Australia Reshaped is the capstone volume in the Reshaping Australian Institutions series. As the summation of all that has gone before, this book is structurally and qualitatively different from the others. Eight leading social scientists have been invited to write a major essay on a key element of Australian institutional life. Each chapter has the length and depth of a major contribution, acting as an overview of the field for both local readers and an international scholarly audience.

This 2006 book is structured around the themes of time, space and discourse as they are applied to our working lives.

Keith Hancock is honoured and celebrated in this work, following the significant contributions he made not only to academic research and teaching, but also to the practice of industrial relations, through the various roles he held as Professor, Vice-Chancellor, Senior Deputy President of the Australian Industrial Relations Commission and author of major government reviews and inquiries.The workshop held in his honour included a number of commentators. This book critically examines the proper role of the law in protecting job security in the contemporary workplace. It provides a historical, theoretical, practical and comparative perspective on this under-researched, but fundamentally important, legal mechanism at a time when the pressure to deregulate and dilute worker-protective laws has taken on increased importance. The volume critically analyses both statute and case law from three advanced industrialised liberal democracies with a common law foundation, the UK, Australia and the USA, to understand the extent to which job security is realised. By applying a common approach and a conceptual framework that emphasises the complex relationships between law, the economy and society to analyse a series of national studies, the book is also designed to draw upon the insights of comparative analysis to deepen our understanding of the limits and possibilities of legal regulation of job security. The national case studies are supplemented by research that focuses on how supra-national organisations have sought both to develop and disseminate new legal norms around the practices and processes of dismissal. This study critically analyses and assesses the adequacy of the international regulatory framework for protecting the rights of employees in the dismissal process.

Twenty-five years after independence, Papua New Guinea is beset by social, economic, and political problems: poverty and inequality, a young and expanding population, a stagnant economy, corruption, and rising crime. The state has not only failed to contain these problems but has become progressively implicated in their persistence. Escalating levels of violence and lawlessness are seen by many as the most serious challenge facing the young country. This book examines these problems of order in light of Papua New Guinea’s remarkable social diversity and the impact of rapid and pervasive processes of change. Three original and strategic case studies involving urban gangs, mining security, and election violence form the core of the work. Each case study looks at particular forms of conflict, and the responses these engender, across different socioeconomic contexts and geographic locations. Empirical data are analyzed through a common framework that employs material, cultural and institutional perspectives, allowing readers to view the three cases through different theoretical prisms, identify linkages between them, and, in the process, build a larger picture of the post-colonial social order. Law and Order in a Weak State charts not only the problems of crime and lawlessness in Papua New Guinea but also the possibilities for constructive, pragmatic solutions. This book offers a critical and timely account of how labour law has become a means for protecting employers rather than workers. The past few decades have witnessed something of a ‘silent revolution’ in the traditional protective role that labour law has played in the lives of workers. While this transformation has been overt in the realm of the market and at the level of the legislature, the role of the judiciary in this process remains significantly under-studied. Focussing on Australia, but drawing also on material from New Zealand, the UK and Canada, this book investigates how the common law has intervened to shape labour law in the image of commercial contract, determining disputes and defining legal issues by ignoring the realities of working life. Under this new conception of labour law, industrial relations between workers and employers are rarely reciprocal or relational. Rather, they are determined by the legal meaning and purpose of the contract of employment, drafted by lawyers for the benefit of employers and their human resources departments. Having demonstrated how approaches to contractual formalist legal reasoning have redefined labour law, this book goes on to propose an array of innovative legal and policy strategies to restore the protective role of labour law to the employment relationship.
