This book focuses on critical approaches to the state and state theory in the Global South. In light of the reemergence of the post-colonial and peripheral state as a crucial institution and actor in the 21st century’s capitalist world-system, the book examines the nature, functions and development dynamics of the state in the periphery, as well as its constituting interests and struggles. Drawing on the works of Poulantzas and Gramsci, dependency and world-systems theory, as well as the regulation school and the German Ableitungsdebatte, stategraphy and critical realism, it analyzes the development of different theoretical perspectives on the state, elaborates on their theoretical, ontological and epistemological presuppositions, and illustrates their methodological, practical and ethical implications. The book is divided into three parts, the first of which provides an overview of recent global capitalist developments and challenges for state theory and lays the theoretical, ontological and hermeneutic foundation for studies of the state and statehood in the Global South. In turn, the second part introduces readers to different schools of state theory, including critical theory and materialism, as well as approaches derived from postcolonial, anthropological, and feminist thought. Lastly, the third part presents various empirical studies, highlighting concrete methodological and practical experiences of conducting critical state theory.

This book brings together Indigenous, Third World and Settler perspectives on the theory and practice of decolonizing law. Colonialism, imperialism, and settler colonialism continue to affect the lives of racialized communities and Indigenous Peoples around the world. Law, in its many iterations, has played an active role in the dispossession and disenfranchisement of colonized peoples. Law and its various institutions are the means by which colonial, imperial, and settler colonial programs and policies continue to be reinforced and sustained. There are, however, recent and historical examples in which law has played a significant role in dismantling colonial and imperial structures set up during the process of colonization. This book combines usually distinct Indigenous, Third World and Settler perspectives in order to take up the effort of decolonizing law: both in practice and in the concern to distance and to liberate the foundational theories of legal knowledge and academic engagement from the manifestations of colonialism, imperialism and settler colonialism. This book presents the case that liberal constitutionalism in the global South is a legacy of colonialism and is inappropriate as a means of securing effective peace in regions that have been subject to recurrent conflict. The work demonstrates the failure of liberal constitutionalism in guaranteeing peace in the postcolonial global South. It develops an alternative, more compelling constitutionalism for peacebuilding in conflicted regions. This is based on constitutionalism that recognises plurality as a major feature in the global South. Drawing on events in Nigeria, it develops a constitutional model, based on Cognitive Justice, which could deliver peace by addressing historic, conceptual, legal, institutional and structural issues that have created social inequality and injustice. The study also incorporates insights from the development of plurinational constitutions in South America. The debate on governance originates in the OECD world. At the latest since the postcolonial debate, we know that we need to “test” our assumptions under radically different conditions. This book offers an extended perspective of local self-governance by examining cases from South Asia, Africa, and Latin America, together with a study of militias in the USA. The chapters present a wide variety of local actors who pursue different notions of order legitimized by local traditions based on hierarchy or deeply rooted communalism, Islamic theology, or grassroots democracy. Some local actors claim a state-like authority and challenge the territorial state. In such cases, there is no longer “a shadow hierarchy” but opposition to the state. Different violent actors fight for supremacy, and the state is just one actor among others. The empirical studies presented in this book show how different kinds of local self-governance are combined with varieties of statehood, and thus contribute to an understanding of the notion of governance in a fundamental sense that goes beyond the special case of the OECD world.

This book argues that the way in which we use the concept of "state" in many African countries must involve a deeper engagement of the complex workings of state–society relations, rather than a master narrative of European state formation. Dimensions of African Statehood explores the concept of "statehood" as a set of daily practices that govern and generate effects through the voices of those performing and living the state. The book is based on extensive, firsthand research on the delivery of and access to public goods as expressions of statehood in eastern Democratic Republic of Congo. A public good, a field long dominated by economic models, can be seen as a power relation rather than a universal, positive good. By unpacking the meaning of "whose public," the book offers an avenue for a dynamic and multilayered understanding of practices that express and shape statehood. The assessment of statehood as presented in this book is an invitation to contribute to the new era of what statehood entails in regions different from the Global North. The contributors to this book critically examine the performance of new modes of governance in areas of limited statehood, drawing on a range of in-depth case studies on issues of climate change, biodiversity, and health. The Paris Agreement for Climate Change or the Sustainable Development Goals (SDGs) rely on new modes of governance for implementation. New modes of governance such as market-based instruments, public-private partnerships or stakeholder participation initiatives have been praised for playing a pivotal role in effective and legitimate sustainability governance. Yet, do they also deliver in areas of limited statehood? States such as Malaysia or the Dominican Republic partly lack the ability to implement and enforce rules; their domestic sovereignty is limited. Exploring this perspective on governance, the authors demonstrate that areas of limited statehood are not ungoverned or ungovernable spaces. The book elaborates how and under what conditions new modes of governance emerge in areas of limited statehood, and examines their relative effectiveness.
