BOOK EXCERPT:
This book features a lively debate between two prominent scholars—Michael A. Genovese and David Gray Adler—on the critical issue of whether the Constitution, written in the 18th Century, remains adequate to the national security challenges of our time. The question of the scope of the president’s constitutional authority—if any—to initiate war on behalf of the American people, long the subject of heated debate in the corridors of power and the groves of academe, has become an issue of surpassing importance for a nation confronted by existential threats in an Age of Terrorism. This question should be thoroughly reviewed and debated by members of Congress, and considered by all Americans before they are asked to go to war. If the constitutional allocation of powers on matters of war and peace is outdated, what changes should be made? Is there a need to increase presidential power? What role should Congress play in the war on terror?

BOOK EXCERPT:
Ten years after the terrorist attacks of September 11, 2011, Rethinking the Law of Armed Conflict in an Age of Terrorism, edited by Christopher Ford and Amichai Cohen, brings together a range of interdisciplinary experts to examine the problematic encounter between international law and challenges presented by conflicts between developed states and non-state actors, such as international terrorist groups. Through examinations of the counter-terrorist experiences of the United States, Israel, and Colombia--coupled with legal and historical analyses of trends in international humanitarian law--the authors place post-9/11 practice in the context of the international legal community's broader struggle over the substantive content of international rules constraining state behavior in irregular wars and explore trends in the development of these rules. From the beginning of international efforts to rewrite the laws of armed conflict in the 1970s, the legal rules to govern irregular conflicts of the "state-on-nonstate" variety have been contested terrain. Particularly in the wake of the 9/11 attacks, policymakers, lawyers, and scholars have debated the merits, relevance, and applicability of what are said to be competing "war" and "law enforcement" paradigms of legal constraint--and even the degree to which international law can be said to apply to counter-terrorist conflicts at all. Ford & Cohen's volume puts such debates in historical and analytical context, and offers readers an insight into where the law has been headed in the fraught years since September 2001. The contributors provide the reader with differing perspectives upon these questions, but together their analyses make clear that law-governed restraint remains a cardinal value in counter-terrorist war, even as the law stands revealed as being much more contested and indeterminate than many accounts would have it. Rethinking the Law of Armed Conflict in an Age of Terrorism provides an important conceptual framework through which to view the development of the law as the policy and legal communities move into the second decade of the "global war on terrorism."

BOOK EXCERPT:
This brilliant new book by one of Europe's leading social thinkers throws light on the global power games being played out between global business, nation states and movements rooted in civil society. Beck offers an illuminating account of the changing nature of power in the global age and assesses the influence of the ever-expanding counter-powers. The author puts forward the provocative thesis that in an age of global crises and risks, a politics of "golden handcuffs" - the creation of a dense network of transnational interdependencies - is exactly what is needed in order to regain national autonomy, not least in relation to a highly mobile world economy. It is imperative that the maxim of nation-based realpolitik - that national interests have necessarily to be pursued by national means - be replaced by the maxim of cosmopolitan realpolitik. The more cosmopolitan our political structures and activities, Beck suggests, the more successful they will be in promoting national interests, and the greater our individual power in this global age will be.

BOOK EXCERPT:
As the activities of individuals, organizations, and nations increasingly occur in cyberspace, the security of those activities is becoming a growing concern. Political, economic and military leaders must manage and reduce the level of risk associated with threats from hostile states, malevolent nonstate actors such as organized terrorist groups or individual hackers, and high-tech accidents. The impact of the information technology revolution on warfare, global stability, governance, and even the meaning of existing security constructs like deterrence is significant. These essays examine the ways in which the information technology revolution has affected the logic of deterrence and crisis management, definitions of peace and war, democratic constraints on conflict, the conduct of and military organization for war, and the growing role of the private sector in providing security.
