This book uncovers how colonial administrators, postcolonial governments and international aid agencies have promoted stability and their own visions of the rule of law in Sudan.

Setting macroeconomic policy is especially difficult in fragile states. Political legitimacy concerns are heightened, raising issues such as who the policymakers are, what incentives they face, and how the process of policymaking is likely to work under limited legitimacy and high uncertainty both about the macroeconomic environment as well as policy effectiveness. In addition, fragility expands the range of policy objectives in ways that may constrain the attainment of standard macroeconomic objectives. Specifically, in the context of fragility policymakers also need to focus on measures to mitigate fragility itself - i.e., they need to address issues such as regional and ethnic economic disparities, youth unemployment, and food price inflation. Socio-political developments around the world have thus pushed policymakers to broaden their toolkit to improve the effectiveness of macroeconomic management in the face of these constraints. The chapters in Macroeconomic Policy in Fragile States address these issues, both by giving an analytical context from which policymakers can build to answer the questions they face in fragile situations as well as by providing lessons drawn from empirical analyses and case studies. The first section of the volume discusses the interactions between political economy considerations and macroeconomic policymaking. The second section covers the private sector environment in fragile states. The third section focuses on macroeconomic policy, especially fiscal policy, monetary policy, exchange rate policy, external flows, and aid effectiveness. The last section explains the role of the IMF in fragile states and concludes by presenting case studies from the Middle East and from Sub-Saharan Africa. The contributors to the volume are economists and political scientists from academia as well as policymakers from international organizations and from countries affected by fragility.

The absence of effective government, one of the most important issues in current international law, became prominent with the failed state concept at the beginning of the 1990s. Public international law, however, lacked sufficient legal means to deal with the phenomenon. Neither attempts at state reconstruction in countries such as Afghanistan and Somalia on the legal basis of Chapter VII of the UN Charter nor economic liberalisation have addressed fundamental social and economic problems. This work investigates the weaknesses of the failed state paradigm as a long-term solution for international peace and security, arguing that the solution to the absence of effective government can be found only in an economic and social approach and a true universalisation of international law.

A compelling reexamination of how Britain used law to shape its empire For many years, Britain tried to impose its own laws on the peoples it conquered, and English common law usually followed the Union Jack. But the common law became less common after Britain emerged from the Seven Years’ War (1754–63) as the world’s most powerful empire. At that point, imperial policymakers adopted a strategy of legal pluralism: some colonies remained under English law, while others, including parts of India and former French territories in North America, retained much of their previous legal regimes. As legal historian Christian R. Burset argues, determining how much English law a colony received depended on what kind of colony Britain wanted to create. Policymakers thought English law could turn any territory into an anglicized, commercial colony; legal pluralism, in contrast, would ensure a colony’s economic and political subordination. Britain’s turn to legal pluralism thus reflected the victory of a new vision of empire—authoritarian, extractive, and tolerant—over more assimilationist and egalitarian alternatives. Among other implications, this helps explain American colonists’ reverence for the common law: it expressed and preserved their equal status in the empire. This book, the first empire-wide overview of law as an instrument of policy in the eighteenth-century British Empire, offers an imaginative rethinking of the relationship between tolerance and empire.

This book addresses a conundrum for the international development community: The law of development cooperation poses major constraints on delivering aid where it is needed most. The existence of a state with an effective government is a basic condition for the transfer of aid, making development cooperation with ‘fragile’ nations particularly challenging. The author explores how international organizations like the World Bank have responded by adopting formal and informal rules to engage specifically with countries with weak or no governments. Von Engelhardt provides a critical analysis of the discourse on fragile states and how it has shaped the policy decision-making of international organizations. By demonstrating how perceptions of fragility can have significant consequences both in practice and in law, the work challenges conventional research that dismisses state fragility as a phenomenon beyond law. It also argues that the legal parameters for effective global policy play a crucial role, and offers a fresh approach to a topic that is central to international security and development.

This book examines the relationship between state fragility and corruption. It analyzes a variety of regions throughout the world, including Latin America, Central Asia and the Middle East, Africa, Central America and Mexico, South America, and Russia. States that are plagued by high levels of state fragility and corruption facilitate illicit activities and other criminal enterprises.

The Americas face many security challenges, including drug trafficking, organized crime, guerrilla movements, terrorism, and environmental challenges. Experts have long debated whether some countries in the region can be classified as failed states. While various states in the Americas have been labeled as failed states, calling a country a failed state is quite controversial and requires a precise definition of what constitutes a failed state. This book instead discusses fragile states in the Americas. Fragile states are weak states that are fertile grounds for organized crime groups and illegal actors as such groups are able to infiltrate the state apparatus through corruption. The goal of this book is to examine fragile states in the region and the major security challenges that these states face. The cause of state fragility is different for various states. Theoretically, the work will conceptualize the meaning of fragility as it relates to state survival and autonomy. Empirically, the book focuses on contemporary threats to the survival of fragile states in the Americas. The book explains and analyzes the main political, security, and economic challenges of these states. It employs a wide array of cases that delve into the security and economic threats and priorities of states in the Americas.

This publication takes stock of i) the evolution of fragility as a concept, ii) analyses of financial flows to and within fragile states between 2000 and 2010, and iii) trends and issues that are likely to shape fragility in the years to come.

Following the 9/11 attacks on New York and Washington, DC, there has been an increasing interest among scholars, students, and the interested public to study and learn about the Islamist-oriented terrorist organizations called Jihadi Salafi Groups (JSGs). Considering that these organizations emerged in highly fragile states, S. Yaqub Ibrahimi asks: how and why is state fragility linked to the emergence of JSGs? Ibrahimi bases his study on three events: the establishment of al-Qaeda in Afghanistan in 1998, the rise of Islamic State in the post-Saddam Hussein Iraq, and the failed al-Qaeda effort to establish a base in Saudi Arabia in 2003. These case studies contain major aspects and features of the rise of JSGs and, together, explain the contribution of state fragility to the process of the formation and expansion of these terrorist organizations. International Security in a World of Fragile States stands out as a pivotal work on the interconnection between the root causes of JSGs and state fragility conditions and their amalgamated role in the formation and evolution of these organizations. It contributes to IR and international security debates by developing a comprehensive but readily understandable narrative of the rise of JSGs in Islamic countries, and examining them in an analytical framework in which their root causes are categorized on individual, group, and international levels.

Failing states share characteristics of inadequate structural competency, including, inter alia, the inability to advance human welfare and security. Economic inequalities and corruption are present, as well as a loss of legitimacy and reduced social cohesion. Failure of rule of law is manifested in areas of judicial adjudication, security, reduced territorial control and systemic political instability. The international community often confronts these challenges in a manner that actually complicates issues further through lack of consensus among state actors. Consequently, a new and emerging concept of sovereignty requires review in terms of the postmodern state.
