When does the exercise of an interest constitute a human right? The contributors to Menuge’s edited collection offer a range of secular and religious responses to this fundamental question of the legitimacy of human rights claims. A claim and empirical demonstration that if human rights NGOs in Nigeria are to popularly legitimise themselves then almost all of them must undergo a fundamental revision of form, concept and activist methods. The book examines how and according to which principles the enactment of European criminal legislation is legitimate. The approach adopted here focuses on the constitutionalization of criminal law (i.e., the growing importance of constitutional elements of the EU legal order and the ECHR regime within criminal law). Further, it shows how and why criminal law has a unique nature, and why it should not be equated with other fields of EU law.The book explains the basic research questions and methodologies, before turning to the nature of criminal law at the level of national law, and addressing the different levels of justification for criminal law. Further, it examines the most prominent features of European criminal law and the difference between general EU law and EU criminal law, as well as the theoretical ideals for European constitutional structures and criminal law. Examples of how the law in practice might not always be in keeping with these normative ideals serve to round out the coverage.

Populist authoritarian governments have jeopardized the human rights accomplishments of the 20th century. Ensuring their fulfillment has become a challenge for these governments and an issue for human rights defenders seeking to find ways to resist anti-democratic actions. This book seeks to expose the crisis of human rights at the hands of people who, despite rising to power through democratic means, now see democracy as a limiting institution that must be dismantled urgently. Restrictions on civil society and arbitrary detentions are some of the reasons why this populist and authoritarian vision is incompatible with human rights, which are guaranteed to some and denied to others. Through various narratives, the authors seek to recognize new spaces for struggle—such as political activism—to develop action-research tools in a context of crisis.

Legitimization of Mormon Feminist Rhetors studies how marginalized groups use rhetorical strategies to craft legitimacy for themselves. Kinney uses archival research to parse the rhetorical devices employed by Mormon feminist women. The author assumes a pan-historical methodology by examining four unique examples of notable Mormon feminist rhetors that stretch across the 191-year history of this religion: Emmeline B. Wells (1828–1921), Fawn Brodie (1915–1981), Sonia Johnson (1936–present), and Kate Kelly (1980–present). Backed by intensive analysis, the author finds that Mormon feminist women take up the ancient rhetorical canons as a heuristic to cultivate a position of authority for themselves: Wells employs arrangement patterns, Brodie engages with memory, Johnson draws upon invention practices, and Kelly applies delivery strategies. Scholars and students of communication, rhetoric, religion, and women’s studies will find this book particularly interesting.

This book explores how digital authoritarianism operates in India, Pakistan, Turkey, Indonesia, and Malaysia, and how religion can be used to legitimize digital authoritarianism within democracies. In doing so, it explains how digital authoritarianism operates at various technological levels including sub-network level, proxy level, and user level, and elaborates on how governments seek to control cyberspace and social media. In each of these states, governments, in an effort to prolong – or even make permanent – their rule, seek to eliminate freedom of expression on the internet, punish dissidents, and spread pro-state propaganda. At the same time, they instrumentalize religion to justify and legitimize digital authoritarianism. Governments in these five countries, to varying degrees and at times using different methods, censor the internet, but also use digital technology to generate public support for their policies, key political figures, and at times their worldview or ideology. They also, and again to varying degrees, use digital technology to demonize religious and ethnic minorities, opposition parties, and political dissidents. An understanding of these aspects would help scholars and the public understand both the technical and social aspects of digital authoritarianism in these five countries.
