This volume studies the outcomes of the two-way flow of investments and people between China and India, and Southeast Asia. These cross-border flows have led to new settlements in Southeast Asia from which new outlooks have emerged among locally born generations that have given rise to new forms of solidarity and identification.The advent of new generations of ethnic Chinese and Indians in Southeast Asia, with no ties to China or India, has spawned important debates about identity shifts which have not been registered by government leaders in Southeast Asia, China and India, as reflected in policy statements and investment patterns. Identity changes are assessed in forms where they best manifest themselves: in social life and in business ventures forged, or unsuccessfully nurtured, through tie-ups involving foreign and domestic capital. A state-society distinction is employed to determine how the governments of these rapidly developing countries envision development, through state intervention as well as with the employment of highly entrepreneurial ethnic groups, and the outcomes of this on their societies and on their economies. This book investigates the roots of rapid economic growth of India in recent decades, by exploring historical processes from the late colonial period. Based upon decades-long archival and field research, this book deals with the period from the late nineteenth century to 2013 and offers an integral viewpoint of the economic history of India. While critiquing the conventional understanding that links recent economic growth only with the development of high-tech, export-oriented service sectors under the liberalised economy, the book suggests deeper and wider roots of development that had a cumulative effect in three stages. First, the agrarian development and rural socio-economic changes from the end of the nineteenth century. Second, the state-led import-substitution industrialisation since 1950 that established the industrial foundations for future economic growth. Third, the economic reforms since 1991 that helped technology-intensive industries find new markets with improved quality of production. For the first time available in English, this book by the late Professor Haruka Yanagisawa, who was a leading figure in the South Asia studies collective in Japan, is an important contribution to the academic tradition of economic history of India. The right to social security, found in international law and in the constitutions of many nations, contributes to the alleviation of poverty globally. Social security and its articulation as a human right have received increased attention in recent years both in response to austerity cuts to welfare in developed countries and as a means of lifting millions out of poverty in developing countries. Women, disproportionately affected by poverty in all parts of the world, stand to gain from a right to social security that takes cognisance of gender discrimination and disadvantage. This book interprets and redefines the right to social security from a gender perspective. Drawing on feminist theory, the book formulates a conceptual approach and a set of principles for a substantively equal, gendered right to social security. In so doing, it challenges the relationship between the right to social security and traditional conceptions of work that exclude women’s labour including their caring roles. It argues that the right must have application at the transnational level if it is to address the changing nature of women’s work due to globalisation. The book applies the framework and principles it develops to a study of international law focusing on the work of key United Nations human rights bodies. It also demonstrates the value of this framework in its analysis of three countries’ social security programmes - South Africa, Australia and India. In combining feminist thought on the nature of work and care with equality theories in developing the right to social security from a gender perspective this book expands the capacity of the right to advance gender equality and address gendered poverty.

Few countries have achieved social development, which requires simultaneously securing market and social incorporation (good jobs and access to social services). This book reviews Costa Rica's experience as one of the few successful cases of double incorporation in the periphery.

Property as a human rights concern is manifested through its incorporation in international instruments and as a subject of the law through property-related cases considered by international human rights organs. Yet, for the most part, the relationship between property and human rights has been discussed in rather superficial terms, lacking a clear substantive connection or common language. That said, the currents of globalisation have witnessed a new era of interrelation between these two areas of the law, including the emergence of international intellectual property law and the recognition of indigenous claims, which, in fundamental ways, speak to an engagement with human rights law. This collection starts the conversation between human rights lawyers and property lawyers and explores analytical approaches to the increasing relationship between property and human rights in a global context. The chapters engage with key theoretical and policy debates and range across three main themes: The re-evaluation of the public/private divide in the law; the tensions between the market and social justice in development and the balance between the rights of individuals and those of communities.
