When does the exercise of an interest constitute a human right? This 2007 book draws from and builds upon many of the more traditional approaches to the study of international human rights institutions (IHIs), especially quasi-constructivism. The author reveals some of the ways in which many such domestic deployments of the African system have been brokered or facilitated by local activist forces, such as human rights NGOs, labour unions, women's groups, independent journalists, dissident politicians, and activist judges. In the end, the book exposes and reflects upon the inherent inability of the dominant compliance-focused model to adequately capture the range of other ways - apart from via state compliance - in which the domestic invocation of IHIs like the African system can contribute - albeit to a modest extent - to the pro-human rights alterations that can sometimes occur in the self-understandings, conceptions of interest or senses of appropriateness held within key domestic institutions within states.

This book examines religious activism—Christianity, Buddhism, and Taoism—in China, a powerful atheist state that provides one of the hardest challenges to existing methods of transnational activism. The author focuses on mechanisms used by three kinds of actors: protesters, advocates and opportunists, and uses regional, inter-faith, and international comparisons to understand why some foreign advocates can enter China and engage in illegal aid and missions to empower local activists, while the same groups cannot conduct the same activities in another geographically, economically and politically similar location. The stories in this book demonstrate a more inclusive and bottom-up approach of transnational activism; they challenge the conventional spiral theory paradigm of human rights literature and the narrow views about GONGOs in civil society literature. This new knowledge helps to sustain a more optimistic view and offers an alternative way of promoting human rights in China and countries with similar authoritarian environments.

Less Than a Roar

The proliferation of international institutions and their impact has become a central issue in international relations. Why do countries comply with international agreements and how do international institutions influence national policies? Most theories focus on the extent to which international institutions can wield 'carrots and sticks' directly in their relations with states. Xinyuan Dai presents an alternative framework in which they influence national policies indirectly by utilizing non-state actors (NGOs, social movements) and empowering domestic constituencies. In this way, even weak international institutions that lack 'carrots and sticks' may have powerful effects on states. Supported by empirical studies of environmental politics, human rights and economic and security issues, this book sheds fresh light on how and why international institutions matter. The book examines how and according to which principles the enactment of European criminal legislation is legitimate.
