In this book, David Jarrett argues that the influential Lockean thesis of justice in property, which traces back to John Locke, seems to entail much egalitarian property redistribution. Put briefly, Lockeans argue that people justly own: (1) any unowned natural resources they labour on, (2) any resources they receive via voluntary transfer from a legitimate owner, and (3) any resources they legitimately receive in compensation for harm done to their person or legitimately held property. However, a question that has been largely overlooked by Lockeans is how to address the problem of property which did not arise in line with Lockean justice. What do we do about property which derives from feudal and colonial conquest, for example? Drawing on a range of theoretical and historical sources, this book argues that the legal concept of restitution is the most reasonable way to address the problem. If we apply this concept, it appears that much property in the world is held unjustly and should be redistributed in an egalitarian manner. Lockean Property Ethics and Restitution will be of interest to political theorists and philosophers alike.

This book discusses Locke's theory of property from both a critical and an interpretative standpoint. The author first develops a comprehensive interpretation of Locke's argument for the legitimacy of private property, and then examines the extent to which the argument is really serviceable in defense of that institution. He contends that a purified version of Locke's argument--one that adheres consistently to the logic of Locke's text while excluding considerations extraneous to his logic--actually does establish the legitimacy of a form of private property. John Locke is widely perceived as a foundational figure within the liberal tradition. This book investigates the competing discourses that inform Locke’s political philosophy, each underwritten by a distinct purpose, not all of which result in philosophical outcomes consistent with what we today understand as “liberal” ideals. Locke himself was unaware that he belonged to a “liberal” tradition. Traditions only acquire meaning in retrospect. But many have perceived the development of Locke’s political philosophy as involving a smooth evolution from “authoritarian” origins to “liberal” conclusions, beginning with Locke’s Two Tracts on Government (1660–62) and culminating in his later political works, the Two Treatises of Government (1689) and A Letter Concerning Toleration (1689). This book advances an interpretation of this development which reveals how, from the time of his earliest writings, Locke sought to advance competing discourses within his political philosophy, each reflecting a different purpose, with the result that this “evolution” was not as smooth as often supposed. Indeed, many of Locke’s earlier commitments and purposes remained in his later political writings. The result is a much more complex and variegated understanding of Locke’s political philosophy than hitherto supposed within the Locke literature.
