An assessment of judicial convergence and fragmentation in international human rights law and their legal and non-legal triggering factors.

Prompted by an unprecedented rise of litigation since the 1990s, this book examines how the European Convention of Human Rights (ECHR) system and the Strasbourg Court interact with states and non-governmental actors to influence domestic change. Focusing on European Court of Human Rights litigation and state implementation of judgments related to minority discrimination and asylum/migration, it argues that a fundamental transformation of the Convention system has been under way. Repeat and strategic litigation, shifting methods of supervision and state implementation to remedy systemic violations, and above all the growing engagement of civil society and non-governmental actors, have prompted a distinctive trend of human rights experimentalism. The emergence of experimentalism has profound implications for the legitimacy, effectiveness and further reform of the ECHR system. This study provides an original constitutive account of regional human rights regimes and how they are activated by societal actors to claim rights, advance case law, and pressure for domestic legal and policy change. It will be of interest to international law and international relations scholars, political scientists, specialists on the ECHR, the Strasbourg Court, as well as to scholars interested in the human rights of immigrants and minorities.

This book provides an expanded conceptualization of legalization that focuses on implementation of obligation, precision, and delegation at the international and domestic levels of politics. By adding domestic politics and the actors to the international level of analysis, the authors add the insights of Kenneth Waltz, Graham Allison, and Louis Henkin to understand why most international law is developed and observed most of the time. However, the authors argue that law-breaking and law-distorting occurs as a part of negative legalization. Consequently, the book offers a framework for understanding how international law both produces and undermines order and justice. The authors also draw from realist, liberal, constructivist, cosmopolitan and critical theories to analyse how legalization can both build and/or undermine consensus, which results in either positive or negative legalization of international law. The authors argue that legalization is a process over time and not just a snapshot in time.

How should judges of the European Court of Justice be selected, who should participate in the Court's proceedings and how should judgments be drafted? These questions have remained blind spots in the normative literature on the Court. This book aims to address them. It describes a vast, yet incomplete transformation: Originally, the Court was based on a classic international law model of court organisation and decision-making. Gradually, the concern for the effectiveness of EU law led to the reinvention of its procedural and organisational design. The role of the judge was reconceived as that of a neutral expert, an inner circle of participants emerged and the Court became more hierarchical. While these developments have enabled the Court to make EU law uniquely effective, they have also created problems from a democratic perspective. The book argues that it is time to democratise the Court and shows ways to do this.

The amicus curiae – or friend of the court – is the main mechanism for actors other than the parties, including civil society actors and states, to participate directly in proceedings in international criminal tribunals. Yet reliance on this mechanism raises a number of significant questions concerning: the functions performed by amici, which actors seek to intervene and why, and the influence of amicus interventions on judicial outcomes. Ultimately, the amicus curiae may have a significant impact on the fairness, representativeness and legitimacy of the tribunals' proceedings and decisions. This book provides a comprehensive examination of the amicus curiae practice of the International Criminal Court and other major international criminal tribunals and offers suggestions for the role of the amicus curiae. In doing so, the authors develop a framework to augment the potential contributions of amicus participation in respect of the legitimacy of international criminal tribunals and their decisions, while minimising interference with the core judicial competence of the tribunal and the right of the accused to a fair and expeditious trial.

Punitive practices are highly revealing of a society's social fabric, its normative order, and power structure. Punishment in International Society examines the penal philosophies and practices in international society. The contributions to this book show the added value of a punitive lens to international politics in two major ways: First, punitive practices reveal the contours of the international normative order, its structures, and hierarchies. Such a perspective highlights the prominent position of individuals in the current normative order, but it also reveals a major divergence in the international normative order between a global North that emphasizes individualized, retributive punishment for atrocity crimes and a global South that puts reparations for past colonial wrongs on the agenda. Second, in contrast to a nation-state, the authority to sanction and act in defense of the normative order is far more dispersed and contested in international society. Although there is a demand to embed punitive practices in procedures and institutions, the most legitimate site of such authority remains contested as regional organizations such as the African Union compete with the United Nations for the authority to defend the normative order. This book brings together an international roster of scholars from the social sciences, law, and humanities. The contributions demonstrate that punitive practices have been more prevalent than commonly acknowledged as they have often been masked as (self-)defence, reparations, or coercive diplomacy. By approaching international punishment from various disciplines, this volume sheds new light on different dimensions of the punitive practices across the globe.

This secret society, believed by some to still exist today, has been the subject of countless debates and speculations. In this subchapter, we will delve into the fascinating history of the Illuminati, exploring its alleged roots and its infiuence on both government and corporate realms. The origins of the Illuminati can be traced back to the late 18th century, in Bavaria, Germany. Founded on May 1, 1776, by a Bavarian professor named Adam Weishaupt, the Illuminati's primary aim was to promote Enlightenment ideals and challenge the oppressive power structures of the time. Weishaupt sought to infiltrate influential institutions, such as government and academia, to bring about social and political change. The early years of the Illuminati were marked by secrecy and clandestine operations. Weishaupt and his close circle of intellectuals recruited members from various walks of life, including politicians, businessmen, and intellectuals. Through their network, the Illuminati aimed to spread their ideas and ideals, advocating for religious tolerance, rationality, and equality.

This edited volume addresses the broader aspects of the political and social landscape, human rights violations, accountability and advocacy efforts, and humanitarian challenges faced by the Rohingya from Myanmar. The work brings together different voices of legal, policy, and international affairs experts to construct a framework which addresses the complex and nuanced issues comprising the Rohingya crisis. Although there is recognition that international legal mechanisms are moving forward more quickly than anticipated, these processes do not constitute standalone sustainable solutions. Myanmar’s myriad political, social cohesion, development and security challenges are likely to persist even as justice and accountability processes move forward. Thus, this book project is premised on the consensus that the international community should complement international justice mechanisms by looking toward creative and multi-faceted approaches in addition to justice and accountability.
