of better quality products, and contribute to achieving domestic food security objectives. Maximizing these benefits while minimizing the inherent risks of contract farming is reliant upon the forging of an enabling environment, a key part of which is the domestic regulatory framework. This Legislative Study provides guidance to domestic regulators and other interested readers on how to appraise and potentially reform domestic regulatory frameworks to achieve responsible contract farming. Recognising that different countries and contextual realties may benefit from different regulatory solutions, this Study provides several examples, supported by representative case studies, on how contract farming can be regulated, without promoting a single solution as the most appropriate. The book argues that an increasing corporatisation of agriculture in India that is enabled by its neoliberal State, in the name of ‘development’, is contributing towards deepening of inequality in the rural India. It says that Contract Farming (CF) acts as a conduit that enables the coming together of myriad production relations (mercantile, finance, productive) to sell agri-commodities to the capitalist peasant. It is an accumulation strategy that brings together various factions of domestic and foreign capital together. It shows that CF as an accumulation strategy is enabled by an active interventionist state and this neoliberal Indian state mediates the relation between the agri-capital and Indian peasantry. The book further analyzes contract farming as a part of the totality of the capitalist mode of production in context of developing countries with a large agrarian base--- asking three fundamental questions – what is CF, how and why is it done and what are the implications of it.

This document is primarily a synthesis of the UNIDROIT/FAO/IFAD Legal Guide on Contract Farming. It is a comprehensive document that considers contract farming from the viewpoint of private law and seeks to provide guidance concerning the design and implementation of sound contracts, thereby generally contributing to building a conducive environment for contract farming. The publication does not intend to cover all possible agricultural contracts. Its scope is limited to the bilateral relationship between producer(s) and a contractor through contract farming. This involves parties entering into a contract that could be established for a fixed term, for one production cycle, for several or many cycles or years, or for an indefinite period. The document aims to provide advice to promote harmonious relations among all parties involved in contracts and those advising them.

The book examines the contract farming systems in Thailand and India with focus on the role of the State in these two countries. The study is based on case studies of four agri-Business firms and their farmers in Northern Thailand in potato and sweet corn crops. This study also attempts to look out the larger impacts of contracting on the local economy in these two countries. The book will he highly useful for stake holders in contract farming-policy makers, academics, agri-business firms etc.

Contract farming has received renewed attention recently as developing economies try to grapple with how to transform the agricultural sector and its associated value chains. This book examines different contract arrangements for selected crops, applying both qualitative and quantitative approaches in order to examine how contract farming affects smallholders and value chain dynamics in Tanzania. Major themes covered in the book include: contract farming policy; contract farming and value chain dynamics; contract farming adoption decisions; contract farming and income diversification. The authors also discuss alternative aspects of contract farming such as trust, conspiracy, empowerment and corporate social responsibility. The book presents original research from case studies conducted in Tanzania on sugarcane, tobacco, sunflower and cotton. These crops have a history of trials and errors with contract farming involving smallholders. Furthermore, they are targeted in national strategies as some of the main crops for establishment and upgrading of agro-industrial activities in Tanzania.

Contract farming is emerging as an important institutional innovation in the high value food chain in developing countries including Bangladesh, and its socioeconomic implications are topic of interest in policy debates. This study is an empirical assessment to explore the determinants of participation and the impact of contract farming on welfare and adoption of food safety practice in Bangladesh. Our analysis indicates that contract farmers are more likely to have better access to agricultural extension services, attended proportionately more community meetings, households members are member of organizations, access more credit, are located farther from output market, and have larger herd sizes. We also find that network variables such as time spent with cooperatives and other institutions and price fluctuation and average prices received experience before participation in contract are strongly associated with participation in contract farming. We find that contract farming has a robust positive impact on welfare measured by expenditure, farm profit and farm productivity, and food safety practice adoption even after innovatively controlling for observed and unobserved heterogeneity among dairy farmers. More specifically results indicate that a one unit increase in the likelihood of participating in contract farming is associated with a 42, 35,34 and 9 percent increase in household expenditure, gross margin and net margin per cow, and food safety practice adoption rate respectively, among other positive impacts.
