Sex and sexuality are an integral part of human life and vital for the survival of the human race, but sexual freedoms in many countries have yet to be enshrined as constitutional rights. Focusing primarily on Japan, Shigenori Matsui explores the extent to which governments should be allowed to restrict or influence sexual autonomy. Should a constitution encompass rights including: to decide or change sexual or gender identity; to have children, through natural birth or through medically assisted reproduction; or to not have children, through access to abortion? This rigorously detailed legal analysis has implications for government policy in all countries facing similar issues.

While there is no shortage of studies addressing the state’s regulation of the sexual, research into the ways in which the sexual governs the state and its attributes is still in its infancy. The Sexual Constitution of Political Authority argues that there are good reasons to suppose that our understandings of state power quiver with erotic undercurrents. The book maintains, more specifically, that the relationship between ideas of political authority and male same-sex desire is especially fraught. Through a series of case studies where a statesman’s same-sex desire was put on trial (either literally or metaphorically) as a problem for the good exercise of public powers, the book shows the resilience and adaptability of cultural beliefs in the incompatibility between public office and male same-sex desire. Some of the case studies analysed are familiar ground for both political/constitutional history and the history of sexuality. The Sexual Constitution of Political Authority argues, however, that only by systematically reading questions of institutional politics and questions of sexuality through each other will we have access to the most interesting insights that a study of these trials can generate. Whether they involve obscure public officials or iconic rulers such as Hadrian and James I, these compelling fragments of queer history reveal that the disavowal of male same-sex desire has been, and partly remains, central to mainstream understandings of political authority.

In the last fifteen years constitutional issues regarding the rights of gays, lesbians and same-sex couples have emerged on a global scale. The pace of recognition of their fundamental rights, both at judicial and legislative level, has dramatically increased across different jurisdictions, reflecting a growing consensus toward sexual orientation equality. This book considers a wide-range of decisions by constitutional and international courts, from the decriminalization of sexual acts to the recognition of same-sex marriage and parental rights for same-sex couples. It discusses analogies and differences in judicial arguments and rationales in such cases, focusing in particular on human dignity, privacy, liberty, equality and non-discrimination. Furthermore, by promoting the political reception of the achievements of foreign gay movements in their own jurisdictions, courts play an essential role in breaking the political stalemate.

Sex in Development examines how development projects around the world intended to promote population management, disease prevention, and maternal and child health intentionally and unintentionally shape ideas about what constitutes “normal” sexual practices and identities. From sex education in Uganda to aids prevention in India to family planning in Greece, various sites of development work related to sex, sexuality, and reproduction are examined in the rich, ethnographically grounded essays in this volume. These essays demonstrate that ideas related to morality are repeatedly enacted in ostensibly value-neutral efforts to put into practice a “global” agenda reflecting the latest medical science. Sex is usually assumed to be a closely guarded secret of prison life. But it has long been the subject of intense scrutiny by both prison administrators and reformers—as well as a source of fascination and anxiety for the American public. In Criminal Intimacy, Regina Kunzel tracks these varying interpretations and reveals their foundational influence on modern thinking about sexuality and identity. Historians have held the fusion of sexual desire and identity to be the defining marker of sexual modernity, but sex behind bars, often involving otherwise heterosexual prisoners, calls those assumptions into question. At the time of publication our understanding of sexuality relied heavily on biology, and also on morality, as was particularly evident when homosexuality and bisexuality were discussed. In this title, originally published in 1990, the author presents a compelling case for viewing the sexual dimension of life through an understanding of its symbols. The potent figure of the devil serves as his avenue of approach. In the first part of the book, the author presents a detailed case history of a young man who began psychoanalytic therapy with him because of a terrifying conviction that he could be possessed by the devil. In the course of therapy it emerged that the devil had entered into his consciousness as a vehicle to express a complex of homosexual wishes and fears that were deeply troubling to a man whose life history had been entirely heterosexual. The author argues that the assumptions about male psychology that came to pervade psychoanalytic theory after Freud’s death could not account for the nature of this young man’s conflicts or for the outcome of the analysis. In the second part of the book, the author cites historical and anthropological data to demonstrate that the depth and breadth of male psychology extend beyond the limits of what was considered normal by the neoconservative theorists who revised Freud’s theories to exclude his ideas about bisexuality. Rejecting the reduction of sexuality to biology, the author asserts that sexuality can be properly regarded as symbolic, in the same way that meaningful works of art and rituals are symbolic. The power of sexual images and actions comes from their ability to combine important meaning with intensely felt emotion. Finally, the author examines the way in which culture affects sexuality through its control of consciousness and its influence on what kinds of sexual symbols may be utilized and what kinds of meanings they may express.
