The interdisciplinary series “Law & Literature” takes a systematic look at the correlation between literature and the law. The studies presented in this series analyze the complex interrelation between two cultural spheres which are not only at the basis of Western Culture and Society, but share in a common focus on texts. Bringing together contributions by jurists, historians of law, legal philosophers, and specialists in literary and cultural studies, this series reflects a trend in current inter- and transdisciplinary research which has recently shown rapid growth both in Europe and the United States.

Through analysis of 5 plays by Shakespeare, Paul Raffield examines what it meant to be a 'stranger' to English law in the late Elizabethan and early Jacobean period. The numbers of strangers increased dramatically in the late sixteenth century, as refugees fled religious persecution in continental Europe and sought sanctuary in Protestant England. In the context of this book, strangers are not only persons ethnically or racially different from their English counterparts, be they immigrants, refugees, or visitors. The term also includes those who transgress or are simply excluded by their status from established legal norms by virtue of their faith, sexuality, or mode of employment. Each chapter investigates a particular category of 'stranger'. Topics include the treatment of actors in late Elizabethan England and the punishment of 'counterfeits' (Measure for Measure); the standing of refugees under English law and the reception of these people by the indigenous population (The Comedy of Errors); the establishment of 'Troynovant' as an international trading centre on the banks of the Thames (Troilus and Cressida); the role of law and the state in determining the rights of citizens and aliens (The Merchant of Venice); and the disenfranchised, estranged position of the citizen in a dysfunctional society and an acephalous realm (King Lear). This is the third sole-authored book by Paul Raffield on the subject of Shakespeare and the Law. The others are Shakespeare's Imaginary Constitution: Late Elizabethan Politics and the Theatre of Law (2010) and The Art of Law in Shakespeare (2017), both published by Hart/Bloomsbury.

There is often a communication disconnect between medical caregivers, including doctors, nurses, therapists, and other assistive medical personnel, and the patient. While medical staff usually understand a patient’s symptoms, causes, and treatments, communicating this understanding to a patient using industry terminologies can lead to confusion and misunderstanding, and similarly, patients may lack the vocabulary to effectively communicate their experiences back to their caregivers. A new approach to communication must be bridged between these groups by individuals who have experience on both sides of the conversation. Previous studies of doctors who end up in the role of the patient reveal how these individuals have a dual perspective on illness, combining their medical knowledge with their own personal medical experiences. Narratives, including autobiographical accounts and fictional stories, can help bridge the gap between experiential and academic knowledge of illness by expanding one’s limited perspective and accessing others’ points of view. Autobiographical and fictional narratives can both play a role in developing a more comprehensive understanding of illness beyond simply treating the disease. It is necessary to further examine the ethical and methodological underpinnings of narrative-based interventions in the education of healthcare professionals, practitioners, and patients. Global Perspectives on Probing Narratives in Healthcare offers a multidisciplinary examination of theoretical and methodological uses of narratives in healthcare by bringing together medical aspects of healthcare and the study of arts and humanities. This illustrates specific applications of narratives in healthcare settings, including improvement of clinical skills, performance of the caring role, and self-efficacy for building a true partnership in the patient’s health journey through varied approaches, up-to-date tools, and resources that can be transferred and adapted to specific educational and healthcare contexts. The Roma Tre Law Review (R3LR) is an open-source peer-reviewed e-journal which aims to offer a digital forum for scholarly debate on issues of comparative law, international law, law and economics, law and society, criminal law, legal history, and teaching methods in law.

The collection of essays presented here examines the links forged through the ages between the realm of law and the expressions of the humanistic culture.We collected thirty-five essays by international scholars and organized them into sections of ten chapters based around ten different themes. Two main perspectives emerged: in some articles the topic relates to the conventional approach of law and/in humanities (iconography, literature, architecture, cinema, music), other articles are about more traditional connections between fields of knowledge (in particular, philosophy, political experiences, didactics).We decided not to confine authors to one particular methodological framework, preferring instead to promote historiographical openness. Our intention was to create a patchwork of different approaches, with each article drawing on a different area of culture to provide a new angle to the history being told. The variety of authorial nationalities gives the collection a multicultural character and the breadth of the chronological period it deals with from antiquity to the contemporary age adds further depth of insight.As the element that unites the collection is historiographical interpretation, we wanted to bring to the fore its historical depth. Thus for every chapter we organized the articles in chronological order according to the historical context covered.Looking at the final outcome, it was interesting to learn that more often than not the connection between law and humanities is not simply a relation between a specific branch of the law and a single field of the humanities, but rather a relation that could be developed in many directions at once, involving different fields of knowledge, and of arts and popular culture.We are grateful to Luigi Lacchè for his contribution to this collection. This essential book provides an examination of the meanings of decolonisation and explores how this examination can inform teaching, researching, and practising of law. It explores the ways in which the foundations of law are entangled in colonial thought and in its [re]production of ideas of commodification of bodies and space-time. Thus, it is an exploration of the ways in which we can use theories and praxes of decolonisation to produce legal knowledge for flourishing futures.

This treatise investigates the emergence of the early modern law of nations, focusing on Alberico Gentili’s contribution to the same. A religious refugee and Regius Professor at the University of Oxford, Alberico Gentili (1552–1608) lived in difficult times of religious wars and political persecution. He discussed issues that were topical in his lifetime and remain so today, including the clash of civilizations, the conduct of war, and the maintenance of peace. His idealism and political pragmatism constitute the principal reasons for the continued interest in his work. Gentili’s work is important for historical record, but also for better analysing and critically assessing the origins of international law and its current developments, as well as for elaborating its future trajectories.

Promoting cultural and scientific creativity, and knowledge and understanding, cultural rights work as atrocity prevention tools and enable people to aspire to a better future.

Drawing upon theories of critical legal pluralism and psychological theories of narrative identity, this book argues for an understanding of popular culture as legal authority, unmediated by translation into state law. In narrating our identities, we draw upon collective cultural narratives, and our narrative/nomos obligational selves become the nexus for law and popular culture as mutually constitutive discourse. The author demonstrates the efficacy and desirability of applying a pluralist legal analysis to examine a much broader scope of subject matter than is possible through the restricted perspective of state law alone. The study considers whether presumptively illegal acts might actually be instances of a re-imagined, alternative legality, and the concomitant implications. As an illustrative example, works of critical dystopia and the beliefs and behaviours of eco/animal-terrorists can be understood as shared narrative and normative commitments that constitute law just as fully as does the state when it legislates and adjudicates. This book will be of great interest to academics and scholars of law and popular culture, as well as those involved in interdisciplinary work in legal pluralism.
