Disputes and dispossession of property rights in the mining sector are causes of injustice, violence, and forced resettlement around the world. This comprehensive volume examines mining, particularly what is often called ‘Artisanal and Small-Scale Mining’, from a perspective of governance and rights. It focuses on rights to land, natural resources, and other forms of material ‘property’. Many projects, policies, and laws targeting artisanal and small-scale mining are embedded in problematic conceptual and institutional frameworks that implicitly stigmatise and discipline artisanal and small-scale miners. This collection takes a critical look at notions of property to destabilise some of these frameworks. The chapters in this book are notable for their recognition of the agency of artisanal miners and ‘local communities’ within the uneven hierarchies in which they are embedded, and their acknowledgement of the difficulties of state regulation of such a complex set of issues. The authors use a variety of theoretical tools, engaging with political economy, political ecology, classical economic theory, and socio-cultural concepts derived from ethnographic methods. For too long Africa's mineral fortune has been lamented as a resource curse that has led to conflict rather than development for much of the continent. Yet times are changing and the opportunities to bring technical expertise on modern mining alongside appropriate governance mechanisms for social development are becoming more accessible in Africa. This book synthesizes perspectives from multiple disciplines to address Africa’s development goals in relation to its mineral resources. Africa is endowed with commercially viable quantities of several minerals and metals, and, more than ever before, African countries wish to harness their mineral resources for their economic development. The African mining sector has witnessed a revolution in terms of new mining codes and amendments to extant mining codes, which are designed to achieve a multitude of objectives, including the assertion of greater control over exploitation of mineral resources; optimization of resource royalties and taxes; promotion of equity participation in mining projects; enhancement of indigenization in the form of domestic participation in mineral production and local content requirements; value addition and beneficiation in terms of domestic processing of raw mineral ores and metals in Africa; and the promotion of sustainable practices in the mining sector. This book analyzes the legal and fiscal frameworks for hard-rock mining in several African countries including Botswana, Democratic Republic of Congo, Ethiopia, Ghana, Guinea, Kenya, Namibia, Nigeria, Liberia, Tanzania, Sierra Leone, South Africa, South Sudan, Zambia, and Zimbabwe, with reference to other resource-rich countries. It engages in a comparative analysis of mining statutes in Africa with regard to topics such as the acquisition of mineral rights; types of mineral rights; the nature of mineral rights; the rights and obligations of mineral right holders; security of mineral tenure; surface rights; fiscal regimes including royalty and tax regimes; resource nationalism in the mining sector; management and utilization of mining revenues including benefit-sharing arrangements between mining companies and host communities; environmental stewardship; and sustainable exploitation of mineral resources.

Spaces of Responsibility explores the role of ethics in (re)ordering extractive relations under the global condition. Through an empirical investigation of actors, places, and ideas in and around Burkina Faso’s industrial gold mining sector, this volume carries out an anti-essentialist yet critical examination, offering new insights into global mining capitalism. Corporate concession-making practices, the implementation of (national) mining legislation, and civil society interventions in mining areas all contribute in different ways to the dialectics of the global. Accordingly, the ongoing territorialization of mining investment often has considerable impacts on the well-being of populations in the Global South. At the same time, multinational corporations today cannot completely distance or isolate themselves from the political, economic, and social contexts they are interacting in and with. Drawing on theoretical debates about the links between resource extraction and socio-economic development, multi-scalar negotiations of ethics in mining governance are ethnographically retraced. In terms of gains and benefits, these negotiations manifest themselves spatially, providing access for some actors while excluding others.

With reference to global governance initiatives aimed at promoting ethical business practices, this volume offers a timely examination of Canada-Africa relations and natural resource governance.

This book uses extractive industry projects in Africa to explore how political authority and the nation-state are reconfigured at the intersection of national political contestations and global, transnational capital. Instead of focusing on technological zones and the new social assemblages at the actual sites of construction or mineral extraction, the authors use extractive industry projects as a topical lens to investigate contemporary processes of state-making at the state–corporation nexus. Throughout the book, the authors seek to understand how public political actors and private actors of liberal capitalism negotiate and redefine notions and practices of sovereignty by setting legal, regulatory and fiscal standards. Rather than looking at resource governance from a normative perspective, the authors look at how these negotiations are shaped by and reshape the self-conception of various national and transnational actors, and how these jointly redefine the role of the state in managing these processes for the ‘greater good’.
