Until the modern period the integration of church (or other religion) and state (or political life) had been taken for granted. There are any number of studies on Turkish secularism. However, to date there has never been a comprehensive analysis of the constitutional protection of secularism, one that systematically covers all relevant aspects. Addressing that gap, this book presents a comprehensive and coherent analysis of the constitutional framework of this principle within the Turkish legal system. Secularism is a common fundamental principle of all three Turkish constitutions (1924, 1961, 1982). The principle has been granted an irrevocable status and has been strictly constructed within the Turkish constitutional system. Despite the guarantee of irrevocability, however, its interpretation and application have undergone a drastic transformation in response to changing social and political circumstances. Today, the complaints filed before the domestic and international judiciary predominantly concern the Turkish State’s neutrality and impartiality towards religion and the exercise of freedom of religion by religious minorities. While many observers have interpreted these problems in light of the contemporary policies pursued in the field of religion, a closer look reveals that the problem lies deeper in Turkey’s general constitutional framework. While the 1982 Constitution declares the principle as an unamendable characteristic of the Republic and protects it with multi-layered mechanisms, certain anti-democratic features of the Constitution, including the President’s predominant role in forming the high-ranking judiciary, affect the proper and consistent application of the principle of secularism. The consolidation of the secular state order depends on various factors other than a suitable constitution. However, it goes without saying that constitutions can help or hinder efforts to find solutions. Therefore, this book identifies the deficiencies in the Turkish constitutional and legal framework regarding the protection of secularism. It presents the historical development and definition of a secular state, analyzes the jurisprudence of the Turkish Constitutional Court and the European Court of Human Rights, studies the application of the party prohibition mechanism as a means of protecting the principle, and assesses the constitutional amendments of 2001, 2010 and 2017. This volume explores the dynamic life of religion and politics in France. The separation of church and state and the autonomy of school education from religion are the two fundamental pillars of France as a secular republic. Secularism is a practice which entails building a ‘wall of separation’ between State and Religion. The general understanding is that this wall helps in prohibiting intervention from either side. However, since the State acts as a guardian of the public interest it may interfere in religious affairs, essentially, to dilute and de-circumscribe the limits of religious orthodoxy. It is, however, pertinent to note that some interventions in religious affairs are made even though there is no valid reason. One such example is the atheistic policy of the Russian state. The objective of this book is to compare the different models of secularism practiced in Russia and India respectively, and lay down some guiding principles which a secular State can adopt to rehabilitate a religion which was subjected to unwarranted State interventions.

This book examines the process of secularization in the Middle East in the late 19th and early 20th century through an analysis of the transformation and abolition of Islamic Caliphate. Focusing on debates in both the center of the Caliphate and its periphery, the author argues that the relationship between Islam and secularism was one of accommodation, rather than simply conflict and confrontation, because Islam was the single most important source of legitimation in the modernization of the Middle East. Through detailed analysis of both official documents and the writings of the intellectuals who contributed to reforms in the Empire, the author first examines the general secularization process in the Ottoman Empire from the late 18th century up to the end of the 1920s. He then presents an in-depth analysis of a crucial case of secularization: the demise of Islamic Caliphate. Drawing upon a wide range of secondary and primary sources on the Caliphate and the wider process of political modernization, he employs discourse analysis and comparative-historical methods to examine how the Caliphate was first transformed into a "spiritual" institution and then abolished in 1924 by Turkish secularists. Ardıç also demonstrates how the book’s argument is applicable to wider secularization and modernization processes in the Middle East. Varieties of Secularism is an ethnographically rich, theoretically well-informed, and intellectually coherent volume which builds off the work of Talal Asad, Charles Taylor, and others who have engaged the issue of secularism(s) and in socio-political life.
