To migrate or not to migrate: that is the question. This book discusses migration in the highly topical context of Ukraine, and explores the imaginations, life-stories, aspirations and life-projects of people in Ukraine through a consideration of Ukrainian migration to the European Union (EU) from the perspective of the sending-country. Building on the existing literature and drawing on a rich variety of empirical data and field research, this text addresses migration by Ukrainian nationals into the EU, and how and why people leave or stay in Ukraine. The book also considers questions of subjectivity, the self and the construction of narratives, and contributes more widely to the significant academic and policy debates surrounding Ukrainian migration in the EU.

A central question in the debate on justice in immigration is whether immigrants have a right to stay; this book argues that liberal-democratic receiving states should also grant migrants a right not to stay. This claim runs against the presumption that migrants always desire to move on a permanent basis and intend to forge a completely new life in the country of destination. From this perspective, temporary migration is always a second-best option for migrants, engendered by the closed and often punitive migration policies of receiving countries. This book's innovative focus on the right not to stay is prompted instead by the realization that increasing numbers of migrants throughout the world conceive and plan their migratory experience as circumscribed in time and instrumental to goals and projects that they will pursue once back in their country of origin. These temporary migration projects are worthy of being accommodated by the receiving states as much as the migratory plans of those who resolve or aim to immigrate on a permanent basis. Accommodating them entails setting up the appropriate welfare measures and programs in the host country and, through bi-lateral agreements, in the country of return. This is especially important in view of the fact that very often the migrants who engage in temporary migration projects find themselves in a condition of high vulnerability and risk. The "right not to stay" advocated in this book is a positive and substantive right to see one's project of temporary migration-and-return protected and accommodated by institutions.

This book discusses international migration in the newly independent states after the collapse of the Soviet Union, which involved millions of people. Written by authors from 15 countries, it summarizes the population movement over the post-Soviet territories, both within the newly independent states and in other countries over the past 25 years. It focuses on the volume of migration flows, the number and socio-demographic characteristics of migrants, migration factors and the situation of migrants in receiving countries. The authors, who include demographers, economists, geographers, anthropologists, sociologists and political scientists, used various methods and sources of information, such as censuses, administrative statistics, the results of mass sample surveys and in-depth interviews. This book analyses why the Ukrainian state established asylum laws and policies in the thirty years since 1991, even though the number of asylum seekers was very low. International and non-governmental organisations transferred international asylum norms to Ukraine. Various state and non-state actors participated in this process, translating, spreading, and resisting those norms. In many cases, legislative adoption was driven by domestic politicians’ pursuit of recognition by international organisations, such as the European Union and the Council of Europe, and by their desire to meet conditionality requirements. NGOs sought to influence administrative practices, alternating between confrontational and conciliatory, formal and informal approaches, and often relying on personal contacts. Actors used and shifted between scales in order to transfer norms or resist transfer. In the process, they produced, renegotiated, and confirmed those scales. For instance, NGOs resorting to the European Court of Human Rights to prevent refoulement placed the European scale above the national scale. This book offers a new multi-actor and multi-scalar analysis of policy transfer.
